J-88-675 9/8/88 ORDINANCE NO. 10474 AN ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AUTHORIZING A BOND ELECTION TO BE HELD ON NOVEMBER 8, 1988, WITH RESPECT TO THE ISSUANCE OF (i) NOT TO EXCEED $35,000,000 STREET AND HIGHWAY IMPROVEMENT BONDS AND (ii) NOT TO EXCEED $10,000,000 WATERFRONT IMPROVEMENT BONDS, OF THE CITY OF MIAMI, FLORIDA, AND THE LEVYING OF A TAX TO PAY THE PRINCIPAL AND INTEREST THEREON; ESTABLISHING A FORM OF THE NOTICE OF BOND ELECTION; ESTABLISHING A FORM OF THE OFFICIAL BALLOT FOR SAID ELECTION; AUTHORIZING CERTAIN OFFICIALS OF THE CITY TO TAKE ACTIONS REQUIRED IN CONNECTION THEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: SECTION 1. This Ordinance is enacted pursuant to the Charter of The City of Miami, Florida, Chapter 166, Florida Statutes, the Constitution of the State of Florida and other applicable provisions of the law. SECTION 2. Notice of the bond election heretofore called by Ordinance No. 10473 to be held on Tuesday, November 8, 1988, shall be published in two newspapers of general circulation published on a daily basis in The City of Miami, Florida, at least twice, once in the fifth week and once in the third week prior to the week in which that election is to be held, the date of the first publication in each of said newspapers to be at least thirty days before said election, which notice shall be substantially in the following form: NOTICE OF BOND ELECTION to be held on TUESDAY, NOVEMBER 8, 1988 in THE CITY OF MIAMI, FLORIDA As provided by Ordinance No. 10474, duly adopted by the City Commission of The City of Miami, Florida, on September 8, 1988, an election will be held on Tuesday, NOVEMBER 8, 1988 For the purpose of submitting to the qualified electors of The City of Miami, Florida, the following questions: (1) "Shall bonds of The City of Miami, Florida, in an aggregate principal amount not exceeding thirty-five million dollars ($35,000,000) be issued under the provisions of Ordinance No. 10473 for the purpose of paying the costs of STREET AND HIGHWAY IMPROVEMENTS in The City of Miami, Florida, such bonds to be issued at one time or from time to time, and to mature at such time and in such amounts as shall be subsequently established by ordinance or resolution of the City Commission, but in no event longer than twenty (20) years from the date of such bonds, to bear interest at a rate or rates not to exceed the maximum rate per- 1.0474 mitted by Florida law and to be payable from ad valorem taxes unlimited as to rate and amount?" (2) "Shall bonds of The City of Miami, Florida, in an aggregate principal amount not exceeding ten million dollars ($10,000,000) be issued under the provisions of Ordinance No. 10473 for the purpose of paying the costs of WATERFRONT IMPROVEMENTS in The City of Miami, Florida, such bonds to be issued at one time or from time to time, and to mature at such time and in such amounts as shall be subse- quently established by ordinance or resolution of the City Commission, but in no event longer than twenty (20) years from the date of such bonds, to bear interest at a rate or rates not to exceed the maximum rate permitted by Florida law and to be payable from ad valorem taxes unlimited as to rate and amount?" Ordinance No. 10473 provides that for the prompt payment of the principal of and interest on each such issue of bonds there shall be assessed, levied and collected a separate tax, without limitation as to rate or amount, on all taxable property within the corporate limits of The City of Miami, Florida (excluding homestead exemptions as required by applicable law), over and above all other taxes authorized to be levied by The City of Miami, Florida, suf- ficient to pay such principal and interest as the same respectively become due and payable. Each such issue of bonds shall be redeemable prior to their respective maturi- ties at such times and prices and under such terms and con- ditions as may be established by subsequent ordinance or resolution of the City Commission prior to the sale and is- suance of each such issue of bonds. The polls at said election will be open from 7:00 a.m. until 7:00 p.m. the same day. The City of Miami, Florida shall be authorized to issue any said issue of bonds if the question for the is- suance of that particular issue of bonds shall be approved by a majority of the votes cast by the qualified electors of The City of Miami, Florida, voting on each such question. Such bond election shall be held at the polling places in The City of Miami, Florida, in the several elec- tion precincts designated by the Board of County Commissioners of Dade County, Florida as set forth below, which are the same polling places as for other elections of The City of Miami, Florida. A description of the registration books and records which pertain to election precincts wholly or partially within The City of Miami, Florida, and which The City of Miami, Florida is adopting and desires to use for holding such special bond elections is as follows: All registration cards, books, records and certifi- cates pertaining to electors of The City of Miami, Florida and established and maintained as official by the Supervisor of Elections of Dade County, Florida, in conformity with the provisions of the general laws of the State of Florida are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of The City of Miami, Florida. SECTION 4. Since The City of Miami, Florida, has established the permanent registration system under state law, and the general election laws of the State of Florida require fourteen (14) days prior approval by the Board of County Commissioners of Dade County, Florida, for acceptance of branch office registration and that the registration books be closed thirty (30) days prior to the date of such bond election, registration for such bond election shall be at the office of the Supervisor of Elections of Dade County, Florida, 111 N.W. 1st Street, Miami, Florida. SECTION 5. Said bond election shall be held at the polling places in the several precincts, respectively, in The City of Miami, Florida as set forth in the foregoing Notice of Bond Election. Not less than twenty (20) days before said election the City Commission shall designate the Inspectors of Election and Clerk of Election for each pre- cinct and, at least fifteen (15) days before the election, shall publish the names of such Inspectors of Election and Clerk of Election in a newspaper of general circulation pub- lished in The City of Miami, Florida. SECTION 6. All qualified electors of The City of Miami, Florida, shall be permitted to vote in said election, and the Supervisor of Elections of Dade County, Florida is hereby requested, authorized and directed to furnish, at the cost and expense of The City of Miami, Florida, a list of all qualified electors residing in The City of Miami, Florida, as shown by the registration books and records of the office of said Supervisor of Elections, and to duly cer- tify the same for delivery to and use of the election of of- ficials designated to serve at the respective polling places in said election precincts. SECTION 7. Matty Hirai, the City Clerk to The City of Miami, Florida, is hereby designated and appointed as the official representative of the City Commission of The City of Miami, Florida, in all transactions with the Supervisor of Elections of Dade County, Florida, in relation to matters pertaining to the use of the registration books and the holding of said election. SECTION 8. For each such question described above, Electors desiring to vote for the approval of said question shall be instructed to punch straight down with the stylus through the hole next to the phrase "FOR THE MEASURE (For Bonds)" within the ballot frame containing the statement relating to said question, and electors desiring to vote against said question shall be instructed to push straight down with the stylus through the hole next to the phrase "AGAINST THE MEASURE (Against Bonds)" within the ballot frame containing the statement relating to said question. Any question may be approved by the majority of votes cast for that question regardless of whether either of the other questions is approved by majority vote. SECTION 10. The City Clerk shall cause to be pre- pared absentee ballots containing the questions set forth in Section 8 above for the use of absent electors entitled to cast such ballots in said election. Odio ENCLOSURES (For July 14, 1988 Citv Manazer Commission Meeting)___ RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached two (2) Ordinances for first reading providing for the holding of a Bond Election in the City of Miami on November 8, 1988, for the issuance of $40,000,000 Street and Highway Improvement Bonds and $10,000,000 Waterfront Improvement Bonds. BACKGROUND The Department of Public Works has completed the City's capital improvement needs for street and highway rebuilding for fiscal years 1988-1994. It has been determined that expenditures of $40,000,000 will be needed during this period in order to maintain a 50-60 year life cycle for this element of the City's infrastructure. These bond funds will finance the rebuilding of 66 miles of streets with an additional resurfacing of 270 miles of streets. Delays in providing street and highway improvements will very likely result in roadway deterioration which could necessitate costly rebuilding rather than less costly resurfacing. Additionally, well maintained streets are needed to support Miami's continued growth and to alleviate traffic congestion. In addition to the requirements of the City's Street Improvement Program, the Department of Public Works has identified a need and desirability for waterfront improvements totaling $10,000,000. The improvements are expected to be accomplished at the following sites: - FEC Slip, Bicentennial Park Watson Island - Virginia Key - Wagner Creek - 16 Park sites at various locations throughout the City. Improvements would include new bulkheading, dredging, repair or reinforcement of existing bulkheads, shoreline stabilization, peripheral landscaping, safety rails and dolphins, cleats, fenders and other large -ship mooring facilities (at FEC Slip). 10474� a q -1 CITY OF MIAMI PROPOSED $40,000,000 STREET AND HIGHWAY BOND AUTHORIZATION COST IMPACT INFORMATION; Assumptions Bonds issued over 8 years Interest rate assumed at 8% 20 year maturity for each series of bonds Property assessments increasing at 3% per year Single family residences (average value) increasing at 30/0' per year Homestead exemptions remain at $25,000 TOTAL COST OVER THE TERM OF THE BONDS $76,050,574 AVERAGE ANNUAL COST OVER THE'TERM OF THE BONDS $ 207I6,091 The City's outstanding General Obligation debt chan.ges annually as old debt is retired and new debt issued. Priority List for Highway Improvements The Highway General Obligation Bond Funds are nearly depleted. There are insufficient funds to complete the fiscal year 1987- 1988 street improvement program.. The Department requests that approval of a General Obligation issue for Highway Improvements be placed on the ballot in November, 1988. The Department recommends a bond issue of the following amount which ,should provide sufficient funds for completion of the proposed'1988-1994 Capital Improvement Program. Additionally, we have identified needs for shoreline improvements adjacent to public lands in the amount of $10,000,000. A final program to be included in the 1988-94 C.I.P. will be completed within the week which will outline these improvements. Highway G.O.B. Issue of $40,000,000 Waterfront G.O.B. Issue of $10,000,000 In order to meet the required deadlines for ballot approval in the fall, these issues should ve brought before the City Commission no later than the regular meeting in July 1988.
