HomeMy WebLinkAboutR-89-018746 J-89-58 12/20/0B RESOLUTION NO: 89-187 A RESOLUTION TO TEMPORARILY RESTRICT VEHICULAR ACCESS TO N.W. 22 LANE BETWEEN N.W. 2 AVENUE AND N.W. 5 AVENUE AND TO N.W. 3 COURT BETWEEN N.M. 22 TERRACE AND N.W. 22 LANE, SUBJECT TO THE PROVISIONS CONTAINED WITHIN THIS RESOLUTION. WHEREAS, the vacant property and abandoned buildings abutting N.N. 22 Lane between N.W. 2 Avenue and N.W. 5 Avenue and N.W. 3 Court between N.N. 22 Terrace and N.W. 22 Lane are being used for the illegal dumping of refuse and used tires; and WHEREAS, the Solid Waste Department must continually clean the vacant property and the Fire, Rescue and Inspection Services Department has inspected and declared the refuse filled abandoned buildings a safety and fire hazard; and WHEREAS, the majority of property abutting said streets is City owned and privately owned property abutting said streets have public access through other adjacent streets; and WHEREAS, the Solid Waste Department, Fire, Rescue and Inspection Services Department, Community Development Department and the Public Works Department have requested a temporary restriction of vehicular access to N.W. 22 LANE and N.W. 3 Court; and WHEREAS, Section 54-17 of the City Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing to require that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on January 12, 1989, as to any objections to the temporary prohibition of vehicular access to N.W. 22 Lane between N.W. 2 Avenue and N.N. 5 Avenue and N.W. '3 Court between N.W. 22 Terrace and N.W. 22 Lane and no objections were sustained by the City Commission; and CITY COMMISSION MEETING OF FEB 9p 198/9 � RESOLUTION No. $�-.8 r/, q REMARKS: } WHEREAS, the City Commission finds that the herein prohibition is in the best interest of the public approves the implementation of prohibiting vehicular access at the above location on a temporary basis; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section I. The recitals and findings set forth in the preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Subject to the following provisions of this Resolution, vehicular access to N.W. 22 Lane between N.W. 2 Avenue and N.W. 5 Avenue and N.W. 3 Court between N.W. 22 Terrace and N.N. 22 Lane in the City of Miami, Florida, shall be restricted on a temporary basis by the construction of barricades at the intersections of N.W. 22 Lane and N.W. 2 Avenue, N.W. 22 Lane and N.W. 5 Avenue and N.W. 3 Court and N.W. 22 Terrace. Section 3. Said barricades are to prevent vehicular access only. Section 4. The Department of Public Works is hereby directed to install and maintain said barricades. Section 5. This resolution shall become effective immediately upon its adoption pursuant to law.
