ORDINANCE NO. _10468
AN ORDINANCE OF THE CITY OF MIAMI, FLORIDA,
AUTHORIZING A BOND ELECTION TO BE HELD ON
TUESDAY, OCTOBER 4, 1988, WITH RESPECT TO THE
ISSUANCE OF NOT TO EXCEED $80,000,000 GENERAL
OBLIGATION BONDS OF THE CITY OF MIAMI,
FLORIDA, TO FINANCE THE COST OF ACQUISITION
OR CONSTRUCTION OF A MAJOR LEAGUE BASEBALL
STADIUM AND ITS RELATED FACILITIES IN THE CITY
OF MIAMI, FLORIDA, ISSUANCE OF WHICH SHALL BE
SUBJECT TO MAJOR LEAGUE BASEBALL OR AN OWNER
OF AN EXISTING MAJOR LEAGUE BASEBALL TEAM
EXECUTING A WRITTEN AGREEMENT TO USE SUCH
STADIUM FOR PLAYING OF HOME GAMES BY A MAJOR
LEAGUE BASEBALL TEAM, AND THE LEVYING OF A TAX
TO PAY THE PRINCIPAL AND INTEREST ON SUCH
BONDS; ESTABLISHING A FORM OF THE NOTICE OF
BOND ELECTION; ESTABLISHING A FORM OF THE
OFFICIAL BALLOT FOR SAID ELECTION; AUTHORIZING
CERTAIN OFFICIALS OF THE CITY TO TAKE ACTIONS
REQUIRED IN CONNECTION THEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
SECTION 1. This Ordinance is enacted pursuant to
the Charter of The City of Miami, Florida, Chapter 166,
Florida Statutes, the Constitution of the State of Florida
and other applicable provisions of the law.
SECTION 2. Notice of the bond election heretofore
called by Ordinance No. 10467 to be held on Tuesday,
October 4, 1988, shall be published in two newspapers of
general circulation published on a daily basis in The City
of Miami, Florida, at least twice, once in the fifth week
and once in the third week prior to the week in which that
election is to be held, the date of the first publication in
each of said newspapers to be at least thirty days before
said election, which notice shall be substantially in the
following form:

As provided by Ordinance No. 10467, duly adopted by the City
Commission of The City of Miami, Florida, on August 8, 1988,
an election will be held on Tuesday,
OCTOBER 4, 1988
For the purpose of submitting to the qualified
electors of The City of Miami, Florida, the following
question: +
"Shall general obligation bonds of The City of
Miami, Florida, in an aggregate principal
amount not exceeding eighty million dollars
($80,000,000) be issued under the provisions
of Ordinance No. 10467 for the purpose of pay-
ing the costs of PURCHASING OR CONSTRUCTING A
MAJOR LEAGUE BASEBALL STADIUM AND ITS RELATED

FACILITIES IN THE CITY OF MIAMI, FLORIDA, THE
ISSUANCE OF WHICH SHALL BE SUBJECT TO MAJOR
t` LEAGUE BASEBALL OR AN OWNER OF AN EXISTING
MAJOR LEAGUE BASEBALL TEAM EXECUTING A WRITTEN
AGREEMENT TO USE SUCH STADIUM FOR PLAYING OF
HOME GAMES BY A MAJOR LEAGUE BASEBALL TEAM,
such bonds to be issued at one time or from
time to time, but in no event earlier than the
execution of such agreement, and to mature at
such time and in such amounts as shall be sub-
sequently established by ordinance or resolu-
tion of the City Commission, but in no event
later than thirty (30) years from the date of
such bonds, to bear interest at rates not to
exceed the maximum rate permitted by Florida
law and to be payable from ad valorem taxes
and from such other sources as may be availa-
ble at a rate and in an amount sufficient to
pay debt service on such bonds and in the
event a franchise is not obtained no bonds
pursuant to the herein referendum will be
issued?"
Ordinance No. 10467 provides that for the prompt
payment of the principal of and interest on such issue of
bonds there shall be assessed, levied and collected a
separate tax, without limitation as to rate or amount, on
all taxable property within the corporate limits of The City
of Miami, Florida (excluding homestead exemptions as
required by applicable law), over and above all other taxes
authorized to be levied by The City of Miami, Florida, suf-
ficient to pay such principal and interest as the same
respectively become due and payable. Such issue of bonds
shall be redeemable prior to the maturity thereof at such
times and prices and under such terms and conditions as may
be established by subsequent ordinance or resolution of the
City Commission prior to the sale and issuance of such issue
of bonds.
The polls at said election will be open from
7:00 a.m. until 7:00 p.m. the same day.
The City of Miami, Florida shall be authorized to
issue said issue of the bonds if the question for the is-
suance of the bonds shall be approved by a majority of the
votes cast by the qualified electors of The City of Miami,
Florida, voting on such question.
Such bond election shall be held at the polling
places in The City of Miami, in the several election pre-
cincts designated by the Board of County Commissioners of
Dade County, Florida as set forth below, which are the same
polling places as for other elections of The City of Miami,
Florida.

and records which pertain to election

holding such special bond elections is

All registration cards, books, records and certifi-
cates pertaining to electors of The City of Miami, Florida
and established and maintained as official by the Supervisor
of Elections of Dade County, Florida, in conformity with the
provisions of the general laws of the State of Florida are
hereby adopted and declared to be, and shall hereafter be
recognized and accepted as, official registration cards,
books, records and certificates of The City of Miami,
Florida.
SECTION 4. Since The City of Miami, Florida, has
established the permanent registration system under state
law, and the general election laws of the State of Florida
require fourteen (14) days prior approval by the Board of
County Commissioners of Dade County, Florida, for acceptance
of branch office registration and that the registration
books be closed thirty (30) days prior to the date of such
bond election, registration for such bond election shall be
at the office of the Supervisor of Elections of Dade County,
Florida, 111 N.W. 1st Street, Miami, Florida.
SECTION 5. Said bond election shall be held at the
polling places in the several precincts, respectively, in
The City of Miami, Florida as set forth in the foregoing
Notice of Bond Election. Not less than twenty (20) days
before said election the City Commission shall designate the
Inspectors of Election and Clerk of Election for each pre-
cinct and, at least fifteen (15) days before the election,
shall publish the names of such Inspectors of Election and
Clerk of Election in a newspaper of general circulation pub-
lished in The City of Miami, Florida.
SECTION 6. All qualified electors of The City of
Miami, Florida, shall be permitted to vote in said election,
and the Supervisor of Elections of Dade County, Florida is
hereby requested, authorized and directed to furnish, at the
cost and expense of The City of Miami, Florida, a list of
all qualified electors residing in The City of Miami,
Florida, as shown by the registration books and records of
the office of said Supervisor of Elections, and to duly cer-
tify the same for delivery to and use of the election offi-
cials designated to serve at the respective polling places
in said election precincts.
SECTION 7. Matty Hirai, the City Clerk to The City
of Miami, Florida, is hereby designated and appointed as the
official representative of the City Commission of The City
of Miami, Florida, in all transactions with the Supervisor
of Elections of Dade County, Florida, in relation to matters
pertaining to the use of the registration books and the
holding of said election.
SECTION 8. The official ballot to be used at said
election shall be in full compliance with the laws of the
State of Florida with respect to absentee ballots and the
use of Computer Election System (CES), and shall be in sub-
stantially the following form:

SECTION 9. For the question described above,
Electors desiring to vote for the approval of said question
shall be instructed to punch straight down with the stylus
through the hole next to the phrase "FOR THE MEASURE (For
Bonds)" within the ballot frame containing the statement
relating to the question, and electors desiring to vote
against said question shall be instructed to push straight
down with the stylus through the hole next to the phrase
"AGAINST THE MEASURE (Against Bonds)" within the ballot
frame containing the statement relating to said question.
SECTION 10. The City Clerk shall cause to be pre-
pared absentee ballots containing the question set forth in
Section 8 above for the use of absent electors entitled to
cast such ballots in said election.
SECTION 11. This Ordinance shall be effective im-
mediatly upon its adoption.
