HomeMy WebLinkAboutO-10526IMIw.YT ... • .• J-88-1213 12/12/88 ORDINANCE NO. 1052C AN EMERGENCY ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 6145, ADOPTED MARCH 19, 1958, AS AMENDED BY ORDINANCE 10398, ADOPTED MARCH 10- 1988, WHICH ESTABLISHED FEES FOR BUILDING, PLUMBING, ELECTRICAL, MECHANICAL (INCLUDING BOILER AND ELEVATOR) INSPECTION, PERMIT AND CERTIFICATE FEES, BY ADDING AND INCREASING SOME FEES AND CLARIFYING CERTAIN ITEMS IN SAID SECTION 59 TO COVER THE INCREASE IN OPERATIONAL COST PRIMARILY FOR THE ENFORCEMENT OF THE SOUTH FLORIDA BUILDING CODE; CONTAINING A REPEALER PROVISION, AND A SEVERABILITY CLAUSE. WHEREAS, the City Manager recommends that in order to provide much needed services for the operation of the City of Miami by adding and increasing some fees and clarifying certain items to cover the increase in operational cost primarily for the enforcement of the South Florida Building Code; WHEREAS, it is essential that fees for the services as provided herein be added; NOW, THEREFORE, BE IT%WDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 5 of Ordinance No. 6145, adopted March 19, 1958, as amended, which provides fees for building, plumbing, electrical and mechanical (including boiler and elevator) inspection, permit and certificate fees, is hereby further amended to read as follows:1 "Sec. 5.- FEE SCHEDULE. a. FEE FOR WORK WITHOUT PERMIT: When work is commenced prior to obtaining a required permit, a fee four (4) times that specified herein shall be paid. but in ne—event shall s'"ten fee be than $29.99. The payment of such fee shall not relieve any person, firm or corporation from fully complying with all of the requirements of all applic- able regulations and codes, nor shall it relieve them 1 Words and/or figures stricken through shall be deleted. GENERAL FEES: (1) REINSPECTION FEES: - FOR EACH REINSPECTION EXCEPT WHERE OTHERWISE NOTED .............. 50.00 When extra inspection trips are necessary due to: (a) wrong address being given on call for inspection; (b) prier rejection of work due to faulty construction; (c) work not being ready for inspection at time specified; (d) failure to call for final or other inspections; (e) required corrections not being made at time specified; (f) for each section where work was not completed when final inspection called, a fee equal to 10 % of the original permit fee or 2-8.09 $50.00, which ever is greater, _ ehareed ........... (g) no approved plans at the building site. The payment of reinspection fees may be required before any further permits will be issued to the person or firm owing same, and further inspections may be refused until payment of reinspection fees has been made. (3) RECERTIFICATION OF PLANS AND REVISED PLANS FEE, AND PERMIT CARD REPLACEMENT. Through the adoption of this Ordinance, addi- tional fees are being established for the first time and certain existing fees are being increased in order to cover the increase in operational cost primarily for the enforcement of the South Florida Building Code. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. 10526 a Section 7. Odio City Manager RECOMMENDATION: 35 DATE: NOV 3 V+ 1988 FILE: SUBJECT: Emergency Amendment to Permit Schedule for City Commission Meeting of December 15, 1988 REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached ordinance which amends the City of Miami Permit Fee Schedule by increasing certain fees and adding others to reflect the actual cost to the City. These fees are incurred as a result of providing service •to the construction industry and to the general public. BACKGROUND: The last substantial increase to the Permit Fee Schedule was made in October of 1986 under Ordinance No. 10157. Since that time there has been an increase in the consumer price index of approximately 9% plus an increase in general employee salaries of 6%. In' order for the Building and Zoning Department, which is primarily funded under enterprise funding, to generate sufficient revenue to cover the cost of operation necessary to continue to provide the services for the protection of the health, safety and welfare of the public, the proposed increases and additions are required. The main changes to the fees are: 1. Increase in minimum fees and reinspection fees. 2. Increase in some fees which were not addressed on the last amendment. 3. Addition of fees for temporary construction hoistways. 4. More realistic breakdown of cost on required tests. To completely fund our adopted budget it is necessary that these fees become effective as soon as possible. 10S2C
