AN ORDINANCE AMENDING THE MIAMI COMPREHENSIVE
NEIGHBORHOOD PLAN AND ADDENDA (SEPTEMBER
1985) FOR PROPERTY LOCATED AT APPROXIMATELY
2-46 NORTHEAST 75TH STREET, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN), BY
CHANGING THE DESIGNATION OF THE SUBJECT
PROPERTY FROM MODERATE DENSITY RESIDENTIAL TO
LIBERAL COMMERCIAL; AND MAKING FINDINGS.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of July 20, 1988, Item No. 1, following an advertised hearing,
adopted Resolution No. PAB 69-88, by a 7 to 1 vote, RECOMMENDING
APPROVAL of this request to amend the Miami Comprehensive
Neighborhood Plan and Addenda (September 1985), as hereinafter
set forth; and
WHEREAS, the City Commission after careful consideration of
this matter, notwithstanding the Planning Board's recommendation,
deems it advisable and in the best interest of the general
welfare of the City of Miami and its inhabitants to grant this
Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Miami Comprehensive Neighborhood Plan and
Addenda (September 1985), is hereby amended by changing the
designation of that certain parcel of real property located at
approximately 2-46 Northeast 75th Street, Miami, Florida, more
particularly described as Lots 1, 2, 3, and 4, Block 1, of
BELMONT PARK REPLAT, as recorded in Plat Book 7 at Page 60 of the
Public Records of Dade County, Florida, from Moderate Density
Residential to Liberal Commercial.
Section 2. It is hereby found that this Comprehensive
Plan designation change:
a. Is necessary due to changed or changing conditions;
b. Involves a residential land use of 5 acres or less and
a density of 5 units per acre or less or involves other

land use categories, singularly or in combination with
residential use, of 3 acres or less and does not, in
combination with other changes during the last year,
produce a cumulative effect of having changed more than
30 acres;
c. The property which is the subject of this amendment has
not been the specific subject of a Comprehensive Plan
change within the last year; and
d. The herein amendment does not involve the same owner's
property within 200 feet of property provided a
Comprehensive Plan change within the last 12 months.
Section 3. All ordinances, code sections, or parts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.
Section 4. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the ordinanoe
as a whole.

Moreover, the proposed expansion would intrude
into a moderate density residential area.
Finally, the City housing stock would be
reduced.
PLANND G DEPT. Denial. The proposed change does net further
the intent of the Ca preh,ensive Plan and there
is no justification for a change.
PLANNING ADVISORY BOARD At its meeting of July 20, 1988, the Planning Ad-
visory Board adopted Resolution PAB 69-88, by a
vote of 7 to 1, recommending approval of the above.
Seven proponents were present at the hearing. Four
replies in favor received by mail.
CITY COMMISSION At its meeting of October 27, 1988, the City
Commission passed the above on First'Reading.

Section 62-17 of the Code of the City of Miami, Periodic review,

which stifles the property's development and improvement resulting in deteriorated,
unimproved and derelict resideirtial housing.

That AFFIANT is familiar with the Subject Property located at N.E. 75 Street
between North Miami Avenue and Northeast Miami Court.
That AFFIANT is the rental manager from Parry Realty, who manages the residential
and commercial property on the Subject Property proposed for amendment.
That AFFIANT is familiar with the Application for Amendment of the City of
Miami's Comprehensive Land Use Plan regarding amending the existing Moderate
Residential Density to the proposed Liberal Commercial.
That AFFIANT is familiar with the Staff's Report which recommends denial of
the proposed amendment.
That AFFIANT favors the proposed amendment to Liberal Commercial of the
Subject Property because AFFIANT believes that the amendment would benefit the
entire community by eliminating undesireable wooden structure's which have an
extremely high rate of vacancy and vandalism and by replacing them with new
CBS construction which is built pursuant to the recent South Florida Building
Code.
That AFFIANT believes the amendment would result in a higher assessed valuation of the
- Subject Property which would result in a higher return of ad velorum tax income to
the City of Miami.
That AFFIANT believes that the property as it exists is not of value to be preserved
because the lots located on the same block are zoned liberal commercial and the property
to the east is zoned Industrial, thus the potential for favorable residential housing
immediately abbutting such property (without even a city street separating same) is
extremely poor. The rental history of the Subject property upports this occurrence.
