A RElSOLUTION, RATIFYING, APPROVING AND CONFIRMING THE ACTION OF THE CITY MANAGER IN WMCUTING A LETTER AGREEMENT DATED NOVEMBER 28, 1988 WITH THE BALTIMORE ORIOLES BASEBALL TEAM FOR THE USE OF THE MIAMI BOBBY MADURO BASEBALL STADIUM IN 1989, WITH THE OPTION ON THE PART OF THE TEAM TO EXTEND SUCH USE DURING 1990. WHEREAS, the City Commission by Motion No. 88-261, adopted March 24, 1988, directed the City Manager to take all necessary = action to keep the Baltimore Orioles baseball team here in Miami for its training sessions; and WHEREAS, the City Manager negotiated with said team such terms of use to effectuate the continuation of the team training at City facilities; and r WHEREAS, a letter agreement was executed in November, 1988 is by the City Manager and the Baltimore Orioles which delineates:_ such terms; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY .,ram —_ OF MIAMI, FLORIDA: Section 1. The action of the City Manager in executing a letter agreement, dated November 28, 1988, with the Baltimore - Orioles baseball team for the use of the Miami Bobby Maduro�= Baseball Stadium in 1989, with the option on the part of the team to extend such use during 1990, is hereby ratified, approved and r. t confirmed. Clty Manager _ E�K�IOStJRE6 sack ground It le respectfully recommended that the City Commission adopt the attached Resolution ratifying, approving and confirming the action of the City Manager in executing a letter agreement with the Baltimore Orioles baseball team for the use of the Miami Bobby Maduro baseball Stadium in 1989, with the option to extend such use for 1990. r RWOMlMDATION The Department of Parks, Recreation and public Paeilities has prepared the attached Legislation. on March 24, r988- by:'Motion. 'F No. 88-261,.the City Commission directed the City,Manager-'t&.take all necessary action to keep the`Baltimore-orioles here in Miami, �4 subsequent discussions and negotiations with the team resulted in the execution of 'a letter agreement in November, 1988. Yt r Theg :a regiment 'allows the team to use the Baseball Stadium for spring tra'ining in 1989, ` requiring that they schedule ' at least twelve games. The Orioles will pay the City 17% of gross receipts from ticket.sales and will receive 17% of gross receipts from.coriraOnions, as was done in the past. The Orioles wi11 control program and novelty concessions, but will aeaess,the $.30 - ticket surcharge for the City as required by ordinance 10439,- = Additionally, y, the team may sell stadium advertising during the � term of use, and will split such revenue 50-50 with the City. Lastly, the city is to increase the number: of practice batting - cages to four (4). The executed letter agreement further carries an option to extend such use through the 1990 season under the same terms and conditions. Adoption of the attached Resolution confirma.tho t . Although no improvements are required to the stadium as a condition of the agreement, we did commit. to increasing the number bf practice batting cages to four. Mr_. Lucchino was informed of the new seat surcharge ordinance and requested a copy of said ordinance. If you have not done so yet, please -send Mr. Lucchino a copy immediately. The Orioles requested, and were granted, the right to sell advertising on -:tha outfield wall. The revenues will be split 50-50 with the City. They i Sot the clubhouse, they've got the fields that they want and whatever, you know... if we're talking about whatever it takes within reason, we are able, to give them, within reason, all that they need right in that park and they're close to hotels, you know, there are a number of hotels right on Le Jeuns to facilitate their headquarters and I think it's an ideal situation.
