AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
APPLYING THE HC-1: GENERAL USE HERITAGE
CONSERVATION OVERLAY DISTRICT TO THE WALGREEN
DRUG STORE LOCATED AT APPROXIMATELY 200 EAST
FLAGLER STREET, MIAMI, FLORIDA (MORE
PARTICULARLY DESCRIBED HEREIN); MAKING
FINDINGS; AND MAKING ALL NECESSARY CHANGES ON
PAGE NUMBER 36 OF SAID ZONING ATLAS.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of June 1, 1988, Item No. 7, following an advertised public
hearing, adopted Resolution No. PAB 57-88, by a 8 to 0 vote,
RECOMMENDING APPROVAL of the request to amend the Zoning Atlas as
hereinafter set forth; and
WHEREAS, the Miami Heritage Conservation Board, at its
meeting of April 26, 1988, following an advertised public
hearing, adopted Resolution No. HC 40-88, by a 6 to 0 vote,
RECOMMENDING APPROVAL of the herein historical designation; and
WHEREAS, the City Commission, after consideration of this
matter deems it advisable and in the best interest of the general
welfare of the City of Miami and its inhabitants to amend the
Zoning Atlas as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, as amended, is
hereby amended by applying the HC-1: General Use Heritage
Conservation Overlay District to the Walgreen Drug Store, which
is located at approximately 200 East Flagler Street, Miami,
Florida, and more particularly described as Beginning at the
northwest corner of Block 120, thence easterly 152 feet, thence
southerly 60 feet, thence westerly 152 feet, thence northerly 60
feet to point of beginning, MIAMI NORTH, according to the plat

thereof, recorded in Plat Book B at Page 41 of the Public Records
of Dade County, Florida.
Section 2. It is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Will not adversely influence living conditions in the
neighborhood;
(g) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(h) Will not create a drainage problem;
(i) Will not seriously reduce light and air to adjacent
area;
(j) Will not adversely affect property values in the
adjacent area;
(k) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(1) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. It is hereby found that the subject property is
eligible for this historic designation under criteria 3, 5, and
7, as set forth in Section 1604.1 of Article 16 of Ordinance No.
9500, the Zoning Ordinance of the City of Miami, Florida.
Section 4. Page No. 36 of the Zoning Atlas, incorporated in
said ordinance by reference and description in Article 3, Section

300 thereof, is hereby amended to reflect the herein zoning
changes.
Section 5. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.

Consideration of recommendations concerning an
amendment to the Official Zoning Atlas of
Ordinance 9500; Zoning Ordinance of the City of
Miami; Florida; to apply Section 1610. HC-1:
General Use Heritage Conservation Overlay
District to the subject property, as described
in the designation report; and retaining the
underlying zoning district.
REQUEST To apply the HC-1 overlay to this historic site
as described in the designation report.
ANALYSIS As part of the Downtown Miami Development of
Regional Impact (DRI) and proposed Downtown
Master Plan; the City was required to identify
all potential historic sites and historic
districts. The selection of these sites was
made by the Planning Department; in conjunction
with the State Historic Preservation Office, the
Metro -Dade Historic Preservation Division, and
other local professionals; using a nationally
recognized set of criteria for determining what
is "historic" or "significant". One condition
of the DRI requires that these properties be
proposed for local historic designation under
the Heritage Conservation Ordinance.
The Heritage Conservation Ordinance is a
mechanism to recognize and encourage the
preservation of Miami's historic resources. The
Ordinance provides an orderly and equitable way
to balance and defend both private property
rights and the community's right to protect its
architectural and cultural heritage.
Designation with an HC-1 zoning overlay triggers
a process for the review of proposed changes to
the exterior of a building. Ordinary

maintenance and repair do not require review;
nor do changes to the interiors of most
buildings. This review insures that proposed
changes to a property are in keeping with its
historic character. A commonly ,misunderstood
aspect of the Ordinance concerns demolition.
Although the Heritage Conservation Board can
delay demolition for up to six months while
trying to negotiate an alternative plan with the
concerned parties, the Board does- not have the
authority to prevent demolition following the
assigned delay period.
It is the pol icy of the", C i ty to work
cooperatively with the owner to seek ways of
promoting an economically productive use of the
historic building. Designation can sometimes
make buildings eligible for certain zoning
incentives, as well as exemptions from some
Building Code requirements. Technical
assistance is also available.
The Heritage Conservation Board determined that
the subject property meets the criteria for
historic designation, as described in the
designation report. The PAB should consider the
appropriateness of the proposed HC-1 zoning
overlay as compared to any other HC regulations
that could be applied or created for the subject
property. The HC-1 overlay would not change or
modify any of the existing zoning regulations.

Please share this letter with the members of the Heritage Conservation
Board.
In 1987, Walgreens celebrated its 50th anniversary at 200 E. Flagler.
Although the shopping patterns and interests of our customers have
changed significantly over the past 50 years, and the interior of the
store has been changed to meet these demands, the significance of the
store today is just as great as it was 50 years ago.
When the store opened in 1937, besides the normal drugstore offerings, it
employed 300 people and contained an ice cream manufacturing plant, three
restaurants, four kitchens, a sporting goods department, and a broadcast
studio. The interesting thing about the store at that time was that all
merchandise was stocked in showcases, and even the simple practice of
buying a tin of aspirin required the service of a clerk. After World
War II, it became common for these items to be placed in an area so that
the customers could serve themselves.
One of the most significant changes in the store over the past 50 years
is that in the pharmacy. The pharmacy continues to be a highlight of the
store and the main emphasis of our Company; in 1937 though, the pharmacists
were compounding and preparing the prescriptions. Today, prescriptions
are manufactured by large pharmaceutical companies in very sophisticated
operations, and they are dispensed by our pharmacists in conjunction with
a computer that keeps emergency medical information, tax and insurance
records as well as many other important parts of today's health care
system.
We look on this store with great pride, and feel that it is a
significant part of Walgreens' history.

Statement of Significance:
The Walgreen, .Drug Store is architecturally significant because it
represents one of the earliest aad most representative Streamline
Moderne structures in Miami. The building also possesses historical
associations with the commercial development -of downtown Miami during
the period between the World Wars.
The Walgreen Drug Store is architecturally noteworthy because its
visual composition makes it one of -the most unique commercial buildings
in downtown Miami. The use of the ribbon windows and curved corner
entrance represents an attempt.to adapt an emerging architectural style
to the peculiarities. of the area's climate and the building's siting.
The building's scale, massing, and repetitive fenestration pattern make
it one of the finest examples of the Streamline Moderne style in South
Florida.
The construction of the Walgreen Drug Store also represents the efforts
undertaken by the Chicago -based Walgreen Company to establish a major
commercial presence in downtown Miami. The construction of such a
large store and the use of such an innovative architectural. style
served to emphasize that the Walgreen Company had acknowledged *"a vote
of confidence in the city."
Upon its completion, the construction of the building represented a
$1.5 million investment for the Walgreen Company. After its opening,
the Walgreen Drug Store was hailed as the "largest in the chain and one
of the largest and most complete in the country." Among the features
noted at the time of its opening were "an old-fashioned candy kitchen,
restaurant space for several hundred people at the mezzanine and
balcony levels, and an all -electric, 88-foot soda fountain with glass -
enclosed fruit displays and separate ice cream plant."
Since its completion, the building has been continuously used by the
Walgreen Company, although its food operations were shut down in 1983.

The building is particularly noteworthy for its ribbon windows,
curved corner entrance, scale, and massing.

ARCHITECTURAL INFORMATION
Description of Building:
The Walgreen Drug Store building is a five -story masonry structure
executed in the Streamline Moderne style of architecture. The building
is a rectangular plan structure commissioned by the Walgreen Company in
1936 and designed by_2immerman, Saxe -and MacBride, Architects, 'With -E.
A. Ehmann as Assocfates-Architect.
Situated at the intersection of East Flagler Street and S. E. 2nd
Avenue, the building's mass features a curved corner facing the
intersection. The structure of the Walgreen Drug Store is a
"fireproof" masonry frame sitting atop a concrete foundation. The
principal elevations of the building feature horizontal bands of metal
awning type windows separated by stone spandrels. The main entrance to
the -building is situated at the first floor level of the curved corner
and is recessed into the wall. Three pairs of glass and metal frame
doors provided access to the interior.
The fenestration pattern of the' building's elevation features a
combination of glass sizes to allow maximum light to the interior and
also provide for maximum natural ventilation when desired. The
fenestration found within the curved corner of the building features
metal casement windows set within multi -pane fixed glass. The bands of
horizontal windows are the same for the upper stories, and large fixed
panes of glass originally comprised the storefront windows at the
sidewalk level. Over the years, some of these windows have been
boarded up.
The building's roofline is characterized by a tall parapet wall
featuring scored masonry bands, which serves to conceal a flat roof
behind. A tall elevator enclosure, clad in masonry, is situated on the
northeast corner of the building.
Description of Site:
The Walgreen Drug Store is located on the southeast corner of East
Flagler Street and S. E. 2nd Avenue. The building occupies the entire
site.

IV. PLANNING CONTEXT
Present Trends and Conditions:
The Walgreen Drug Store is currently leased to Walgreen's. The lease
is due to expire in the mid-1990s, and the owner has indicated that he
will not renew the lease. The building is located on a prime downtown
corner, and is much smaller than current zoning would allow.
The -Walgreen Drug Store was identified in the Downtown Miami
Development of Regional Impact (DRI) as a historic site. The building
has also been nominated to the National Register of Historic Places.
Conservation Objectives:
When the Walgreen lease expires ire -the mid-1990s, every effort should
be made to identify a solution that might lead to the preservation of
the historic building. If the owners elect to construct a new
building, a creative solution should be explored to incorporate the
existing building into the new development without destroying its
integrity.
These conservation objectives can best be achieved by maintaining the
present zoning of the property.. An HC—1 zoning overlay district will
maintain the existing zoning, requiring only the review of physical
changes to the property.
