NS--10.511 A RESOLUTION ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER AND REJECTING ALL BIDS/PROPOSALS RECEIVED BY THE CITY IN CONNECTION WITH THE LOCAL DRAINAGE PROJECT E-57 FOR CONSTRUCTION OF FRENCH DRAINS, AUGUER WELLS, CATCH BASINS AND MANHOLES AS WELL AS PAVEMENT REPLACEMENT, CURBS, GUTTERS AND SIDEWALKS; FURTHER DIRECTING THE CITY MANAGER TO SEEK NEW BIDS/PROPOSALS BASED ON SUCH SPECIFICATIONS AS HE DEEMS APPROPRIATE FOR THE PROCUREMENT OF SAID SERVICE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recommendation of the City Manager is hereby accepted and all bids/proposals received by the City in connection with the Local Drainage Project E-57 for construction of french drains, auguer wells, catch basins and manholes as well as pavement replacement, curbs, gutters and sidewalks are hereby rejected. Section 2. The City Manager is hereby directed to seek new bids/proposals based on such specifications as he deems appropriate for the procurement of said service. Section 3. B- 5 5 4 3 SUBJECT: Resolution Awarding Contract LOCAL DRAINAGE PROJECT E-57 REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution accepting the low bid of M. Vila & Associates, Inc., for Local Drainage Project E-57, received June 23, 1988 in the amount of $990,675.00, Base Bid plus additive bid of the proposal; accepting the Chief Procurement Officer's rejection of a protest in connection with said bid; and authorizing the City Manager to enter into a contract on behalf of the City. BACKGROUND Amount of Bid: $990,675.00 % of Cost Estimate: 99% Cost Estimate/Budgeted Amount: $1,000,000/$1,200,000 Source of Funds: CIP Ordinance No. 10347, as amended Minority Representation: 201 invitations mailed 15 contractors picked up plans & specs (3 Hispanic, 3 Black, 0 Female) 3 contractors submitted bids (2 Hispanic, 1 Black, 0 Female) Public Hearings/Notices: Bid notice published as required. Assessable Project: No Discussion: The Department of Public Works has evaluated the bids received on June 23, and determined that the lowest responsible and responsive bid, in the amount of $99U,675.00 is from M. Vila & Associates, Inc., a hispanic minority controlled corporation. Wit1liams, Director 1 ENCLOSURE& Ilovitch & Manella's General Services Administration Letter Attached is a copy of a letter from Ilovitch & Manella, P.A.- which serves as Solo Construction's official protest to the City of Miami in regard to the award of Bid #87-88-104, "Local Drainage Project E-57". As Chief Procurement Officer, I have reviewed the protest and the procedures which have led to the award of Bid #87-88-104 to M. Vila and Associates, Inc. and it is my conclusion that the protest of Solo Construction is without merit and it is hereby rejected by me for the following reasonsr 1. There is no power of attorney for the bond, as per City Code. 2. There is no affidavit as to capital & surplus of bonding company, as per City Code. 3. Proposal is unsigned and not sealed, as per requirement on page 3. 4. There are no unit prices written in words, only lump sum prices. � 5. The bid proposal was not submitted in duplicate originals, as required in the advertisement for bids. In accord with the provisions of Section 18-56.1(b) of the Code of the City of Miami, please sign below indicating your recommendation and approval of this bid protest resolution.
