CORPORATION DATED JANUARY 291 1987 FOR THE CONSTRUCTION OF DINNER KEY MARINA PAVING AND LANDSIDE UTILITIES CIP PROJECT NO 4140059 SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10521, WITH FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR•FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated January 29, 1987 between the City of Miami, Florida and P.N.M. Corporation for DINNER KEY MARINA PAVING AND LANDSIDE UTILITIES CIP Project No. 414005; and WHEREAS, an increase in contract of $32,115.86 is required to cover the cost of additional electrical work required by -changes in the South Florida Building Code after bids had been received, the replacement of a collapsed electrical duct serving old Piers Nos. 1, 2 and 3 and extensive removal, relocation or abandonment or unforeseen underground utilities or structures that conflicted with new water mains, storm sewers, electric and telephone ducts and sanitary sewer vacuum piping; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to be done; and WHEREAS, the Director of the Department of Public Works recommends the increase in contract to cover the additional costs; :and t =� WHEREAS, funds to cover the increase are available from, N4 money already allocated to the project; and Tx ah u Nt . t + p hi hr LTV S Li !: a :V Rf, f. .. 1t ✓f - } EE, ��r=K ' +f",.�•'�„`-A �"�j°,� 7� '� atdt.+�,SiJr, �y'„zn+sr 5t..ut s` -'. to k /+�..1�/ /.''/. +� Q { '`a.. Corporation and they have furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; ri NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a properly advertised public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four - fifths of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, 1a Florida and P.N.M. Corporation for the construction of Dinner Key t� Marina Paving and Landside Utilities CIP Project No. 414005 dated January 29, 1987 is hereby increased by $32,115.85 with funds for the increase to be provided from monies already allocated to the project. 1/ J Section 3.
