RESOLUTION NO. NS-91S3
A RESOLUTION AUTHORIZING THE ISSUANCE OF A
REVOCABLE USE PERMIT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, TO THE NICARAGUAN AMERICAN
FOUNDATION FOR AN AREA OF 1,118 SQ. FEET IN
HENDERSON PARK.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The issuance of a Revocable Use Permit, in a
form acceptable to the City Attorney, to the Nicaraguan American
Foundation for an area of 1,118 square feet in Henderson Park, is
hereby authorized.
Section 2. This Resolution shall become effective
immediately upon its adoption pursuant to law.

Please place Maritza Herrera and David Raskosky, of the Nicaraguan American
Foundation, as a discussion item on the October 27 agenda regarding the
renovation of the revocable permit for Henderson Park. The Foundation, which
has refurbished the building at its awn cost, has been providing immigration
status legalization assistance to Nicaraguans and other recent immigrants frcan
this location. Although the Foundation inadvertently failed to renew the permit,
it would like to correct the oversight.
If it is not possible to place this on the October 27 agenda, please include this
as one of the first discussion items for the first meeting in November.

Dear Mr. Odio:
This is in reference to the notice received from
Mr. Albert J. Armada, copy of which I am enclosing,
instructing us to vacate the premises that the
Nicaraguan American Foundation is presently occupying
in Henderson Park.
As Mr. Armada correctly states, we failed to request on
a timely basis a renovation of the Use Permit granted to
us by Resolution passed on April 8, 1988. We are now
trying to correct that oversight and would like to
request your assistance.
The Nicaraguan American Foundation was formed by a group
of private citizens to help nicaraguans, and other needy
persons, in their effort to adjust to their new condition
as recent arrivals in this community. We found out that
immigration status legalization was an area in which we
could be of significant help even with the very modest
resources at our disposal.
Largely through the efforts of our Executive Director,
Maritza Herrera, we were able to qualify our organization
as one of the eleven Qualified Designated Entities
providing assistance in completion of Applications for
legalization under the Amnesty Law.
I would like to point out that we were one of the most
successful participants in this program. Out of the
eleven organizations originally qualified, only three
remained active for the duration and we were one of the
three. We were able to help obtain legal status not only
to many nicaraguans but persons from many other
nationalities as well.

Since we began operating in May of 1987, 3,969 persons
have visited our office seeking assistance. So far we
have successfully completed 1,092 Amnesty and political
asylum applications and have helped obtained jobs to 186
persons. We have provided counseling and avice to practi-
cally every person that has visited our office.
Right now we are finalizing negotiations with Miami Dade
Community College to structure a program through which
the College will provide us assistance for English
classes for those who having applied for status under
the law, need to learn the language to qualify for permanent
residence.
Everything we have accomplished so far is due only to the
hard work and dedication of our permanent (and I should
add underpaid) staff of three persons. Our only means
of support are the very modest fees we charge for the
services and private contributions from friends. Loosing
the use of the premises would be a devastating blow to our
organization, we simply do not have the means to pay for
rent.
I urge you to reconsider your decision to ask us to vacate
the premises. We are providing a significant contribution
to this community at very little cost to the.City. Without
your support we would be unable to continue.

On April 8, 1987, Resolution No. 87-343 was passed authorizing
the issuance of a Revocable Use Permit for 1,118 square feet in
Henderson Park to the Nicaraguan American Foundation for a one
year period. The Permit was executed by the City Manager on May
4, 1987.
Section 2, Time, of the referenced Permit states that:
"This Revocable Permit shall be valid for a period of
one year, commencing on the second day of March, 1987,
and terminating on the first day of March, 1988....
This Revocable Permit may be extended for additional
one year periods upon request of PERMITTEE, submitted
in writing at least one hundred twenty (120) days prior
to the termination date,'as approved by the City
Commission on a yearly basis".
The Nicaraguan American Foundation did not submit a request to
the City for an additional one year extension. As such the
Permit expired March 1, 1988.

Pursuant to the provisions of Section 2 of the Revocable Use
Permit issued to the Nicaraguan American Foundation, Inc., on May
4, 1987, the City of Miami requests that you vacate said Demised
Premises within thirty (30) upon receipt of this notice.
Please give this matter your immediate attention.
