A RESOLUTION OF THE MIAMI CITY COMMISSION
EXPRESSING CONCERN TO THE NEWLY ELECTED STATE
OF FLORIDA INSURANCE COMMISSIONER FOR THE
INCREASE IN WORKERS' COMPENSATION INSURANCE
PREMIUMS AND URGING HIM TO RECONSIDER THE
PROPOSED INCREASE AS IT WILL PROVE BURDENSOME
ON THE INDUSTRY; ENCOURAGING THE PRACTICE OF
SETTING RATES BASED ON LOSS EXPERIENCE SO AS
TO OFFER AN INCENTIVE TO EMPLOYERS FOR
INITIATION AND IMPLEMENTATION OF SAFETY
STANDARDS IN THEIR WORK FORCE; FURTHER
DIRECTING THE CITY CLERK TO TRANSMIT COPIES
OF THIS RESOLUTION TO THE HEREIN NAMED
OFFICIALS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The Miami City Commission hereby expresses
concern to the newly -elected State of Florida Insurance
Commissioner for the increase in Workers' Compensation insurance
premiums and urges him to reconsider the proposed increase as it
will prove burdensome on the industry.
Section 2. The practice of setting rates based on loss
experience so as to offer an incentive to employees for
initiation and implementation of safety standards in their work
force is hereby encouraged.
Section 3. The City Clerk is hereby directed to transmit
copies of this Resolution to Tom Gallagher, Insurance
Commissioner Elect, Bill Gunter, Insurance Commissioner, and
Governor Bob Martinez.
Section 4. This Resolution shall become effective
immediately upon its adoption pursuant to law.

88-1091 (copy attached), Section 3 of which directed the
City Clerk to transmit a copy to the Insurance Commissioner.
We are in receipt of a letter from Mr. Tom Gallagher,
Insurance Commissioner, in response to said Resolution.
Said response is being forwarded to you for your information
and files.

I received your recent correspondence and the Resolution from the
City of Miami concerning objections to the 28.8% overall increase
in workers' compensation insurance rates which was granted by
Commissioner Gunter. I share your concern with the magnitude of
this increase. I am more concerned that the Department of
Insurance staff actuaries have advised that this increase is a
conservative estimate of needed rates. The indications are that
losses may be substantially higher in the next year if nothing is
done to correct problems within the system.
Governor Martinez has created a Workers' Compensation Task Force
to address the problems which have developed in the system. This
Task Force has met in Orlando, Miami, Boca Raton, Tampa,
Jacksonville and Tallahassee to take testimony from the public
and all those involved in and affected by the workers' compensa-
tion system. This Task Force will be meeting to review the
testimony which has been taken and make recommendations to the
Governor on corrections which need to be made within the system.
I support the Governor and the Task Force in their efforts to
identify the problems and draft solutions. I will work
diligently to assure that meaningful reforms are made.
