Ns_. 1L0!0-, A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE, TO PAY TO LYNN PADDOR, HAMMER CONSTRUCTION, AND PISTORINO AND ALAM, WITHOUT THE ADMISSION OF LIABILITY THE TOTAL SUM OF 934,380.57 IN FULL AND COMPLETE SETTLEMENT OF ANY AND ALL CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, FLORIDA, UPON THE EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI. FROM ANY AND ALL CLAIMS AND DEMANDS. WHEREAS, LYNN PADDOR, filed a claim against the City of Miami for damage to an apartment building owned by him which was struck and extensively damaged by a City vehicle on July 8, 1988, at or near 127 N.E. 5th Street in Miami, Florida; and WHEREAS, under the control of the Claims Division of the City Attorney's Office, repairs were undertaken by contractors in conjunction with structural engineers; and WHEREAS, the above claim has been investigated by the Claims Division of. the City Attorney's Office in accordance with City Ordinance No. 8417, as amended, which created the City of Miami's Self Insurance Program, and said office recommends that this claim he settled for the total sum of $34,380.57; NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Director of Finance is hereby authorized to pay to LYNN PADDOR, PISTORINO AND ALAM,AND HAMMER CONSTRUCTION, without the admission of liability, the total sum of $34,380.57 in full and complete settlement of any and all bodily injury claims and demands against the City of Miami, Florida upon the execution of a release, releasing claims and demands. the City of Miami from all UITY COMMISSION MEETING OF NOV 17 1988 �;iaJLVWN No. 88-10 i --- PASSED AND ADOPTED this 17th day of November ► 1988- XAVIER L. Fernandez City Attorney City Commission Agenda ENCLOSURES November 17, 1988 RECOMMENDATION It is respectfully recommended that the City Commission approve the attached resolution so that this property damage claim can be settled. BACKGROUND Private citizen, Mr. .Lynn Paddor, filed a claim against the City of Miami for property damage to his apartment building. This accident occurred at 127 N.E. 5th Street as a City of Miami fire vehicle was backing out of the parking lot at 144 NE 5th Street striking the lower eastern corner of the building. Hammer Construction performed the repairs at a total amount of $31,696.81. A structural engineering company, Pistorino and Alam, performed services in the total amount of $1,933.76. Mr. Paddor lost $750.00 in revenue during the time that his apartment building was under construction. The above claim has been investigated by the City Attorney's Office and the Claims Division in accordance with Ordinance No. 8417 which creates the City of Miami's Self Insurance Program.
