A RESOLUTION APPROVING IN PRINCIPLE,
AMENDMENTS TO THE BISCAYNE VIEW APARTMENT
PROJECT MAJOR USE SPECIAL PERMIT ISSUED
PURSUANT TO RESOLUTION NO. 88-390, ADOPTED
APRIL 28, 1988, TO REFLECT THE INCLUSION OF
APPROXIMATELY 463 DWELLING UNITS,
APPROXIMATELY 18,000 SQUARE FEET OF
COMMERCIAL SPACE, APPROXIMATELY 452 PARKING
SPACES, APPROXIMATELY 721,000 GROSS SQUARE
FEET OF FLOOR AREA, APPROXIMATELY 529,000
GROSS SQUARE FEET OF RESIDENTIAL AREA AND
APPROXIMATELY 175,000 GROSS SQUARE FEET OF
GARAGE AREA; REFERENCING THE PLANS ON FILE;
APPROVING, IN PRINCIPLE, FINDINGS THAT THERE
WERE CERTAIN ERRORS IN RESOLUTION NO. 88-390
AND THAT THE ABOVE CHANGES MEET THE SAME
REQUIREMENTS AS FOR THE ORIGINAL APPROVAL;
AND FURTHER, DIRECTING THE CITY CLERK TO SEND
COPIES OF THIS RESOLUTION TO THE AFFECTED
AGENCIES AND THE DEVELOPER.
WHEREAS, the City of Miami submitted an Application for a
Major Use Special Permit per Article 28: Major Use Special
Permits: Detailed Requirements of Zoning Ordinance 9500, for the
Biscayne View Apartments Project (the Project) to be developed by
Cruz Development and Associates, Ltd. (the Developer); and
WHEREAS, the City Commission on April 28, 1988, following an
advertised public hearing adopted Resolution No. 88-390, the
Biscayne View Apartment Project Major Use Special Permit (the
Permit) which approved the Project with conditions; and
WHEREAS, Resolution No. 88-390 contained errors in the line
items of said Permit pertaining to: residential, garage, and
commercial gross building area and the number of parking spaces;
and
WHEREAS, the Developer has submitted building permit plans
(the Plans) which are currently on file with the City, which
reflect the correct calculations; and
WHEREAS, the Director of the Department of Planning has
reviewed the Plans and has prepared a statement demonstrating
that the charges meet with the same requirements as for the
original approval; and
WHEREAS, the remaining Findings of Fact as contained in said
Permit are still correct and undisturbed;

NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDAt
Section I. The City Commission hereby approves, in

principle, findings that there were certain errors in Resolution
No. 88-390, adopted April 28, 1988, pertaining tot residential,
garage, and commercial gross building area and the number of
parking spaces shown on the Biscayne View Apartment Project Major
Use Special Permit pursuant to Section 2 of Resolution 88-390 and
that the changes meet the same requirements as for the original

approval.

Section 2. The City Commission hereby approves, in
principle, amendments to the Biscayne View Apartment Project
Major Use Special Permit issued pursuant to Resolution No.
88-390, adopted on April 28, 1988, to reflect the inclusion of:
approximately 463 rental apartment units, approximately 18,000

square feet of Commercial space, a garage containing
approximately 452 parking spaces, approximately 721,000 gross
square feet of building area, approximately 529,000 gross square
feet of residential area, approximately 18,000 gross square feet
of commercial area, and approximately 175,000 gross square feet
of garage area said amendments being made to correctly reflect
the calculations on the Plans.
Section 3. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as is fully set forth in this
Section.
Section 4. The City Clerk is further directed to send
copies of the herein Resolution to the affected agencies as
specified by the Planning Department and to the Developer.

RECOMMENDATION
It is respectfully recommended that the City commission adopt the
attached resolution approving in principle, amendments to the
Biscayne View Apartment Project Major Use Special Permit issued
pursuant to Resolution No. 88-390, adopted April 28, 1988, to reflect
the inclusion of approximately 463 dwelling units, approximately
18,000 square feet of commercial spaces approximately 462 parking
spaces, approximately 721,000 gross square feet of floor areas
approximately 529,000 gross square feet of residential area and
approximately 175,000 gross square feet of garage area; referencing
the plans on file; approving in principle, findings that there were
certain errors in Resolution No.
88-390 and that the above changes
meet the same requirements as for the original approval; and furthers
directing the City Clerk to send copies of this Resolution to the is

The Planning Department recommends that the City Commission adopt':the
attached resolution approving in principle, amendments to the
Biscayne View Apartment Project Major Use Special Permit issued

The City of Miami filed an application for Major Use Special Permit
for the Biscayne View Apartment Project which is being developed by
Cruz Development and Associates, Ltd. on Block 24 in southeast
Overtown/Park West. The Major Use Special Permit was approved by
Resolution No. 88-390, adopted April 28, 1988. Resolution No. 88-390
incorporated certain findings of fact and project description
information included in the Major Use Special Permit application and
incorporated by reference the plans prepared by Stul

dated February 179 1988 which were submitted as part
Special Permit application.
Since the time the Major Use Special Permit application was approved,
the Developer, Cruz Development and Associates, Ltd, has moved
forward to develop a full set of building permit drawings for the
proposed 463 unit rental apartment complex to be located between N.E.
9th Street and N.E. 10th Street in Overtown and is currently seeking
a building permit to being construction. The building permit plans,
which are on file with the City, have been reviewed and approved by

addition, although not referenced in Resolution No. 88-390, the
current building plans call for the building to be 10 feet shorter
than shown in the original plans incorporated into the Major Use
i Special Permit. Here again, the Department finds this to be an
