A RESOLUTION CLOSING NORTHWEST 9TH STREET TO VEHICULAR TRAFFIC AT ITS INTERSECTIONS WITH NORTH MIAMI AVENUE AND NORTHWEST 1ST AVENUE TO ALLOW CONSTRUCTION OF A PEDESTRIAN MALL BETWEEN NORTH MIAMI AVENUE AND NORTHWEST 1ST AVENUE AS PART OF THE SOUTHEAST OVERTOWN/PARR WEST REDEVELOPMENT PROJECT; FURTHER AUTHORIZING THE CITY CLERK TO ADVERTISE FOR SEALED BIDS FOR CONSTRUCTION NECESSARY TO ACCOMPLISH SAID PROHIBITION OF VEHICULAR TRAFFIC. WHEREAS, the Miami City Commission approved the design Standards and Guidelines for the Southeast Overtown/Park West Redevelopment Project on March 21, 1985; and WHEREAS, said standards and guidelines designate Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue for redevelopment as a pedestrian mall including prohibition of vehicular traffic; and WHEREAS, Section 54-17 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing, to require that vehicular access to a particular street be prohibited at an intersection where such prohibition is found to be in the best interest of the public; and WHEREAS, the Director of the Southeast Overtown/Park West Redevelopment Project has requested that the Department of Public Works initiate the process to prohibit vehicular access to Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue; and WHEREAS, the Police Department, Fire, Rescue and Inspection Service Department and Solid Waste Department have made recommendations on the proposed prohibition of vehicular traffic on Northwest 9th Street between North Miami Avenue and Northwest lst Avenue and have expressed no objections provided that access kf for emergency vehicles is allowed at all times; and [E63 CONJM't 4P ` EETING A F: 18@ Na "� WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on February 9, 1989, as to any objections to the prohibition of vehicular access to Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue and no objections were sustained by the City Commission; and WHEREAS, the City Commission hereby finds that the herein prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby approved, confirmed and adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Northwest 9th Street, at the intersection of North Miami Avenue and the intersection of Northwest 1st Avenue, is hereby closed to vehicular traffic, with the exception of emergency vehicles, to allow construction of a pedestrian mall between North Miami Avenue and Northwest 1st Avenue as part of the Southeast Overtown/Park West Redevelopment Project. Section 3. The City Clerk is hereby authorized to advertise for sealed bids for the construction necessary to accomplish the prohibition of vehicular traffic as set forth herein. Section 4. This Resolution shall become effective immediately upon its adoption pursuant to law. PASSED AND ADOPTED this 9th day of Fehruar ^ , 1989. City Commission Peeting of February 9, 1989 REFERENCES : Prohibition of Vehicular Access on NW 9 Street ENCLOSURES: New Resolution Pursuant to the legal opinion, verbally given to the City Commission on January 26, 1989, regarding City Code limitations on closing of City streets (only at intersections), the subject Resolution, for prohibition of vehicular access on Northwest 9th Street between North Miami Avenue and Northwest 1st Avenue for purposes of creating a pedestrian mall, has been rewritten to specifically provide that said closings shall occur at the intersections.
