On the contrary, the Traffic Signal Warrant Study prepared for the intersection reveals that of the eight traffic accidents that occurred there in 1987, four, or SO%, were correctable by a traffic signal. The report also notes that a signal "could enhance platooning and speed control 'and create gaps for traffic to exit other driveways along Coral Way". While this reasoning cannot be used as technical support for a signal warrant, its logic with respect to enhancement of safety is sound. 2. Coral Way should not be designed to function as an arterial thoroughfare. It is characterized by practically continuous frontage businesses, offices, and similar uses; less than a mile to the west of Miracle Center it is a business street with angle parking along the frontage. At few points along its length are there more than two traffic lanes in either direction, and those that exist are frequently interrupted by turning movements from and to Coral Way. While the street carries near - capacity traffic volumes, it is not overly congested nor especially hazardous. It is concluded that there is no compelling public —' healttt:or safety issue that justifies alteratioh-of Coral Way at the subject location; but that a traffic signal is warranted there. Staff Recommendation: The Planning Department recommends that the application for a Certificate of Approval to either (1) relocate two banyan trees in the median of Coral - Way, or (2) to relocate approximately nine black olive trees and reduce the swale area along the south said of Coral Way to create a left -turn lane, be denied because the proposed relocation meets neither the criteria for tree removal of Section 17-9 of the Miami City Code, nor the criteria for tree removal or alterations of the physical dimensions of the street in the Bill designating Coral Way as a State Historic Highway. However, the Planning Department does recommend that a traffic signal be installed at the. intersection of Coral Way and S. W. 33rd Avenue. HERITAGE CONSERVATION BOARD At its meeting of October 25, 1988, the Heritage Conser- vation Board -adopted Resolution HB 80-76, by a 6 to 2- vote, granting the request as amended. APPEAL Letter dated November 3, 1988 from the Planning Department appealing the above decision. (City Code, Section 17-6 (3) ) The applicant's proposed solution preserves two banyan trees in the median of Coral Way at the expense of removing and relocating eight black olive trees from the swale area and relocating the two east bound through lanes to the south by approximately eight feet. This solution has not been applied anyplace else in the City; the closest example is the left turn storage lane west bound on Bird Road to south bound Grenada Boulevard in Coral Gables. The Planning Department believes that alteration of the physical '-dimensions of east bound Coral Way at S. W. 33rd Avenue will destroy the unique landscape character of this secti-on as tree canopy will be substantially reduced which will result in a substantial negative environmental impact; the criteria for tree removal of Section 17-9 of the City Code has not been met. 2. Coral Way is' designated as a "State historic highway" by the State of Florida (see attached legislation). Among other things, this designation prohibits State funding of tree removal or alteration of Coral Way's physical dimensions except when "necessary for the public heaith or safety." Further, the language of the Act specifically provides that. "preservation of Coral Way and the median -landscaping take priority over considerations of traffic management,: and the public safety shall not be construed to require alterations in Coral' Way or the median landscaping when alternative means of prorating safety, including more restrictive traffic regulations, are available (emphasis supplied). The Planning Department believes that the applicant's proposal 'to widen the pavement, relocate the curb, and remove and relocate eight black olive trees is in conflict with the provisions of the historic designation Act.cited above, as it fails to satisfy the two tests: a. The improvement must be necessary by reason of public health or safety; and b. There are no "alternative means" available to satisfy the health or safety issues. W. 33rd Avenue RECOMMENDATION; It is respectfully recommended that the Commission adopt the resolution attached, as an alternative to the resolution considered by the Commission on November 17, 1988, which attached resolution would a) reverse Heritage Conservation Board Resolution HC-88-76; b) remand a Certificate of Approval for removal and relocation of two banyan trees in the median of Coral Way (S. W. 22 Street) at S. W. 33rd Avenue to the Heritage Conservation Board; thereby allowing construction and installation of a traffic signal and left turn storage lane on east bound Coral Way and S. W. 33rd Avenue, provided 0 the Florida Department of Transportation allows the closure of median openings at approximately 3276 and 3400 Coral Way to accommodate the relocated banyan trees. , BACKGROUND: On October 26, 1988, the Heritage Conservation Board approved Resolution HC-88-76 granting a Certificate of Approval for the removal of eight black olive trees from, the southside of Coral Way so that a traffic signal and left turn storage lane would be constructed and installed on east bound Coral Way at S. W. 33rd Avenue to provide access and egress to and from the Miracle Center project. This grant of approval resulted in widening the pavement area, relocating the curb line of Coral Way to the south to accommodate the east bound through lanes,, and reducing the Swale area. The Planning Department appealed the grant of approval by letter of November 3, 1988, maintaining that, as Coral Way was a State Historic Highway and Scenic Transportation Corridor, issues of traffic engineering must necessarily defer -to " the preservation of the roadway and rtrees. While the Planning Department maintained that a -separate left turn storage lane was unnecessary and unneeded, the Florida Department of Transportation said that no traffic signal would be approvod without the inclusion of a left turn storage lane. Faced with these opposing views, the Commission continued the item and instructed the Administration to find a solution. Following meetings with affected parties during the. period December 1.7, 1988, the recommendation (above) was agreed upon.. As used in this act, "Coral Way" means those portions of Coral Way and 3rd Avenue located between $W 37th Avenue and Interstate 95, in Dade County. Section 2. Coral Way is hereby designated as a state historic highway. No state funds shall be expended by any public body or agency for any of the following purposes: (1) To cut or remove any tree having a diameter at its thickest part in' excess of 6 inches within 35 feet of either side of the paved surface or the median of Coral Way, or to engage in an activity which requires the removal without replacement of such a trees (2) To alter the physical dimensions or location of _. Coral Way except for the addition of primary or secondary roads intersecting the limits of Coral Way.. Nothing in this act shall be construed to prevent the ordinary maintenance and repair of Coral Way, provided the physical dimensions and location of Coral Way are preserved, nor to prevent any work that is necessary for the public health or safety as determined by the agency having jurisdiction over the portion of Coral Way involved. However, the preservation of Coral Way and the median landscaping take priority over considerations of traffic management, and the public safety shall not be construed to require alterations in Coral.Way or the median landscaping when alternative means of promoting safety, including more restrictive traffic regulations, are available. Section 3.
