Also enclosed is a copy of the response to Mr. Pearson's letter by Sergio Rodriguez, Director of the City of Miami, dated September 16, 1988. Please be advised that I do wish to make a personal appearance before the City Commission related to the request for a fee waiver for St. Alban's Day Care Center. Would you please be kind enough to put my name on the City Commission Agenda and inform me of the day and time when I can appear and request the filing fee waiver in person. Thank you. W. 2nd Miami, Florida Dear Jack: Peon, _McGuire :6sociutes Planning _ Street 33128 As president of the Board of Directors of St. Alban's Day Nursery in Coconut Grove, I am writing to formally request that you waive N the filing fee we are currently required to pay in order to submit our plan for an addition to a classroom at St. Alban's. As you probably know, we are a non-profit organization entirely dependent upon Head Start, state and local funding for our existence. The plans for the addition are being drawn without fee by Grove resident Alfred Browning Parker. The funds for the addition are being donated entirely by Grove residents (we are raising the money now). All of us serve without compensation. St. Alban's cares for more than 425 children of working mothers every day. It is a service desperately needed by the community. We have more than 200 children on a waiting list whom we cannot even take in because of lack of space and funding. It is therefore important that we conserve every penny we can toward capital construction of our facilities, including the money we would have to pay the City for approval of our plans. We are also asking the city commission to waive the fee due for appearing before them to ask for their approval. Please let me know whether you can do this, as we intend to submit our plans to you shortly. Thanks for your help and consideration. ODIO City Manager It is certainly an indication of your community concern that the Board of Directors of St. Alban's Day Nursery is going ahead with your classroom addition. Your volunteers are to be congratulated and encouraged in this project. In response to your letter of July 12, 1988 (attached), to Jack Luft, Chief of Urban Design, of the Planning Department, I have no authorization to waive the filing fee required when you request: a) Class C Special Permits; b) a special exception from the Zoning Board; or c) when you request a building permit based on approval of your construction documents. To my knowledge, it is not procedurally necessary under the Zoning Ordinance or building code for your group to appear before the City Commission to request formal approval; unless appealed, variances and special exceptions are decided by the Zoning Board. However, if you wish to make a personal appearance before the City Commission to consider your request for a fee waiver, please contact Mr. Aurelio Perez-Lugones, Legislative Administrator, of the City Manager's staff at 579-3467, and further your request by letter to the City Manager.
