AN ORDINANCE AMENDING ORDINANCE NO. 10347,
ADOPTED NOVEMBER 19, 1987, AS AMENDED, THE
CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE,
BY INCREASING THE APPRUPRIATIUN FUR COCONUT
GROVE STORM SEWERS, PROJECT NO. 352187, IN
THE AMOUNT OF $80,000; AND CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10347 on
November 19, 1987, to establish appropriations for capital
improvements, continue previously approved capital improvement
projects, and establish new capital improvement projects to begin
during fiscal year 1987-88; and
WHEREAS, said Ordinance No. 10347, appropriated $600,000
for the construction of Coconut Grove Storm Sewers, Project No.
352187; and
WHEREAS, the scope of the proposed construction in, Coconut
Grove Storm Sewers was increased after said Ordinance No. 10347
was adopted to alleviate additional drainage problems in the
Coconut Grove area; and
WHEREAS, competitive bids were received on September 20,
1986 for construction of Coconut Grove Storm Sewers and based on
the lowest acceptable bid submitted by Miri Construction Inc.,
the total project cost being $680,000; and
WHEREAS, the low bid may be withdrawn by the contractor if
a contract is not awarded within 60 days of the date of the bid
opening; and
WHEREAS, it is now in order to increase the funds
appropriated for Coconut Grove Storm Sewers, Project No. 352187,
from $6UU,000 to $680,000 in Storm Sewer General Obligation Bonds
to enable a contract to be awarded to Miri Construction Inc, for
construction of said project;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. " Section 1 of Ordinance No. 10347, as amended,
adopted November 19, 1987, is hereby amended in the following
particulars: 1/
"Section 1. The herein appropriations are hereby
made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin
during fiscal year 1987-88. The herein
appropriations which are hereby designated by
reference to descriptive project title and number
also include appropriations for previously approved
scheduled projects as well as re -appropriations of
prior fund appropriations. The source of revenues to
support the herein appropriations is hereby
identified by fund and project with the project
appropriations and revenues therefor being set forth
for seven program areas (I-VII) based upon use or
functional category within said areas, as follows:

Section 2. If any section, part of section, paragraph,

clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 3. All ordinances, or parts of ordinances insofar
as they are inconsistent or in conflict with provisions of this
ordinance are hereby repealed.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached ordinance amending Ordinance No. 10347, the City's
Capital Improvement Appropriations Ordinance, to increase the
appropriation for Coconut Grove Storm Sewers, Project No. 352187.
BACKGROUND
The Department of Public Works, in an effort to implement the
City's Storm Drainage Master Plan and to serve .all residents of
the City of Miami, is proposing an amendment to the City's
Capital Improvement Appropriations Ordinance No. 10347 to
increase the appropriation for Coconut Grove Storm Sewers,
Project No. 352187, by $80,000.
Ordinance No. 10347, adopted on November 19, 1987, appropriated
$600,000 for Coconut Grove Storm Sewers. Subsequent to .the
passage of the ordinance and during the design phase of the
project, the Department of Public Works decided to expand the
scope of the project to alleviate additional drainage problems in
the Coconut Grove area.
Competitive bids were received for the project on September 20,
1988. Based on the lowest acceptable bid submitted by Miri
Construction Inc., the total project cost will be $680,000.
Since only $600,000 has been appropriated, an additional $80,000
must be appropriated in order to award a contract and proceed
with the project. According to the C i t y ' s standard contract
documents, the contractor has the right to withdraw his bid if a
contract is not awarded within 60 days of the date of 'the bid
opening.
The additional $80,000 are available from the 1984 Storm Sewer
General Obligation Bond. Fund.
