'48-1111 ) A RESOLUTION WAIVING THE REQUIREMENTS FOR FORMAL SEALED BIDS AND RATIFYING THE ACTIONS OF THE CITY MANAGER IN AWARDING CONTRACTS AND EXECUTING CONTRACTS WITH THE LOWEST RESPONSIBLE AND RESPONSIVE BIDDERS FOR THE RESTORATION OF THE LOWER PRESS BOX AT THE ORANGE BOWL STADIUM RECENTLY DAMAGED BY FIRE; WITH MONIES NOT TO EXCEED $40,000 THEREFOR ALLOCATED FROM THE ORANGE BOWL OPERATING ACCOUNT, INDEX NO. 580402, TO COVER CONTRACT COSTS; AND ADOPTING THE CITY MANAGER'S WRITTEN FINDINGS THAT A VALID EMERGENCY EXISTED. WHEREAS, a fire of presently undetermined origin on the evening of September 2, 1988, damaged a portion of the lower press box of the Orange Bowl Stadium, rendering it unusable; and WHEREAS, said fire created a situation that was unsafe and dangerous for the public as well as the Orange Bowl tenants, and repairs had to be made immediately; and WHEREAS, a portion of the seating area above had to be closed to occupancy until repairs are made to certain supporting members incorporated in the press box structure; and WHEREAS, the City Manager and the Directors of the Departments of Public Works and Parks, Recreation & Public Facilities determined that the fastest and most effective way to remedy the situation was to let out contracts for a damage report study to the consulting firm of Wiss, Janney and Elstner, in an amount not to exceed $3500, and for the structural and interior repair of the press box to the firm of MET Construction, Inc., in a total amount not to exceed $36,500; and WHEREAS, the funds are available in the Orange Bowl operating account, Project No. 404000, Index No. 580402-3407 for the proposed amount of the contracts, project expense, and incidental s; and CITY COMMISSION MEETING OF NOV 1`7 1988 ON No. �38-1115 LSOLUTI WHEREAS, the City Manager has made a written finding that the use of the competitive sealed bidding method for the award of the herein procurement contracts was not practicable or advantageous, due to the fact that the fifteen (15) day bidding time required by the City Code imposed a serious constraint on the scheduled activities at the Orange Bowl Stadium; and WHEREAS, the City Commission, after a properly advertised public hearing, accepts and ratifies the City Manager's above finding; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The findings and recitals set forth in the preamble to this Resolution are hereby adopted as if fully set forth in this Section. Section 2. The requirement for formal competitive sealed bids for the damage report study and for the repairs to the structure and the interior of the Orange Bowl Press Box is hereby waived by a four -fifths vote of the members of the City Commission. Section 3. An amount not to exceed $40,000 is hereby allocated from the Orange Bowl operating budget account, Index No. 580402-340 to cover the cost of said contracts. Section 4. The actions of the City Manager in awarding a contract for a damage report study and executing a contract with the lowest responsible and responsive bidders for structural and interior repairs to the Orange Bowl Press Box needed as a result of the September 2, 1988, fire, are hereby ratified. --2- 88-1115 PASSED AND ADOPItD THIS 17th day of November 1988. Odio City Manager RECOMMENDATION: 1 DATE N I, V _1 1988 SUBJECT Resolution Waiving Bid Requirements $ Contracts REFERENCES ENCLOSURES FILE Formal Awarding It is respectfully recommended that the City Commission adopt the attached resolution which waives the requirement for formal sealed bids in connection with the emergency repairs to the Orange Bowl Press Box, and ratifies the actions of the City Manager in awarding two contracts to and entering into two contracts with the lowest responsive and responsible bidders for the bids received for a damage report study and structural and interior repairs. BACKGROUND: The Department of Public Works has determined that there existed an emergency need to carry out repairs at the Orange Bowl Press Box. On the evening of September 2, 1988, a fire of presently undetermined origin damaged a portion of the lower press box, rendering it unusable. It was required that a damage report study be carried out by the firm of Wiss, Janney and Elstner. They are industry consultants on the specialized field of fire damage to steel structures. Subsequently, informal bids were taken on an emergency basis, for the implementation of the damage report study recommendations. The firm of MET Construction, Inc. submitted the lowest prices to replace or repair the fire - damaged roof, ceiling, walls, and flooring and to restore the plumbing, electrical and air conditioning services; they also submitted the best price, on a time and materials basis, for the repairs to the steel structure. The attached resolution waives the time requirements for formal sealed bids, and ratifies the actions of the City Manager which awarded contracts and entered into contracts on behalf of the City with the lowest responsible and responsive bidders. O••• d i o City Manager CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE NOV 7 1988 FILE SUBJECT Orange Bowl Press Box - Emergency Repairs REFERENCES ENCLOSURES Based on information supplied to me by the Director of the Public Works Department, I have found that there exists an emergency need to waive the requirements for formal bidding, and to award contracts on an emergency basis to the lowest responsible and responsive bidders for a fire -damage study report and for the repair and reconditioning of the press box at the Orange Bowl. The reasons for the emergency are as follows: EMP : emp On the night of September 2, 1988, a fire of still unknown origin damaged a portion of the lower press box, rendering it unusable. In order to effect repairs, it became necessary to engage the services of a reputable firm specialized in fire damage to steel structures; the firm of Wiss, Janney & Elstner has produced a report with their recommendations. Immediately, informal bids were taken and the firm of MET Construction, Inc. has been retained to implement said recommendations, which include the structural repairs, as well as replacement or repair of the ceiling, roof, walls, and flooring, and restoration of the plumbing, electrical, and air conditioning services. In order to avoid interruption of the City's contractual obligations with the Orange Bowl tenants, and to protect the safety of the users, these repairs are being made on an emergency basis. ��3-1115 2
