AN ORDINANCE AMENDING ORDINANCE NO. 9500, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, BY AMENDING PAGE 1 OF THE
OFFICIAL SCHEDULE OF DISTRICT REGULATIONS IN
"PRINCIPAL USES AND STRUCTURES," "RG-1.
GENERAL RESIDENTIAL (ONE- AND TWO-FAMILY)"
SPECIFICALLY BY RESTATING PARAGRAPH 3 UNDER
THE HEADING "PERMITTED GENERALLY" TO LIMIT
THE NUMBER OF DWELLING UNITS TO TWO; BY
ADDING NEW PARAGRAPH 2 UNDER THE HEADING
ENTITLED "PERMISSIBLE ONLY BY SPECIAL PERMIT"
TO PROVIDE FOR A SPECIAL EXCEPTION FOR THREE
OR MORE DWELLING UNITS; AND BY AMENDING
"MINIMUM LOT REQUIREMENTS," "RG-1. GENERAL
RESIDENTIAL (ONE- AND TWO-FAMILY)" BY
DELETING THE EXCEPTION WHICH PROVIDES THAT
SEMIDETACHED STRUCTURES MAY BE ON MINIMUM LOT
WIDTHS OF 25 FEET FOR EACH UNIT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 2, 1987, Item No. 4, following an advertised
hearing, adopted Resolution 48-87 vote of 8 to 1, RECOMMENDING
APPROVAL, of amending Ordinance No. 9500 as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 9500 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance 9500, as amended, the Zoning
Ordinance of the City of Miami, Florida, is herein amended by
amending Page 1 of the Official Schedule of District Regulations,
made a part of Zoning Ordinance 9500, in the following

PETITION 4. Per Motion 87-517; May 28, 1987, reconsideration
of amending Ordinance 9500, as amended, the
Zoning Ordinance of the City of Miami, Florida,
by amending the Official Schedule of District
Regulations, a part of said -.Ordinance 9500, page
1 of 6, RG-1 GENERAL RESIDENTIAL (One and Two
Family), Uses and Structures, Principal Uses and
Structures, Permitted Generally, to restate
paragraph 3 to limit the number of dwelling
units to two; to introduce new paragraph-2 under
the heading "Permissible Only by Special Permit"
to provide that three or more dwelling units are
permissible only by special exception; and by
amending Minimum Lot Requirements, to delete the
exception -in the following paragraph that
currently provides that semidetached structures
may be on minimum lot widths of 25 feet for each
unit.
(Note: Former Amendment "S" has been divided
into Amendments "S-1" which has been adopted as
Ordinance 10267; "S-2" which has been remanded
to the Planning Advisory Board, and a remainder
of Amendment "S" which has been withdrawn and
will be sent to the Planning Advisory Board).
(Note: Amendment S-2 was heard on the Planning
Advisory Board Agenda of July 1, 1987 and
withdrawn by the Planning Department to
eliminate ambiguities).'
REQUEST To amend Zoning Ordinance 9500 by making a
special exception if excess net lot area in RG-1
is proposed to be either converted for use or
used for new construction.

BACKGROUND On May 22, 1987, the City Commission consiaerea
Amendment "S-2" and, remanded the Item oy Motion
87-517, as follows:
"A MOTION INSTRUCTING• THE ADMINISTRATION TO
REFER BACK TO THE PLANNING ADVISORY BOARD A
PROPOSED SECOND READING ORDINANCE (AMENDMENT "S-
2" TO ORDINANCE 9500 - BY AMENDING OrrICIAL
SCHEDULE OF OISTRICT REGULATIONS - MAKING
DELETIONS AND DELETING CERTAIN REOUIREMENTS) IN
ORDER THAT T1r PAS MAY DETERMINE IF EACH
APPLICATION CAN STAND ON ITS OWN AS AN
EXCEPTIONAL USE
ANALYSIS These amendments would:
1. Clarify that one additional dwelling unit
could be added, wnere a lot in RG-1 already
had one existing owelling unit provided that
the net lot area per owelling unit was 2500
square feet.
Z. Rtouire special exception approval, if
permission were sought .to build tree or
more dwelling units in RG-1 districts. For
example, a property owner of a 7500 sq-ft.
lot, with an -existing two farmi 1 y detached or
o,.e family semidetacned dwelling could
petition for an additional single family
unit on the oasis of 1 unitl2500 sq-ft.
3. Eliminate a provision that would allow
certain lots to be su bdividet! to 25' in
width.
RECOMMENDATIONS
PLANNING DEPT. Approval,
PLANNING ADVISORY BOARD At its meeting of Sectemoer 2. 1987, the Planning
Advisory Boara adocted Resolution PAB 48-87 oy a
vote of 8-1, recommending approval of the aoove.
CITY COMMISSION At its meeting of October 22, 1987, the City
Commission continued the aoove to its meeting
of Novemoer 12, 1987.
The decision of the December 2nd meeting will
be oresented at the December 10th City Lommission
nearing.
