SS71063 A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMn�INT OF $22,470.24 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND MARKS BROTHERS COMPANY DATFD APRIL 3n, 19P7 FOR THE CONSTRUCTION OF NORTH RIVER DRIVE HIGHWAY IMPROVEMENT (THIRD BIDDING) IN NORTH RIVEP. DRIVE HIGHWAY IMPROVEMENT DISTRICT H-4501 CIP PROJECT NO 341103, SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10347, AS AMENDED, WITH FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR - FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION; FURTHER ACCEPTING THE COMPLETED WORK OF MARKS BROTHERS COMPANY AT A TOTAL COST OF $1,754,663.99; AND AUTHORIZING A FINAL PAYMENT OF $470,490.93. WHEREAS, there exists a contract dated April 30, 1987 between the City of Miami, Florida and Marks Brothers Company for NORTH RIVER DRIVE HIGHWAY IMPROVEMENT (THIRD BIDDING) IN NORTH RIVER DRIVE HIGHWAY IMPROVEMENT DISTRICT H-4501 CIP Project No. 341103; and j WHEREAS, an increase in contract of $22,470.24 is required to cover the cost of planting fifty-one (51) Mahogany -' trees with root guards, as required by the Planning Department; { and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to be done; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs; and WHEREAS, funds to cover the increase are available from money already allocated to the project; and _ WHEREAS, all of the work included in the contract and the proposed increase in contract has been satisfactorily completed by Marks Brothers Company and they have furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; a n d CITY COMMISSION MEETING OF NOV 3 1988 RESOLUTION No. 88 106 REMARKS: I WHEREAS, the City Manager and the Director of the Department of Public Works recommend acceptance of the completed work and authorization of final payment to the contractor; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four - fifths of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, Florida and Marks Brothers Company for the construction of North River Drive Highway Improvement (Third Bidding) in North River Drive Highway Improvement District H-4501 CIP Project No. 341103 dated April 30, 1987 is hereby increased by $22,470.24 with funds for the increase to be provided from monies already allocated to the project. Section 3. The completed work performed by Marks Brothers Company for NORTH RIVER DRIVE HIGHWAY IMPROVEMENT (THIRD BIDDING) in NORTH RIVER DRIVE HIGHWAY IMPROVEMENT DISTRICT H-4501 C.I.P. Project No. 341103 is hereby accepted at a total cost of $1,754,663.99. Section 3. The proper officials of the City of Miami are hereby authorized to pay Marks Brothers Company a balance of $470,490.93 as full and final payment for all work performed and all materials furnished in connection with the aforesaid contract. DISTRICT CIP Project No. 341103 RtfEnENCEs Resolution for Increase in ENCLOSURES Contract and Final Payment It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract in the amount of $22,470.24 in the contract between the City of Miami, Florida and Marks Brothers Company for the construction of NORTH RIVER DRIVE HIGHWAY IMPROVEMENT (TIIIRD BIDDING) in NORTH RIVER DRIVE HIGHWAY IMPROVEMENT DISTRICT H-4501 CIP Project No. 341103; said funds to be provided from the Capital Improvements Ordinance No. 10347, as amended, with funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted fron emergency circumstances by an affirmative vote of four -fifths of the members of the City Commission and adopting the finding and conclusions set forth in the preamble of this resolution; further accepting the completed work of Marks Brothers Company, at a total cost of $1,754,663.99; and authorizing a final payment of $470,490.93. BACKGROUND: The Department of Public Works has determined that it is now in order for the Commission to authorize an increase in contract amount, accept the completed work and authorize final payment. after all conditions are met for the North River Drive Highway Improvement (Third Bidding) in North River Drive Highway Improvement District H-4501 - CIP Project No. 341103. The North River Drive Highway Improvement (Third Bidding) in North River Drive Highway Improvement District H-4601 has been completed by Marks Brothers Company. The project consisted of constructing 0.8 miles of North River Drive between N.M. 5 Street and S.W. 2 Avenue including; clearing and grading, asphaltic pavement, concrete curb, gutters and sidewalks, decorative paver sidewalk, storm sewer facilities and landscaping. 1 0 O C T- 2 S- 8 8 T U E 1 2: 0 3 P LNG - P U S W O R K S P. 0 4 After the tree planting was substantially completed south of Flagler Street, the City determined additional trees were required other than the Queen Palms specified and already planted. Fifty-one (51) Mahogany trees with seven (7) feet of clear trunk, including root guards, were required to be planted. At thirteen (13) locations new concrete paver base had to be removed to install the root guards. The cost for these additional Mahogany trees with root guards is $33,617.00. As required by City ordinances, an increase of $10,000 or more in a City contract must be accompanied by a finding by the City Manager that the increase resulted from emergency circumstances, and such a finding has been prepared and signed. It is further required that a Public Hearing be held, and the Public Hearing has been scheduled. The contractor on the project has satisfactorily completed all of the work included in the original contract, and the work covered by the proposed $22,470.24 increase in contract, for a total cost of $1,754,663.99. Odi ENCIosuREs : Emergency Need for Increase City Manager in Contract Based on information supplied to me by the Director of the Public Works Department, I have found that there exists an emergency need for an increase in contract amount of $22,470.24 in the contract between the City of Miami, Florida and Marks Brothers Company for the construction of North River Drive Highway Improvement (Third Bidding) in North River Drive Highway Improvement District - H-4501. The reason for the emergency need is as follows: After the tree planting was substantially completed south of Flagler Street, the City required that fifty-one (51) Mahogany trees with seven (7) feet of clear trunk, including root guards, be planted in addition to the existing Queen Palms.
