J-88-858 8/31/88 ORDINANCE NO. 1.0491i AN ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION (SECTOR NUMBER ONLY) OF APPROXIMATELY 2101 NORTHWEST 19TH TERRACE, MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED HEREIN) FROM RG-2/4 GENERAL RESIDENTIAL TO RG-2/5 GENERAL RESIDENTIAL BY MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 25 OF SAID ZONING ATLAS MADE A PART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300, THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board, at its meeting of July 11, 1988, Item No. 4, following an advertised hearing, adopted Resolution No. ZB 94-88, by a 9 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification (Sector Number Only) of approximately 2101 Northwest 19th Terrace, Miami, Florida, more particularly described as Lots 43-50 inclusive, Block 2, Alexander Court, as recorded in Plat Book 26 at Page 65 of the Public Records of Dade County, Florida, from RG-2/4 General Residential to RG-2/5 General Residential. Section 2. It is hereby found that this zoning classification change: t" M (a) Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (o) Will not create an isolated district unrelated to adjacent and nearby districts; (d) 2s not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, eto.; (2) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 25 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. -2- 104915 PASSED ON FIRST READING BY TITLE ONLY this 27th day of September , 1988. Bichachi and Fortuna Bichachi (the "Owners") in favor of The City Of Miami (the "City") RECITALS The Owners are the owners of the real property legally described on Exhibit "A" to this Declaration (the "Property"). The Owners desire to develop the Property in a manner compatible with the surrounding properties and in order to insure that such compatible development does in fact occur, the Owners make the following Declaration of Restrictions covering and running with the Property: DECLARATIONS 1. Height Limitation. The height of any building constructed on the Property shall not exceed forty-five (45) feet. 2. City Contribution. A contribution in the amount of $5,000.00 shall be paid to the City of Miami within thirty (30) days of the acceptance of this Declaration by the City Com- mission which contribution shall be used by the City for any valid public purpose. 3. Affordable Housing. To the extent permitted by law, the Owners agree that in the event the Owners construct dwelling units on the Property, said units shall be maintained as affordable and liveable housing units. Said units if one (1) bedroom units shall be at least 500 square feet and if two (2) bedrooms units at least 650 square feet. 4. Binding Effect. The restrictions set forth in this Declaration during their lifetime shall be for the benefit of, and limitation upon, all present and future owners of the Property and for the public welfare. This Declaration on the ` part of the Owners shall constitute a covenant running with the land and may be recorded in the public records of Dade County, Florida, and shall remain in full force and effect and be binding upon the owners ,their heirs, successors and assigns until such time as it is modified or released. 5. Term. This Declaration is to run with the Prop- erty and shall be binding on all parties and persons claiming under them for a period of thirty (30)' years from the date it is recorded, after which time it shall be extended automatically for successive periods of ten (10) years, unless an instrument signed by a majority of the then owner(s) of the Property has been recorded agreeing to change the Declaration in whole, or in part, provided the Declaration has first been released by the City. 6. Modification. This Declaration may be modified, amended or released as to the Property or any portion thereof, by the owner(s) of the fee simple title to the portion of the Prop- erty to be affected by such modification, amendment or release provided that the same is also approved by the City Commission or City Zoning Board (whichever by law has jurisdiction over such matters) after public hearing. Should this Declaration be so modified, amended or released the Director of the City Building and Zoning Department or Zoning Administrator, or his successor shall forthwith execute a written instrument effectuating and acknowledging such modification amendment or release. 7. Enforcement. Enforcement shall be by action at law or in equity against any party or persons violating or attempting to violate any covenants contained in this Declara- tion, either to restrain violation or to recover damages. The prevailing party in such action or suit, shall be entitled to recover, in addition to costs and disbursements allowed by law, such sum as the court may adjudge to be reasonable for the serv- ices of his attorney. 8. Severability. SECOND READING ORDINANCE: 2101 N.W. 19 TERRACE: Comprehensive Neighborhood Plan amendment from moderate density of moderate -high density residential. -------------------------------------------------------------------------- - CAS 13 October 27, 1988 Mayor Suarez: We're going to continue the planning and zoning agenda so that we can handle those matters that left over from the morning as quickly as possible. Guillermo, we're at PZ... Mr. Guillermo Olmedillo: PZ-26 and 27 are companion items. There was a concern - this is for property located on 2101 N.W. 19th Terrace and there was a concern as to the price of the units and the height of the building. The applicant has proffered a voluntary covenant by which he will not exceed 45 feet, he will contribute $5,000 to the park fund and the size and the price of the units is going to be limited by this covenant. Mr. De Yurre: What number are we on? Mayor Suarez: Twenty-six, 27 companion items. Mr. Sergio Rodriguez: Twenty-six... Mr. Olmedillo: Twenty-six and twenty-seven. Mr. Plummer: OK, well this I'm holding out and you want me to get that done. Mr. Rodriguez: Second reading. Mr. Olmedillo: Twenty-six is the plan amendment, 27 is the zoning change and the covenant goes with the zoning change. Mr. De Yurre: Is this the one they donated the $5,000 to the program, is that the one? Mr. Rodriguez: Right. Mrs. Kennedy: Covenant, um hum. Mr. Olmedillo: That is correct. Yes, the covenant covers four items. One is the height, two is the contribution, three is the size of the units and four is the affordable price of the unit. Mayor Suarez: OK, all the covenants and concessions are in place. This is the second reading. Do we have anyone here that is opposed to this item? If not, I'll entertain a motion.
