HomeMy WebLinkAboutO-10529B ORDINANCE NO. 1052 AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10521, ADOPTED NOVEMBER 17, 1988, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, BY ESTABLISHING A NEW PROJECT ENTITLED "ATHALIE RANGE PARK - POOL REPLACEMENT PROJECT NO. 331348 IN THE AMOUNT OF $.2,100,000; APPROPRIATING FUNDS IN SAID AMOUNT FOR SAID PROJECT FROM PROPOSED ISSUANCE OF DEBT INSTRUMENTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10521 on November 17, 1988, appropriating funds for Capital Improvement projects; and WHEREAS, in accordance with Section 2.136 of the Miami City Code (1980), the Planning Department has prepared and submitted to the City Commission a Capital Improvement Program (CIP) that identifies the sources of funding of all proposed capital projects valued at $5,000 or more for the program years 1988- 1994; and WHEREAS, the City Commission, upon the recommendation of the City Manager and Director of the Department of Parks, Recreation and Public Facilities has identified the emergency need for an additional project entitled "Athalie Range Park - Pool Replacement" in order to provide safe and adequate recreational facilities to residents of the City; and WHEREAS, the total project will include demolition of the existing pool, construction of a new 50-meter pool, locker rooms, restrooms and showers and installation of site amenities and equipment; and WHEREAS, the City Commission, by Motion No. 88-1121, adopted November 17, 1988, directed that said project be receive priority in projects to be funded from proposed debt instruments; and WHEREAS, funds in the amount of $2,100,000 will be available upon issuance of said instruments for said project; 1� The Ordinance No. of this Ordinance was incorrectly read into the record as Ordinance No. 10150. 10529 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance 10521, adopted November 17, 1988, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1988-89. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. The source of revenues to support the herein appropriations is hereby identified by fund and project with the project appropriations and revenues therefor being set forth for seven program (I-VII) areas based upon use or functional category within said areas, as follows: Total Appropriations ($ x 000) * * * * * * * * * * * * * * * * * * * * IV. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. All firgures are rounded to the nearest hundred dollars. - 2 - 1.0529. Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the reservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 5. The requirements of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 6. Od City Manage RECOMMENDATION: DATE: FILE: TH o 7 1988 SUBJECT: CIP Appropriations Ordinance for the Range Pool Project REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance to amend the Capital Improvement Program Ordinance (No. 10150) by establishing a new project entitled "Athalie Range Park - Pool Replacement" and appropriating funds in the amount of $2,100,000 from Proposed Issuance of Debt Instruments. BACKGROUND: The Departments of Public Works and Parks, Recreation and Public Facilities have prepared the attached legislation to formally establish and appropriate funds for the development of a new pool at Athalie Range Park. The Project was given initial approval by Commission Motion No. 88-1121, adopted November 17, 1988, which directed the City Manager to give high priority to the replacement of this facility in Range Park. Since 1982, the renovation of the entire park, particularly the pool (which was the site of an electrocution in 1983), has been a priority of the Parks Department. Built in the 1950's, age, heavy use and vandalism have created the need for extensive repairs and rehabilitation. After the failure of the 1984 parks bond issue, the administration has had funds only for the installation of security fence and safety -related repairs. Despite community support for comprehensive rehabilitation of the park and pool, only $233,000 was appropriated under the $8.3 million Citywide Neighborhood Park Renovations Project (CWNPRP) which will be used for security lighting, court resurfacing, park furnishings and restrooms. When this appropriation was made, the intent was to 10529 73 - / Honorable'Mayor and Members of the City Commission Page 2 find alternative funding sources in significant amounts for the much needed pool replacement. With the approval of the new funding source, $2.1 million will be available for the project, which will utilize the design plan originated for Jose Marti Park, with minor adjustments for site specific problems and location needs. Thus, the project will include demolition of the old pool, construction of a heated and handicapped -accessible 25- meter pool with bleachers, bathhouse, locker room, office and all furnishings and equipment. This item is presented as an emergency measure so that funds are in place for the start of redesign in December and Construction in January. Completion of the project is targeted for the summer of 1989. A companion resolution is also scheduled after this ordinance as a Public Hearing to approve the waiver of formal bid proce ures for construction services and other procurement needs' of the pro j ect . 1U529
