RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION
FINDING THAT THE PLAN: OF THE WYNWOOD
COMMUNITY ECONOMIC DEVELOPME14T CORPORATION
FOR THE PROPOSED WYNWOOD INDUSTRIAL PARK ARE
CONSISTENT WITH THE OBJECTIVES OF THE CITY OF
MIAMI PORTION OF THE NORTH CENTRAL DADE
COUNTY E14TERPRISE ZONE, THE WYNWOOD LOCAL
GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT
(ORDINANCE NO. 10406), THE GARMENT
CENTER/FASHION DISTRICT REDEVELOPMENT PLAN
(RESOLUTION NO. 79-553) (JULY, 1979) THE
MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN AND
ADDENDA (SEPTEMBER 1985) AND EXISTING,
APPLICABLE CITY OF MIAMI REGULATIONS.
WHEREAS, the State of Florida Community Contribution Tax
Incentive Program (§220.183 F.S.) is designed to encourage
private businesses to participate in the revitalization of
distressed areas; and
WHEREAS, business firms are permitted under the Community
Contributions Tax Program to make contributions to community
development projects and receive tax credits on their Florida
corporate taxes, or on an insurance premium tax liability owed to
the State; and
WHEREAS, the Wynwood Community Economic Development
Corporation is a licensed Florida community development
corporation; and
WHEREAS, the Wynwood Community Economic Development
Corporation, a non-profit corporation, is an eligible sponsor of
donations under the State of Florida Community Contributions Tax
Incentive Program, and is willing to receive contributions under
this program; and
WHEREAS, the Wynwood Community Economic Development
Corporation is planning projects which are designed to construct
or substantially rehabilitate industrial, commercial, housing, or
public facilities, in a distressed area, and to promote
entrepreneurial and Job development opportuniti

WHEREAS, an industrial park and Foreign Trade Zone area, to
be known as the Wynwood Industrial District, is being planned by
the Wynwood Community Economic Development Corporation and the
City of Miami, in an area within the City of Miami, generally
bounded by Northwest 2 and 24 Streets on the North, by Northwest
21 Terrace and Northwest 22 Street on the South, Northwest 2
Avenue on the East, and Northwest 6 Avenue on the West; and
WHEREAS, a major portion of the Wynwood target area is
included in the City of Miami Portion of the North Central Dade
County Enterprise Zone established under Chapter 290, Florida
Statutes, and Dade County Resolutions R-1001-86 and R-1126-86 and
City of Miami Resolution No. 86-589.1; and
WHEREAS, the Proposed Foreign Trade Zone arer- is totally
contained within the Wynwood Local Government Neighborhood
Improvement District, A Safe Neighborhood District, established
under the terms of Section 163.506, F.S., and by City of Miami
Ordinance No. 10406; and
WHEREAS, development is occurring within the City of Miami in
accordance with the Comprehensive Neighborhood Plan (September
1985), and Garment/Center Fashion District Redevelopment Plan
(July, 1979) and with the various City regulations;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Miami City Commission hereby finds that the
plans attached hereto of the Wynwood Community Economic
Development Corporation for a proposed Wynwood Industrial Park
are consistent with the provisions of the City of Miami Portion
of the North Central Dade County Enterprise Zone (Resolutions R-
1001-86 and R-1126-86 and City of Miami Resolution No. 86-589.1),
the Wynwood Local Government Neighborhood Improvement District
(Ordinance 10406), the Miami Comprehensive Neighborhood Plan and
Addenda (September 1985), Garment Center/Fashion District
Redevelopment Plan (Resolution No. 79-553) (July, 1979) and
existing, applicable City of Miami regulations. 4

On Thursday, August 4, 1998 the International Trade Board reviewed
the Overtown-Wynwood Foreign Trade Zone Project being proposed by
William Rios, Executive Director of the Wynwood Community Economic
Development Corporation. Based on the findings of the City of
Miami Planning Department as reported by Mr. John Lefley, it is
the recommendation of this board that the City Commission pass a
resolution stipulating that the proposed Overtown-Wynwood Foreign
Trade Zone Project is consistent with existing City plans and
regulations. (Please check the plans to see if this is true).
Passage of this resolution will position the Wynwood Community
Economic Development Corporation to receive donations of land and
property under the provisions of the Community Contribution Tax
Incentive Program (Chapter 220.193 F.S.), which is one of the
State of Florida business incentives available under the Florida
Enterprise Zone Act (Chapter 290 F.S.).

OF FLORIDA STATUTES 220.183 AND 624.5105
Dear Mrs. Howard:
The Wynwood Community Economic Development Corporation, a non-profit community
based organization, requests sponsorship status for corporate donations under
the various provisions of the Florida Enterprise Zone legislation.
In accordance with your Community Contribution Tax Incentive Program
Guidelines, we are submitting the following documents:
1. A copy of the Article of Incorporation and a copy of the By -
Laws of the Wynwood Community Economic Development Corporation.
2. A project description paper entitled "Overtown-Wynwood Foreign
Trade Zone".
3. A map showing the portions of the Wynwood and Overtown
Communities that are contained within the City of Miami area
designated as an Enterprise Zone, from January 1, 1987 through
December 31, 1994, and the boundaries of the proposed Overtown-
Wynwood Foreign Trade Zone.
4. City of Miami' Resolution No. which states that the
proposed project is consistent with local plans and
regulations.

OYERTOWN-WYNWO00 FOREIGN TRADE ZONE
Name Overtown-Mynwood Foreign Trade Zone
Location An area bounded by N.W. 24 Street on the North, N.N. 22
Street and N.M. 21 Terrace on the South, N.W. 2 Avenue on
the East, and N.W. 6 Avenue on the West.
Project
Description Creation of an Overtown-Wynwood based Foreign Trade Zone to
provide affordable warehouse and manufacturing space for
small size and minority businesses. Project provides for
the assemblage of both public and private parcels into an
area suitable for designation as a subzone of an existing
zone, or new zone defined under the terms of Public Law 397,
as amended, generally known as the Foreign Trade Zones Act.
The parcels may be in public or private ownership, developed
or undeveloped. Development involves new construction,
rehabilitation of existing industrial structures, parking,
loading docks, and facilities for the United States Customs
Service. The project may be planned in tandem with
complimentary legislation and training programs aimed at
fostering positive social interaction among legitimate
users, and is designed to promote a positive employment and
business development climate through the reduction of crime
by employing defensible space architectural and planning
techniques. In addition the project is designed to promote
economic self-sufficiency in depressed minority areas and
Enterprise Zones.

"The term "zone" means a "foreign -trade zone".
It is an isolated, enclosed, and policed area,
operated as a public utility, in or adjacent to
a port of entry, furnished with facilities for
loading, unloading, handling, storing,
mainipulating, manufacturing, and exhibiting
goods, and for reshipping them by land, water,
or air. Any foreign and domestic merchandise,
except such as is prohibited by law or such as
the Board may order to be excluded as
deterimental to the public interest, health, or
safety may be brought into a zone without being

subject to the customs laws of the United
States governing the efttry of goods or the
payment of duty thereon; and such merchandise"
permitted in a zone may be stored, exhibited,
manufactured, mixed or manipulated in any
manner, except as provided in the act and other
applicable laws or regulations. The
merchandise may be exported, destroyed, or sent
into customs territory from the zone, in the
original package or otherwise. It is subject
to customs duties if sent into customs
territory, but not if reshipped to foreign
points."
Existing
Conditions The area contains approximately parcels and
approximately structures. Approz3'maTely t of
the land area 7s vacant. The dominant industriaTTand use
is located immediately to the north of the proposed site.
This existing industrial complex is almost entirely devoted
to manufacturing the production and export of apparel,
fashion accessories, assemply and textiles and furniture.

Approximately 24.76 net acres, approximately 31 gross acres,
including approximately 12.2 net acres of City -owned vacant
land.

Project
Objectives
and Benefits - Provide employment for *low-income residents and new
immigrants.
- Provide foreign trade opportunities for small and
minority businesses.
- Attract apparel firms to locate in existing industrial
areas adjacent to proposed Foreign Trade Zone.
- Provides business advantages through the following
techniques; use of the Foreign Trade Zone concept; the
Enterprise Zone designation; recognition of this site as
a prime location for expert activities; the Safe
Neighborhood defensible space program; duty reduction
through use of the Carribbean Basin Initiative (CB1);
through awareness of the adjacent existing infrastructure
for industrial, co=ercial, retail, and housing uses.
- Development of economic self-sufficiency by focusing on
economic expansion generated by the enterprise zone and
safe neighborhood legislation.

Implementation
Strategy Assemble parcels through a combination of publicly -owned
properties, and icquisi*ion of private properties, using
funds derived from Industrial Revenue Bonds, land leverage,
and Enterprise Zone Donation Tax Incentives.
Neighborhood and Economic Development.
Construction of new structures with funds derived from the
following:
* Florida Safe Neighborhoods Act
* Industrial Revenue Bonds
* U.S. EDA Funds
* U.S. HHS Funds
* Enterprise Zone (tax contribution donations)
Liquid Assets, Real Property, Goods, Inventory,
and In -kind Services
* Economic Development Transportation Fund
Emphasis on international trade and assembly industries,
to take advantage of various preferential tariff provisions,
as defined in the Caribbean Basin Recovery Act (CBI), and on
incentives contained in the legislation application to
Enterprise Zones and Foreign Trade Zones.
Utilize UDAG, HHS, and EDA grant and loan programs for
planning and construction phases of programs and Enterprise
Zone Tax Credit Donations.
Utilize various tax -savings provisions of the State of
Florida Enterprise Zone legislation as an industrial
development tool, an as a cost -saving device for tenants of
both the zone and the surrounding industrial areas.
Enter into an agreement with existing Free Trade Zone
operators for operation of the proposed Overtown-Mynwood
Foreign Trade Zone.
Obtain matching construction funds through the
designation of the site as a Safe Neighborhood Improvement
District.
Base U.S. Department of Labor training programs with the
local community development corporation, the Mynwood
Community Economic Development Corporation.

The Coemmity Contribution Tax 2neentive "ram is designed to 't
