WHEREAS, sealed bids were received November 17, 1988, for .`
Prototypical Housing - City of Miami in connection with

WHEREAS, the City Manager, and the Directors of the
Housing
Conservation and Development Agency .,and the Department of

Works recommended that the bid received from La Mar Construction.'
be accepted as the lowest responsible and responsive bid;
and
WHEREAS, the Capital Improvements Ordinance No: 10510, was
adopted on November 17, 1988, and monies are available

THIS AGREEMENT, made and entered into this day of

WITNESSETH: That the parties hereto, for the considerations
hereinafter set forth, mutually agree as follows:
ARTICLE 1. SCOPE OF THE WORK: The Contractor shall furnish
all
labor, materials and equipment and perform all the work in
the
.manner and form provided by the Contract Documents, for
the
project entitled:
ARTICLE 2. - THE CONTRACT SUM: The City shall, pay to:
the
Contractor, for the faithful erformance of the Contract,
in
lawful money of the United States, and subject to additions
and
deductions and based on unit prices (where applicable), all
,as
provided in the Proposal and other Contract Documents,: the sum

ARTICLE 3. PARTIAL AND FINAL PAYMENTS: In accordance with the
provisions fully se ort n the"general Conditions" of the
"Specifications",- and subject to additions and deductions as
provided, the City shall pay the Contractor as follows:
(al On or before the loth day of each calendar month,
the City shall make partial payments to the
Contractor on the basis of a duly certified and
approved estimate of work, performed during the
preceding calendar month by the Contractor, less
ten (1O�) percent of the amount of such estimate
which is to be retained by the City until all work
has been performed stri•ctiy in accordance with
this Agreement and until such work has been
accepted by the City.
(b) Upon submission by the Contractor of evidence
satisfactory to the City that all payrolls,
material biIIs and other costs incurred by the
Contractor is connection with the construction of
the work have been paid in full, and also, after
all guarantees that may be required in the
Specifications or by the Contractor have been
furnished and are found acceptable by the City,
final payment on. account of this Agreement shall
be made within sixty (60) days after completion by
the Contractor of all work covered by this
Agreement and acceptance of such work by the City.
ARTICLE 4. TIME OF COMPLETION: The Contractor shall commence the
work to be performeH under his Contract within the number of
consecutive calendar days after date of written notice from the
Director of the Oepartment of Public Works to begin work.as noted
in the Proposal, and shall fully complete the Contract in
accordance with the Contract Documents within the number of
working days as set forth in the Proposal.
It is mutually agreed between the parties hereto, that tine is the
essence of this Contract, and, in the event that construction of
the work is not completed within the time herein specified, it is
agreed that from the compensation otherwise to be paid to the
Contractor, the City may retain for each day thereafter, Sundays
and holidays included, that the work remains uncompleted, the sum
set forth in the General Conditions of the Specifications, as
modified by Division 2 - Special Provisions, which sum represents
the actual damage which the City of Miami, Florida, will have
sustained ner day by failure of the Contractor to complete the
work within the time stiplilatel, and this sum is not a oenalty,
but will be the liquidated damage the City will have sustained in
event of such default by the Contractor.

attached, when required for its faithful performance, the r.ity

unsatisfactory, or if, for any
reason, in the opinion of the
Engineer; such bond ceases to be adenuate to cover the performance
of the work, the Contractor shall, at his expense, within five (5)
days after receipt
of notice from the Engineer so to do, furnish
an additional bond or bonds in such form
and amount, and with such
surety or sureties as shall be satisfactory to the City. In
such
event, no further payment to the Contractor shall be deemed to he
due
under this Agreement until such new or additional security for
the faithful performance of the
work shall be furnished in runner
and form satisfactory to the City.
ARTICLE 6. CONTRACT DOCUMENTS: Al of the documents hereinafter

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the
attached resolution accepting the low bid of La Mar Construction
for prototypical Housing, City of Miami, B-3233, received on
November 17, 1988 in the amount of $83,900, base bid; further
authorizing the City Manager to enter into a contract on behalf of
the City with La Mar Construction, Inc. for the construction.of two
( 2 ) 3-bedroom, 2-bath single family homes planned for development.
on two City -owned parcels in the Wynwood neighborhood.
BACKGROUND
The Housing Conservation and Development Agency recommends
ratification of the attached resolution accepting the low bid of La
Mar Construction received on November 17, 1988 in the amount of
$83,900 for prototypical housing, City of Miami B-3233,. Base Bid.
The attached resolution further authorizes the City Manager to
enter into a contract on behalf of the City with La Mar
Construction for the construction of two (2) 3-bedroom, 2-bath
single family homes planned for development in the Wynwood
neighborhood.
In October of 1986, the City Commission took a major step toward
addressing the existing housing affordability gap in the City by
approving implementation of the.Scattered Site Housing Development:$
and Affordable Homeownership Opportunity Program.
With the City of Miami serving as developer, it will be possible

$4,290,000 in Special Obligation Bonds, 1986 Series A, the proceeds

Currently, two (2) underutilized single family lots located in -the
Wynwood neighborhood are under public ownership, and have been
targeted for .the City's first undertaking in the development of new
single family residential housing units in the Wynwood neighborhood
in connection with the City's Scattered Site Affordable
Homeownership Development Program. The purchase -price for each of
the 3-bedroom 2-bath single family home is planned in the Wynwood
neighborhood estimated at $59,500, inclusive of land cost.
On July 14, 1988, through Resolution No. 88-650, the City
Commission approved the solicitation of bids from private
contractors for construction of two new 3-bedroom 2-bath single
family homes on City -owned lots located at 49 Northwest 35th Street
and allocated $90,000 in Special Obligation Bonds, 1986 Series A
proceeds for the purpose of funding the cost of construction and
other related expenses associated with the development of the two
(2) dwelling units planned. In addition, the City Commission'also
approved designating the Wynwood housing project as a set aside for
small Hispanic. contracting firms in accordance with the provisions
of Ordinance No. 10062.
On Thursday, November 17, 1988, twelve (12) small Hispanic owned
construction firms submitted bids to the City in accordance with
the development of the two single family homes planned for
construction in the Wynwood neighborhood. The exhibit accompanying
the attached resolution provides a brief analysis of the bids which
were received by the City. Listed below is a brief analysis of -the
lowest responsible and responsive bid received by the City.
