OF THE AND CONTAININGEAN EFFECTIVENDATE-

WHEREAS, the City Commission has approved a Major Use
Speoial Permit (Resolution No. 86-834; October 23,
1986) as
amended, for Miraole Center now being oonstruoted at 3301 3601
Coral Way; and
WHEREAS, the permit directs the developer, Fort Schoenberg
Properties Ino. (the "Developer") to install a traffic signal at
the intersection of Coral Way and Southwest 33rd Avenue and to
f Southwest 33rd Avenue, north of the site;
pursue the closing o
and
WHEREAS, the Developer has filed an applioation for a
Certifioate of Approval for removing two Banyan trees from the
median of Coral Way in order to a000mmodate a traffic signal and
left -turn storage lane, from east bound Coral Way to north bound
Southwest 33rd Avenue, the only entranoe to the site; and
WHEREAS,
the Planning Department has reoommended a traffic
signal only and no tree removal at the median of Coral Way; and

*X, THEREFORE, BE IT RESOLVED By THE COMMISSION OF M CITY
07 NIAXI , FLORIDA:
Seotion 1. Resolution No. 88-1212, adopted by the City
Commission on Deoemb®r 18, 1988, and reoonsidered by the City
Commission pursuant to Resolution No. 89-107, is hereby
resoinded.
Section 2. The recitals and findings oontained in the
Preamble to this Resolution are hereby approved, oonfirmed and

adopted by referenoe thereto and inoorporated herein as if fully
set forth in this Seotion.
Seotion 3. The City Commission hereby affirms, with
modifioation, the deoision of the Heritage Conservation Board.
Resolution HC-88-78, Ootober 28, 1988, here attaohed, authorizing
a Certifioate of Approval for the removal of eight blank olive
trees on the south side of Coral Way (S.W. 22nd Street) and
Southwest 33rd Avenue, within the Coral Way Soenio Transportation
Corridor, established by Ordinanoe No. 9897; adopted September
20. 1984; thereby allowing oonstruotion and installation of a
traffio signal and left -turn storage lane on east bound Coral Way
at Southwest 33rd Avenue and neoessarily reduoing the Swale area

on the south side of Coral Way to a000mmodate two east bound
through lanes.
Seotion 4. The City Commission hereby modifies the deoision
of the Heritage Conservation Board by aooepting the proffer of
the applioant: Fort Sohoenberg Properties. Inc., to donate Ten
Thousand Dollars ($10,000) to the Urban League of Greater Miami.

Parks) a Parks, Reoreation and Publio Faoilities Department

Seotion 8. The City Commission hereby, further, modifies
the deoision of the Heritage Conservation Board by direoting the
Administration to undertake a review of the completed
oonstruotion. and operation of traffio on Coral Way and report

A RESOLUTION AUTHORIZING A CERTIFICATE OF APPROVAL; PER
REVISED PLANS ON FILE IN THE PLANNING DEPARTMENT, FOR
THE REMOVAL OF EIGHT BLACK OLIVE TREES ON THE SOUTH
SIDE OF CORAL WAY (S. W. 22ND STREET) AT S. W. 33RD
AVENUE, LOCATED WITHIN THE CORAL WAY SCENIC
TRANSPORTATION CORRIDOR, ESTABLISHED BY ORDINANCE 9897,
SEPTEMBER 20, 1984, THEREBY ALLOWING CONSTRUCTION AND
INSTALLATION OF A TRAFFIC SIGNAL AND LEFT TURN STORAGE
LANE ON EAST BOUND CORAL WAY AT S. W. 33RD AVENUE AND
THEREBY NECESSARILY REDUCING THE SWALE AREA ON THE
SOUTH SIDE OF CORAL WAY TO ACCOMMODATE THE TWO EAST
BOUND THROUGH LANES, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. THE APPLICANT SHALL RELOCATE THE EIGHT EXISTING
BLACK OLIVE TREES FROM THE SWALE AREA TO OTHER
LOCATIONS ALONG THE CORAL WAY SCENIC TRANSPORTATION
CORRIDOR TO BE SELECTED BY THE HERITAGE
CONSERVATION OFFICER;
2. THE APPLICANT SHALL EXPEND $20,000 IN COSTS OF
LANDSCAPE MATERIALS (ONLY) TO RE -LANDSCAPE SITES
ALONG THE CORAL WAY SCENIC TRANSPORTATION CORRIDOR
TO BE SELECTED BY THE HERITAGE CONSERVATION OFFICER
WITH THE ASSISTANCE OF MIRACLE CENTER'S LANDSCAPE
ARCHITECT, ALBERT PEREZ. THIS RE -LANDSCAPING SHALL
BE IN ACCORDANCE WITH LANDSCAPE PLANS TO BE
PREPARED BY MR. PEREZ AT MIRACLE CENTER'S EXPENSE

AND TO BE APPROVED BY THE HERITAGE CONSERVATION
OFFICER PRIOR TO FINAL APPROVAL BY THE HERITAGE
CONSERVATION BOARD;
3. THE APPLICANT SHALL COMPLETE THE BLACK OLIVE TREE
RELOCATION AND RE -LANDSCAPING OF SELECTED PORTIONS
OF THE CORAL WAY SCENIC CORRIDOR WITHIN NINETY DAYS
OF ISSUANCE OF THE CERTIFICATE OF APPROVAL FOR THE
SUBJECT WORK;
FINDING THAT THE AUTHORIZATION OF THIS CERTIFICATE OF
APPROVAL SHALL NOT BE CONSTRUED AS ESTABLISHING A
PRECEDENT FOR FUTURE TURN LANES ON CORAL WAY. BECAUSE
CORAL WAY IS A LOCAL SCENIC TRANSPORTATION CORRIDOR AND
IS DESIGNATED AS A STATE HISTORIC HIGHWAY BY THE STATE
OF FLORIDA, THE ADDITION OF TURN LANES AT INTERSECTIONS
ON CORAL WAY SHALL BE CONSIDERED BY THE HERITAGE
