A RESOLUTION Sy AN AFFIRMATIVE VOTE OF 4/5TNS VOTE OF THE MEMBERS OF THE CITY COMMISSION WAIVING FORMAL COMPETITIVE SEALED BID PROCEDURES FOR CONSTRUCTION AND EQUIPMENT FOR THE A'THALIE RANGE PARK POOL REPLACEMENT PROJECT; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT AN EMERGENCY EXISTS JUSTIFYING `JSUCH� WAIVER FOR SAI SAITO D WHEREAS, said deadline does not allow sufficient time for the formal advertising, receipt of bids, and award of contracts which are normally required procedures; and WHEREAS, Sections 18-52.5 and 18-52.6 of the City Code mane provision for the emergency procurement of required goods and services for public work projects and improvements; and WHEREAS, the City Manager and Director of the Department of Parks, Recreation and Public Facilities recommend that informal bid procedures be utilized to procure the needed services, equipment and/or materials for said project; and WHEREAS, after receipt of informal bids, contracts for said services, equipment and/or materials will be awarded to the lowest responsive and responsible bidder(s) by the City Manager; and WHEREAS, Ordinance No. 10529 adopted December 15, 1988, established the Athalie Range Park - Pool Replacement Project (No. 331348) within the City Capital Improvement Program and appropriated $2,100,000 for said Project; and y. WHEREAS, foregoing is being presented at a properly_ advertising public hearing before the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: i� Section 1. The recitals contained in the preamble to this;. Resolution are:hereby incorporated by reference thereto and adopted as if.fully set forth in this Section. Section, 2. The City Managers finding that: a valid public emergency exists justifying such waiver for said Project is hereby'ratified, approved and confirmed. Section 3. By an affirmative vote of 4/5ths of the members_ =' of the City Commission, formal competitive sealed bid procedures 7 for the procurement of services, equipment and/or materials for, the construction of the "Athalie Range Park - Pool. Resolution for Athalie Range Park Pool Replacement: Emergency Waiver REFERENCES: ENCLOSURES: RECOA MFMATION: it is respectfully recommended that the City Commission adopt the attached resolution which waives formal competitive sealed bid procedures for the "Athalie Range Patk - Pool Replacement Project" based on the City Manager's written finding that a valid .public emergency exists justifying such waiver. The resolution Alt also authorizes the City Manager to accept the lowest responsive and responsible bids utilizing informal bid processes for the necessary goods and services (construction, materials,` furnishings and equipment) and allocates funds in the amount of $2,100,000 from the newly created Capital Improvement Project (No. 331348) of the same name. BACKGROUND: The Departments of Public Works and Parks, Recreation and Public Facilities have prepared the attached legislation. .At the November 12, 1988, City Commission meeting, the City Commission directed that a new pool at Range Park was to be a top priority among projects to be funded from Proposed Issuance of Debt Instruments. In light of the existing pool's severely deteriorated state and the community's urgent need for adequate recreational facilities, the City Manager directed that the,new pool be ready for public use for the summer of 1989. On this t.. basis, the City Manager has made a written finding (attached) that the Athalie Range Park - Pool . FLORIDA INTER -OFFICE MEMORANDUM DATE: n E C e 7 1903 ME: SUBJECT: Emergency Finding: waiver of Formal Bid Procedures for Range.Pool Replacement REFERENCES: ENCLOSURES: This memorandum serves as the written finding of a valid public emergency for the Athalie Range Park - Pool Replacement Project (No. 331348). This finding is based upon the following: * Due to age, heavy use and vandalism, the existing pool at Range Park is in a severely deteriorated condition requiring substantial rehabilitation or replacement to bring it up to proper recreational standards and optimum health and safety requirements. Repairs to the pool to maintain minimum health and safety standards for the last several years have created a financial burden on the Parks Department operating budget and still do not address the greater capital improvement needs of the facility. *' By state and local recreational standards, the neighboring community is entitled to safe, operational and adequate water -based recreational facilities and has made several urgent appeals to'the City to address this need. * Immediate replacement of this pool complex will allow the City to more effectively utilize current operating allocations to the Parks Department, and to relatively reduce expenses for repairs, maintenance, chemical supplies, and water and electric consumption. * Failure to implement the project immediately will exacerbate the above conditions. Such conditions indicate the need for extraordinary measures to t protect the health, safety and welfare of the 'community and the convenience of the City. In order to. initiate and complete e construction of the replacement pool by the summer of 1989,° formal competitive sealed bid procedures shall be waived for the 4 procurement of p goods and services required for this project, pursuant to Sections 18-52..5 and .6 of the City' Code.
