HomeMy WebLinkAboutR-89-0107777 J-89=-82 1/19/89 RESOLUTION NO.�y��� A RESOLUTION TO RECONSIDER RESOLUTION NO. 88-1212, ADOPTED DECEMBER 15, 1988, WHICH GRANTED PERMISSION TO REMOVE AND RELOCATE CERTAIN TREES ON CORAL WAY AND WHICH MODIFIED HERITAGE CONSERVATION BOARD RESOLUTION NO. 88-76 RELATIVE TO THE DEVELOPMENT OF THE MIRACLE CENTER PROJECT LOCATED AT APPROXIMATELY CORAL WAY AND SOUTHWEST 33RD AVENUE. WHEREAS, the City Commission adopted Resolution No. 88-1212 on December 15, 1988, authorizing the removal of two Banyan trees from the median of Coral Way in order to accommodate a traffic signal and left turn lane, from eastbound Coral Way to northbound Southwest 33rd Avenue; and WHEREAS, the developers of Miracle Center are required to install a traffic signal at the intersection of Coral Way and >i Southwest 33rd Avenue, pursuant to the Major Use Special Permit (Resolution No. 86-834; October 23, 1986) as amended, for Miracle `. Center now being constructed at 3301-3501 Coral Way; and s WHEREAS, the developer of Miracle Center has requested that Y the City Commission reconsider their action taken in issuing Resolution No. 88-1212; and WHEREAS, the Heritage Conservation Board by Resolution HC-88-76, October 25, 1988, had authorized issuance of a, Certificate of Approval for tree removal on the south side of F Coral Way, thereby allowing the left turn storage lane and traffic signal at the intersection of Coral Way and Southwest r 33rd Avenue.; and WHEREAS, the Planning Department had appealed the decision -'_ of the Heritage Conservation Board Resolution HC-88-76, which appeal was considered by the City Commission and acted upon by the City Commission by Resolution No. 88-1212; December 15, 1988. The City Commission herebv reconsiders its = action in adopting Resolution No. 88-1212 and conducts a rehearing on the Planning Department's appeal of the Heritage Conservation Board's action contained in Resolution HC-88-76, October 25, 1988, which authorized issuance of a Certificate of Approval for tree removal on the south side of Coral Way, thereby allowing a left turn storage lane and traffic signal at the +a intersection of Coral Way and Southwest 33rd Avenue. L storage lane and traffic signal at the intersection of Coral May and S: W: x -'I ` 33rd Avenue; and a WHEREAS, the Planning Department appealed the Heritage Conservation Board -- Resolution NC-0-76 by letter of November 31, 1988; and WHEREAS, after a public hearing, the Commission continued the item from the meeting of November 17, 1988 to December 15, 1988; and WHEREAS, on December 15, 1988, in public hearing, the applicant agreed to the Planning Departments' recommendation, as modified, and proffered certain public benefits; and WHEREAS, the Commission finds it is the best interests of the health, safety and welfare of the citizens of Miami to adopt this resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby modifies the decision of the Heritage Conservation Board Resolution HE-88-76, October 25, 1988, which resolution authorized a Certificate of Approval for the removal of eight black olive trees on the south side of Coral Way (SW 22nd Street) at SW 33rd Avenue. Section 2. The Commission hereby authorizes issuance of a Certificate of Approval, as modified, for only the removal and relocation of two banyan trees now located in the median of Coral Way at S. W. 33rd Avenue. Section 3. Construction and installation of a traffic signal and left turn storage lane for the east bound lanes of Coral Way at S. W. 33rd Avenue is approved. Section 4. The Commission accepts the proffer of the applicant: Fort Schoenberg Properties Inc., to donate Ten Thousand Dollars ($10,000) to The Urban League of Greater Miami, Inc. in honor of T. Willard Fair, President and Chief Executive Officer, and Ten Thousand Dollars (t10,000) to Project RAP (Recreation -At -Parks), a Parks, Recreation and Public Facilities Department 5 Special Account. j Section 5. The Florida Department of Transportation is urged to consider the approval of the closure of the median openings at 3400 Coral Way and ua possibly at approximately 3275 Coral Way, to accommodate the relocated banyan r& trees, either there or elsewhere on Coral Way. E Analysis; Coral Way is a local Scenic Transoortation Corridor and is designated as a "state historic highway" by the, State of Florida. Among other things, this designation prohibits tree removal or alteration of the street's physical dimensions except when` "necessary for the public health or safety". Further' the language of the Bill specifically provides that "preservation of Coral Way and the median landscaping take priority over -considerations - . of traffic mewgemeat. and the public safety shall not*be construed to require alterations in Coral 'mayor the median landscaping Wm alternative ones of promoting safety.- including •more restrictive traffic regulations, are available" (emphasis supplied). The report also notes that a signal "could enhance platooning and spend control and create gaps for r traffic to exit other driveways along Coral Way'. While this reasoning cannot be used as technical support for a signal warrant, its logic with respect to enhancement of safety is sound. 2. Coral Way should not be designed to function as aA arterial thoroughfare. it is characterised by practically continuous frontage businesses, Offices* and similar uses; less than a mile to the west of Miracle Center it is a bbsiness street with angle parking along the frontage. At few points along its length are there more than two traffic lanes in either direction, and those that exist are frequently interrupted by turning movements fr= and to Coral Way. While the street carries near - capacity traffic volumes, it is not overly congested nor especially hazardous. , It is concluded that there is no compelling public health::or safety issuer that justifies alteration -'of Coral Way at the subject location; but that a traffic signal is warranted there.
