AN ORDINANCE AMENDING THE MIAMI COMPREHENSIVE
NEIGHBORHOOD PLAN AND ADDENDA (SEPTEMBER
1985) FOR PROPERTY GENERALLY DESCRIBED AS THE
BLOCK BOUNDED BY NORTHWEST 7TH AND NORTHWEST
8TH STREETS, AND NORTHWEST 3RD COURT AND
NORTHWEST 4TH AVENUE (MORE PARTICULARLY
DESCRIBED HEREIN), BY CHANGING THE
DESIGNATION OF THE SUBJECT PROPERTY FROM
MODERATE HIGH DENSITY RESIDENTIAL TO GENERAL
COMMERCIAL/ RESIDENTIAL; AND MAKING FINDINGS.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 28 1988, Item No. 1, following an advertised
hearing, adopted Resolution No. PAB 74-88, by a 9 to 0 vote,
RECOMMENDING APPROVAL of this request to amend the Miami
Comprehensive Neighborhood Plan and Addenda (September 1985), as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Miami Comprehensive Neighborhood Plan and
Addenda (September 1985), is hereby amended by changing the
designation of that certain parcel of real property generally
described as the block bounded by Northwest 7th and 8th Streets,
between Northwest 3rd Court and Northwest 4th Avenue, Miami,
Florida, more particularly described as All of Block 47N, of A.L.
KNOWLTON'S MAP OF MIAMI, as recorded in Plat Book B at Page 41 of
the Public Records of Dade County, Florida, from Moderate High
Density Residential to Commercial/Residential.
Section 2. It is hereby found that this Comprehensive Plan
designation change:
a. Is necessary due to changed or changing conditions;

b. Involves a residential land use of 5 acres or less and
a density of 5 units per acre or less or involves other
land use categories, singularly or in combination with
residential use, of 3 acres or less and does not, in
combination with other changes during the last year,
produce a cumulative effect of having changed more than
30 acres;
C. The property which is the subject of this amendment has
not been the specific subject of a Comprehensive Plan
change within the last year; and
d. The herein amendment does not involve the same owner's
property within 200 feet of property provided a
Comprehensive Plan change within the last 12 months.
Section 3. All ordinances, code sections, or parts thereof
in conflict herewith are hereby repealed insofar as they are in
conflict.
Section 4. Should any part or provision of this Ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the ordinance as a
whole.

Per Motion 88-736/Resolution 88-736; July 21,
1988, consideration of amending the Miami
Comprehensive Neighborhood-' Plan (September,
1985), and addendum, as amended, by changing the
land use designation of the subject property
from Moderate High Density Residential to
Commercial/Residential
and
by amending the proposed Miami Comprehensive
Neighborhood Plan 1989-2000 by changing the
land use designation of the subject property
from High Density Multi -Family Residential to
General Commercial.
REQUEST To amend both the present and proposed
comprehensive plans to accommodate commercial
use in the block bounded by NW 7th and 8th
Streets, between NW 3rd and 4th Avenue.
BACKGROUND On July 21, 1988, the City Commission passed
Motion 88-734 which states as follows:
"A Motion accepting the recommendation of the
Planning Department and instructing the Planning
Department to do a land use designation study of
the area bounded by NW 3rd and 5th Avenues,
between NW 5th and 8th Streets; further
directing the administration to report back to
the Commission in December with its
recommendation."
Note that this Motion was also included in
Resolution 88-736, the resolution transmitting
the Miami Comprehensive Neighborhood
Plan 1989-2000 to the Florida Department of
Community Affairs for review.

The City of Miami Department of Development has
urged that redevelopment be allowed to occur in
a more timely manner.
ANALYSIS This block is bounded on the east by the
southbound frontage road (NW 3rd Avenue) and
elevated I-95, on the west by modest commercial
development (a drug store) and on the south by
low density housing and on the north by moderate
density housing. The block itself conta ins
_ approximately 4 residential structures.
Consistent with re -zoning approximately 3 years
ago, this proposal will encourage- limited.
commercial use in the east -west range of blocks
between NW 7th and 8th Streets. Caution should
be exercised in rezoning in Overtown so that the
City's long term policy of encouraging a
residential community is continued.
Studies by the Department of Development for
Overtown indicate that this site would more
appropriately be used as a commercial
residential area, due to the proximity to
downtown and the I-95 exit. Existing market
conditions do not support a purely residential
development without a significant public
subsidy. The change in land use and zoning on
this site would allow commercial redevelopment
which would serve the Overtown residential
community as well as other neighboring
residential and office uses.
RECOMMENDATIONS
PLANNING DEPT. Approval.
PLANNING ADVISORY BOARD At its meeting of September 28, 2988 the Planning
Advisory Board adopted Resolution Number PAB 74-88
by a 9 to 0 vote, recommending approval of the above.
CITY COMMISSION At its meeting of October 27, 1988, the City Commission

Application for Change
to ,Miami Comprehensive
Plan & Zoning Atlas
Attached is an application requesting a change in the plan desig-
nation for the block bounded by U.W. 7th and 8th Streets and N.W.
3rd and 4th Avenues in the Miami Comprehensive Neighborhood Plan
from Moderate High Density Residential to Commercial Residential.
Additionally, we have included a change of zoning request for the
same property, which translates the plan redesignation into the
zoning atlas.
This request is a result of a combined effort with Bert Waters of
the Planning Department and staff of the Department of Develop-
ment. It is their joint recommendation that this site would be
more appropriately used as a commercial residential area, due to
its proximity to downtown and an I -95 exit.
