Home My WebLink AboutO-10502ORDINANCE i 050z AN ORDINANCE AMENDING ORDINANCE NO. 8719, AS AMENDED, ADOPTED OCTOBER 26, 1977, BY APPROPRIATING FOR THE IMPLEMENTATION OF AN AMENDED TRUST AND AGENCY FUND ENTITLED: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR, THE ADDITIONAL SUM OF $1,625,150 AT PRESENT ALLOCATED AS PROGRAM INCOME REVENUE IN PREVIOUS YEAR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS; SAID AMOUNT TO BE TRANSFERRED FROM SAID REVENUE FUNDS AND ALLOCATED AS BUDGET FUNDS IN THE TWELFTH (12TH) YEAR CITYWIDE SINGLE FAMILY HOUSING REHABILITATION PROJECT TOTALLING $1,022,422 AND CITYWIDE MULTIFAMILY RENTAL REHABILI- TATION GRANT LEVERAGING SUBSIDY PROJECT TOTALLING $602,728 TO BE CARRIED OUT BY THE HOUSING CONSERVATION AND DEVELOPMENT AGENCY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10444 on June 9, 1988, appropriating trust and agency funds in the increased amount of $201,955; and WHEREAS, additional revenue from the repayments of Single family and Multifamily Housing Rehabilitation loans totalling $1,625,150 have been credited to the fourth (4th) through twelfth (12th) year CDBG funds respectively as program income; and WHEREAS, the correct amount have been credited to the fourth (4th) through twelfth (12th) years Community Development accounts in compliance with federal rules and regulations to fund other eligible rehabilitation activities; and WHEREAS, the herein ordinance is a proper vehicle to appropriate the aforesaid amount of $1,625,150; and IL0502 WHEREAS, the Housing Conservation and Development Agency implements the Single family and Multifamily Housing Rehabilitation Program on a Citywide basis; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 2. Section 1 of Ordinance No. 8719 adopted October 26, 1977, is hereby amended in the following particulars:l/ "Section 1. The following Trust and Agency Funds are hereby established and resources are hereby appropriated as described herein." FUND TITLE: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR RESOURCES: FEDERAL GRANT - U.S. DEPARTMENT OF HOUSING URBAN DEVELOPMENT -3,106,TTS 13,732,105 APPROPRIATION: COMMUNITY DEVELOPMENT BLOCK GRANT TWELFTH (12TH) YEAR 12,106,9 13,732,105" Section 2. The herein amended appropriation of $13,732,105 for Community Development refers to those publicly supported physical development activities and those related social or economic development activities being carried out within a reasonable period of time in accordance with the approved Grant Program Final Statement, said increased funds in the amount of $1,625,150'!'(as well as all future revenues likewise generated), are to be allocated :$1,022,422 for the Citywide Single Family Housing Rehabilitation Project and $602,728 for the Citywide Multifamily Rental Rehabilitation Grant Leveraging Subsidy Project to be carried out by the Housing Conservation and Development Agency. Section 3. All ordinances or parts of ordinance insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. Remaining provisions are now in effect and remain unchanged. 2 No monies are to be disbursed therefrom without City Commission approval. -2- 10502 Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid the remaining provisions of this Ordinance shall not be affected. BACKGROUND: The Department of Community Development has prepared.the appropriate legislation which the City. Commission adopted through Ordinance No. 10145 adopted September 11, 1986, establishing appropriations for 1.2th Year CDBG. The Housing Conservation and Development Agency implements the CDBG Single Family and Multifamily Housing Rehabilitation Program. The above mentioned Fourth (4th) through Twelfth (12th) Year amounts •were credited as program income. In order to make those funds available for the Twelfth (12th) Year CityAde Single Family Housing Rehabilitation fund and Citywide Multifamily Rental Rehabilitation: Grant Leveraging Subsidy find, it becomes necessary that they be allocated as budget funds.
