SR-1 nn`l A RESOLUTION OFFICIALLY ACCEPTING THE ATTACHED CITY CLERK'S CERTIFICATION AND DECLARATION OF THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON OCTOBER 4, 1988, IN WHICH THE ISSUANCE OF NOT TO EXCEED $80,000,000 GENERAL OBI_,IGATION BONDS OF THE CITY OF MIAMI, FLORIDA, TO FINANCE THE COST OF ACQUISITION OR CONSTRUCTION OF A MAJOR LEAGUE BASEBALL STADIUM AND ITS RELATED FACILITIES IN THE CITY OF MIAMI, FLORIDA, ISSUANCE OF WHICH SHALL BE SUBJECT TO MAJOR LEAGUE BASEBALL OR AN OWNER OF AN EXISTING MAJOR LEAGUE BASEBALL TEAM EXECUTING A WRITTEN AGREEMENT TO USE SUCH STADIUM FOR PLAYING OF HOME GAMES BY A MAJOR LEAGUE BASEBALL TEAM, AND FURTHER SUBJECT TO THE PROVISION THAT IF A FRANCHISE NOT BE OBTAINED THEN NO BONDS PURSUANT TO THE REFERENDUM - WOULD BE ISSUED AND THE LEVYING OF A TAX TO PAY THE PRINCIPAL AND INTEREST ON SUCH BONDS WAS DISAPPROVED BY THE ELECTORATE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby officially accepts the attached City Clerk's Certification and Declaration of the results of the Special Municipal Election held on October 4, 1988, in which the issuance of not to exceed $80,000,000 General Obligation Bonds of the City of Miami, Florida, to finance the cost of acquisition or construction of a Major League baseball stadium and its related facilities in the City of Miami, Florida, issuance of which shall be subject to Major League baseball or an owner of an existing Major League baseball team executing a written agreement to use such stadium for playing of home games by a Major League baseball team, and further subject to the provision that if a franchise not be obtained then no bonds pursuant to the referendum would be issued, and the levying of a tax to pay the principal and interest on such bonds was disapproved by the electorate. r- ^� CITY CUi'y2I'��IISSION 8 �'�'??e'���°°'!' The City Commission hereby declares: (a) with respect to said question of the issuance of not to exceed $80,000,000 General Obligation Bonds of the City of Miami, Florida, to finance the cost of acquisition or construction of a Major I.,eague baseball stadium and its related facilities in the City of. Miami, Florida, issuance of which shall be subject to Major League baseball or an owner of an existing Major League baseball team executing a written agreement to use such stadium for playing of home games by a Major League baseball team, and further subject to the provision that if a franchise not be obtained then no bonds pursuant to the referendum would be issued, and the levying of a tax to pay the principal and interest of such bonds, said election was duly called and properly held and notice thereof was duly given in accordance with law and Ordinance No. 10468, adopted August 8, 1988, entitled: "AN ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AUTHORIZING A BOND ELECTION TO BE HELD ON TUESDAY, OCTOBER 4, 1988, WITH RESPECT TO THE ISSUANCE OF NOT TO EXCEED $80,000,000 GENERAL OBLIGATION BONDS OF THE CITY OF MIAMI, FLORIDA, TO FINANCE THE COST OF ACQUISITION OR CONSTRUCTION OF A MAJOR LEAGUE BASEBALL STADIUM AND ITS RELATED FACILITIES IN THE CITY OF MIAMI, FLORIDA, ISSUANCE OF WHICH SHALL BE SUBJECT TO MAJOR LEAGUE BASEBALL OR AN OWNER OF AN EXISTING MAJOR LEAGUE BASEBALL TEAM EXECUTING A WRITTEN AGREEMENT TO USE SUCH STADIUM FOR PLAYING OF HOME GAMES BY A MAJOR LEAGUE BASEBALL TEAM, AND THE LEVYING OF A TAX TO PAY THE PRINCIPAL AND INTEREST ON _ SUCH BONDS; ESTABLISHING A FORM OF THE NOTICE OF BOND ELECTION; ESTABLISHING A FORM OF THE OFFICIAL BALLOT FOR SAID ELECTION; AUTHORIZING CERTAIN OFFICIALS OF THE CITY TO TAKE ACTIONS REQUIRED IN CONNECTION THEREWITH; AND PROVIDING AN EFFECTIVE DATE."; (b) all steps in connection with said election were duly, regularly and lawfully taken and had; and all applicable provisions of the Constitution and Statutes of the State of Florida and of said Ordinance have been fully complied with; F - k- -2- 8871004 k 0 (c) the inspectors and clerks of each election precinct in the City have duly made returns of the results of the election in each such precinct on the question submitted at said election; (d) at said election there was submitted to the qualified electors of the City of Miami, Florida, the following question: "Shall general obligation bonds of The City of Miami, Florida, in an aggregate principal amount not exceeding eighty million dollars ($80,000,000) be issued under the provisions of Ordinance No. 10467 for the purpose of paying the costs of PURCHASING OR CONSTRUCTING A MAJOR LEAGUE BASEBALL STADIUM AND ITS RELATED FACILITIES, IN THE CITY OF MIAMI, FLORIDA, THE ISSUANCE OF WHICH SHALL BE SUBJECT TO MAJOR LFAGUE BASEBALL OR AN OWNER OF AN EXISTING MAJOR LEAGUE BASEBALL TEAM EXECUTING A WRITTEN AGREEMENT TO USE SUCH STADIUM FOR PLAYING OF HOME GAMES BY A MAJOR LEAGUE BASEBALL TEAM, such bonds to be issued at one time or from time to time, but in no event earlier than the execution of such agreement, and to mature at such time and in such amounts as shall be subsequently established by ordinance or resolution of the City Commission, but in no event later than thirty (30) years from the date of such bonds, to bear interest at rates not to exceed the maximum rate permitted by Florida law, and to be payable from ad valorem taxes and from such other sources as may be available at a rate and in an amount sufficient to pay debt service on such bonds and in the event a franchise is not obtained no bonds pursuant to the herein referendum will be issued?"; (e) the attached schedule correctly shows the number of each of the election precincts in the City of Miami, the number of electors entering the voting machine booths for the purpose of voting, the number of votes cast by qualified electors approving said question, and the number of votes cast by qualified electors disapproving said question; (f) each qualified elector of the City of Miami was given the opportunity of voting for or against the question. -3- 88-'1004 P Section 3. On October 4, 1988, commencing at approximately 5:00 P.M. the Dade County Supervisor of Elections had the tabulating equipment based at the Elections Department and O.C.S.I.S. offices at the Metro -Dade Center was once again tested to ascertain that the equipment would correctly count the precinct votes cast for the measures. At the completion of the precinct ballot count, the automatic - tabulating equipment was again tested to ascertain that the equipment correctly counted the precinct votes cast for the measures. On October 5, 1988, commencing at approximately 9:00 A.M., the = Dade County Supervisor of Elections had the tabulating equipment based at the Elections Department and O.C. S.I.S. offices, at the Metro -Dade Center, was tested to ascertain that the equipment would correctly count the absentee ballot votes cast for the measures. At the completion of the absentee ballot count, the automatic tabulating equipment was again tested to ascertain that the equipment correctly counted the absentee ballot votes cast for the measures. I do hereby further certify that all documents concerning these Logic and Accuracy Tests showed the computer to be functioning correctly and are in the possession of the Supervisor of Elections of Metropolitan Dade County, under sealed vault. On September 30, 1988, commencing at approximately 9:00 a.m., the Dade County Supervisor of Elections had the tabulating equipment based in the Elections Department and O.C.S.I.S. offices at the Metro -Dade Center tested to ascertain that the equipment will correctly count the precinct and absentee ballot votes cast for all candidates and measures. 2.
