Long Project Manager Bayfront Park Redevelopment Following is a status report of the Bayfront Park Redevelopment Including the projects done by the U.S. Army Corps of Engineers and work being done to erect the Challenger 7 Memorial within the southwest corner of the park. It will report upon and elude to, the present status of the Professional Services Agreement the City has with Fuller and Sadao P.C. for the consulting services related to the park redevelopment. The construction projects reported upon pertain to 10 Capital Improvement Program Projects including 34 separate funding sources some of which pertain to more than one C.I.P. Project and more than one Construction Contract. One of the C.I.P. Projects (*031335), pertains to the three Corps of Engineers projects which does not Include any of the funding sources because they were not funded by the City. CITY CONSTRUCTION PROJECTS BAYFRONT PARK REDEVELOPMENT - PHASE I Contractor: PNM Corporation Amount of Contract: $750,038.00 Began: May 31. 1985 Project Description: This project covered all of the landscaping, transplanting, top soil, sod and temporary Irrigation for all of the park north of the Flagler Street Promenade. It also provided new landscaping materials. :.t Project Status: The pro j ect Is essent I a I ty comp i,etecf removal of of some stored top so1I, debrIs and dead trees from the Chopin Plaza area (that area of the park south of the:__.;_, Flagler Street Promenade) remains to be done. Final payment. on the project Is being delayed, pending resolution of a =; dispute with the contractor. Regardless of the resolution of the dispute we expect no overrun of the contract amount. - Page 1 of 7 98� 112��►� - ; November 17, 1988 BAYFRONT PARK REDEVELOPMENT - PHASE II Contractor: PNM Corporation Amount of Contract: $6,871,000 plus Increases of $430,528 and $300.000. Total $7,601,528 Starting Date: December 31, 1985 Project Description: This project covered the construction of the Light Tower and Light Tower Building, the Service Building, the Maintenance Space, retaining walls, park lighting, walks, an Irrigation system, storm and sanitary sewers, water lines, and grading In the area of the park between Bayside and the Flagler Street Promenade which includes the Amphitheater. Project Status: The project is essentially completed. Remaining to be completed is punch IIst work; items such as corrections to the Irrigation system and clean-up In the area south of Flagler that the contractor was allowed to use as a staging area. Final payment on the project will be delayed pending resolution of a claim for delay damages received the date of this status report. The contractor claims delays caused by changes in the plans and by errors and omissions. Resolution of the claim will likely require litigation and the Involvement of the Consultant and their Insurance companies. BAYFRONT PARK REDEVELOPMENT - PHASE III Contractor: Danville-Findorff, Inc. Amount of Contract: $3,654,000 Starting Date: July 8, 1987 Project Description: This project covered the Amphitheater Stage Building, seating the Amphlawalk cover, the Memorial walk work. theconstruct on, >t- 7 area and lighting; and other Items of Project Status: The Amphitheater, was essentially completed and COtiptAtly usab t o for the the completion of the project Is be I n9 delayed by' extra' work°;� required to provide wheelchair access to all parts afthe s Amphitheater, Installation of security fence the proposed.. Installation of an electronic message center sign on Biscayne Boulevard and several other Items of work. I - November 17, 1988 Project Status: (continued) No overrun of the contract amount Is expected on this project but one Item, not yet done or authorized may require an Increase. The Bayfront Park Management Trust has requested security fence changes and additions that may cost as much as $120,000 additional which would exceed the contingency funds available. If It becomes apparent that an Increase In the contract amount is required, Commission approval will be obtained first. BAYFRONT PARK REDEVELOPMENT - PEPPER FOUNTAIN (Still in Design Stage) Estimated Cost: $2,750,000 Estimated Start of Construction: February, 1989 Description of Project: This project will cover the construction of a large fountain In the center of the Circular Plaza at the intersection of the Baywalk and the Promenade. The necessary sealed cofferdam required for the fountain construction Is already In place. It was built by the Corps of Engineers as part of the Baywalk project. Project Status: The plans and specifications for the project are expected to be completed In December. We plan to receive bids for the work in January 1989 and to award a contract and begin construction in February of 1989. 1 have not seen the plans or specifications but I believe a minimum of 7 months will be required to construct the fountain which Indicates a completion date of September. B�kYFRONT PARK REDEVELOPMENT - CHOPIN PLAZA stimated Cost: $2,200.000 which does not Include the cost of he Thunder Rock Sculpture and the Miami Center Fountain. Expected Start of Construction: Not determined Present Status: Even though this project Is being - Indefinitely delayed by the possibility of the construction of an underground parking garage on the site, the consultants were Instructed to proceed with the preparation of plans and specifications In accordance with the original Noguchl plan. They will be accepted from the consultant's and'held for further use. The estimated cost of this project Is approximately $2,200,000. Existing funding, Including $1,250,000 in Direct Appropriation Grants from the State of Florida, totals $1,518,500 which means that had we proceeded with the project uninterrupted, we would have had a $700,000 funding shortfall, We Intended to structure the construction contract to allow the construction of as much as of the work as fun44.ngg. wont a I I ow - Page 3 of 7 l48--g 12.E • 1 r November 17, 1988 SAYFRONT PARK REDEVELOPMENT - CHOPIN PLAZA (Cont'd.) Present Site Conditions: At the November 3rd Commission meeting the Commission passed a motion approving in principle the concept of the garage with the provision that Miami Center would clear and sod and have a temporary sprinkler system Installed by December 31, 1988. Miami Center has begun the work and is making good progress. BAYFRONT PARK REDEVELOPMENT - PLAY SCULPTURES Estimated Cost: $130,000 Exoected Start of Construction: January 1989 Present Status: Plans for the play sculptures are completed. The work of preparing the specification, other than those technical specifications shown on the plans, arranging for the advertising of bids, receiving bids and the award of a contact has been left to me. I plan to receive bids In December and award a contract and begin work in January. Work should be completed by March of 1989. U S ARMY CORPS OF ENGINEERS PROJECTS 6 PHASE I (NEW BULKHEAD) Contractor: C.H.R. Construction Started: July 1985 Completed: October 1985 Total Cost: $500,000 Project Description: This project covered the construction of a new sheet pile seawall along the east side of the park i.e. from Bayside to Chopin Plaza. Neither I nor any other City personnel had much Involvement In this construction. PHASE II - BAYWALK AND FACILITIES Contractor: Atlantic Foundation Co. Started: November 1985 Completed: September 1987* *This Is the date that the City of Miami took use of the essentially completed Saywalk. November 17, 1988 PHASE II - BAYWALK AND FACILITIES (Cont'd.) 1) The City provided the fill (from the Virginia Key stockpile) for filling the area behind the seawall. 2) Drainage for the Baywalk was Incorporated Into the park system. 3) We provided Irrigation and potable water to the project. 4) 1 was liaison between the Corps and the Consultants. 5) We will be building the Pepper fountain utilizing the cofferdam and tunnel constructed as part of the project. 6) 1 was considered the Owner's (City of Miami) Representative. FLAGLER STREET PROMENADEC✓ Contractor: PNM Corporation Started: October 1987 ` Completed: August 1988 Total Cost: $1,300,000 Project Description: This project covered the installation of keystone paving on the Circular Plaza and the construction of the Promenade (concrete slab with granite pavers) from there to Biscayne Boulevard. My Involvement In this project was also extensive and time consuming. CHALLENGER 7 MEMORIAL This project Is not a City of Miami project. It Is the undertaking of the Challenger 7 Memorial Committee chaired by Ralph Renick. The Clty's participation thus far has been, first to allow Its construction on City property and then to donate such th.1nss as surveying, are eIectrIcaI service, and use of materials and equipment atl as arranged by and recorded by me. The City has also furnished me with clerical help and a telephone relative to the work i've done on this project. I've always considered my work on the project to be a personal contribution and have been as careful as I can not to let it Interfere with my City duties. Piling for the foundation have been Installed and a cofferdam built around them to allow the construction of the pIIecap. Some of the work completed was done by donation but It has become necessary to have the work done by paying contractors to do It. The progress on the project has been poor chiefly because of a lack of funding. DIRECT PURCHASES The following direct purchases have been made for the park; 1) A Laser Projection System for the Light Tower. Cost: $319,200 Bids Received: October 1987 Purchase Authorized: November 1988 Receipt Expected: January 1989 2) A Fork Lift Cost: $17,930 Received: September 1988 3) An Aerial Work Platform: Cost: $4,084 Received: August 1988 4) A Portable Dance Floor: Cost: $20,475 Being Constructed 5) Acoustical Enclosures for the Amphitheater Stage Cost: $32,460 Being Constructed In addition to the above a great amount of effort was put Into purchasing a sound system for the Amphitheater. The low bidder received was $142,000 but the second tow bidder challenged the advertising procedures that had been followed and because of his challenge and because there Is some among the Bayfront Park Management Trust that feel the system more elaborate than required, the Comm I ss I on was never asked' �K9 •`.4 to authorize the purchase.- ;:, CONSULTANTS PROFESSIONAL SERVICES AGREEMENT The agreement with the Consultants was executed on January 19, 1982 and the original fee amount, which was not Intended to be the complete fee, was $130.000. The agreement has been amended six times since, with Amendments numbers 'V and 1l,I having been executed on November 2nd of this year. - T 'r tom- srr �h ,P'.•. N9 .x Page ­ a of ? =* �- �* -�<,s November 17, 1988 CONSULTANTS PROFI'SSIONAL SERVICES AGREEMENT (Cont'd.) Amendment V Increased the total fees to be paid to the Consultants by $153,000 to a total of $1,234,950. Amendment VI provided for the additional payment of up to $25,000 exclusively for development and testing of a prototype of the Pepper Fountain with the funds for the payment to come from money already allocated to that project. The present status is that we have paid the Consultants a total of $1,028,176 of the $1,234,950 scheduled fee or 84%. Additionally, we have paid $19,584 of $25,000 set up for the development of the Pepper Fountain prototype. FINANCIAL STATUS The appropriations for the 10 CIP projects referred to In the beginning of this report total $18,193,400 not Including $1,768,500 appropriated for the Chopin Plaza area. I cannot give an exact, current accounting of the expenditures of those appropriations but by periodic review of the accounting with those more knowledgeable In accounting, am staying informed and in a position to prevent an overrun of the total of the appropriations. If required, and with an additional two weeks, I can provide a current expenditure report but I believe that the Clty's Accountants can do the Job better. TOTAL COST I have heard many reports of the total cost of the Park Redevelopment, the most common being $30 million. To my knowledge the cost of the redevelopment will be as follows: 1) The total of the 10 CIP projects $19.961 Million (referred to above) 2) The cost of the C of E projects $ 6.7 Million (already completed) 3) Work to be funded by private donations: Challenger Memorial $300,000 Thunder Rock Sculpture 250,000 Miami Center Foundation 100,000 Memorial Well 260,000 TOTAL .810 Million 27.48 Million NOTE: This total does not Include the work of renovating the Rock Garden which could cost from $100,000 to $200,000 depending upon the extent of the work.
