Odio 'JJJ City Manager III W1 DAT[ "' ' 19t�d rnLC ""j«' Item PZ-5 Discussion Item Remaining Heritage Conservation Agenda R[ICR9NLtf [NCL06URcs Most of the remaining Heritage Conservation agenda items (PZ-6 through PZ-25) have not received affirmative letters from property owners. At this point, after public hearing, they can a) be tabled, continued or deferred; b) be denied, or c) be approved. The Planning Department continues to recommend that all these items be approved especially the four properties in which the owners approve. Three property owners did not respond and the designations should be continued. However, if the City Commission decides W to approve the remaining items, the Department then recommends that these items be denied -- not tabled, continued or deferred. 10 in accord with the historic reservation requirements of the Downtown Miami Development of Regional Impact (r,RI) Master Development Order (Resolution 87-1148, Condition 12) and the Southeast Overtown/Park West Development of Regional impact (DRI) Master Development Order (Resolution 88-110, Condition 11), the City of Miami Planning Department is attempting to have all properties that were identified as historic in the development orders designated as Heritage Conservation districts under Article 16 of Ordinance 9500, the zoning ordinance of the City of Miami, Florida, as amended. At the request of City Commission, the Planning Department has solicited letters from property owners indicating whether or not they approve of the proposed designations. Letters have been received from almost every property owner; however, it has been impossible to contact some owners. Responses received are as follows: Four approve (PZ-6, 7, 9 and 10). - Three did not respond (PZ-12, 20 and 23). Page I of 2. Ten oppose designation (PI-8, 11, 13, 15-17, 21, 22, 24, and 25). The Downtown ilagler District (PZ-18) split: 3 owners approve and 9 oppose. - The tummus Park District (P2-14) split: 6 owners approve and 2 oppose. At this point, the remaining heritage conservation items can a) be tabled, continued, or deferred; b) be denied; or c) be approved. If the Commission decides not to approve certain items, it is recommended that the items be denied -- not tabled, continued or deferred. The reasons for this are two -fold: 1. Each property is presently under a moratorium that precludes issuance of any building permit or a demolition permit for the property, unless the owner applies to the Heritage Conservation Board for an accelerated Certificate of Appropriateness and such Certificates has been issued under the provisions of Article It of Ordinance 9500. This moratorium is in effect until the.City Commission legislatively acts on the item. 2. Any request for remodeling, building additions or demolitions for property, identified as historic by either the Downtown or Southeast Overtown/Park West Development Orders, must be referred to the State Historic Preservation Officer and to the Planning Department for review and comment. However, the Commission could only eliminate these referrals by subsequently amending the conditions of the Development Orders. It is anticipated that a property owner would prefer a decision now, in preference to continuing the item.
