RECOMMENDATION
It is rrcommrnded that the Commission authorize a representative: a) to
discuss Mavor Raul Martinez's "opt -out" proposal pertaining to the Metro Dade
County impact Fee Ordinance at the Dade League of Cities meeting of Thursday,
Drcenrh(,r I, 1Om ; b) to make a pertinent recommendation to the Board of County
Conenis,ioners at the public hearing of Tuesday, December 6, 1988; otherwise
retaininq the Commission policy expressed in Resolution 88-808; September 8,
19f18, prr the attached resolution.
BACKGROUND
The Planning Department. has prepared the following analysis and recommendation
for consideration. At. the Roard of County Commissioners meeting on November
15, 1988, Mayor Raul Martinez proposed an "opt -out" provision whereby
municipalities could opt -out of the County Impact Fee Ordinance provided the
municipality enacted an ordinance equal to, or more stringent than, the County
Ordinance.
This opt -out. proposal is questionable for the following reasons:
1. ilie numerous exemptions in the City Impact Fee Ordinance are not
mirrored in the County Ordinance.
2. The City Ordinance does not charge for County roads.
3. It is not clear how the money would be spent - Mayor Martinez proposes
A "mini - MPO."
Unless these provisions are clarified, the administration recommends retaining
the Commissioners' present policy, as expressed in Resolution 88-808;
September 8, 1988, which states:
"The City Commission supports the Dade League of Cities
inc;.'s position regarding Dade County impact fees and
encouraging the Metropolitan Dade County Commission to allow
municipalities to "opt. -out" of its proposed impact fee
ordinance, if the municipality determines that such
non -participation would be in such municipality's best
interest"

As a fall -hack position, the administration would recommend support for the
County impact fee only provided that:
1. The County Impact Fee should be spent within the same City within which it
is collected; and
2. The County Ordinance continued to exempt the Downtown and Southeast
Overtown Park West Development of Regional Impact Areas.

Section I. The City Commission hereby authorizes a representative:
