AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED; MORE SPECIFICALLY BY AMENDING
TABLE 4, TITLED "DENSITY, INTENSITY AND PARKING," TO CHANGE
THE METHOD BY WHICH THE PARKING RATIO MAY BE REDUCED
WITHIN OPPORTUNITY ZONES; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114
as the Zoning Ordinance for the City of Miami ("Miami 21 Code"); and
WHEREAS, on April 28, 2022, the City Commission adopted Ordinance No. 14065
amending Table 4 titled "Density, Intensity and Parking," to change the method by which the
parking ratio may be reduced within a transit oriented development area or within a transit
corridor from a waiver process to the process of an exception with city commission approval of
Ordinance No. 13114, the Zoning Ordinance for the City of Miami ("Miami 21 Code"); and
WHEREAS, City Commission has considered whether the proposed amendments will
further the goals, objectives and polices pf the Miami Comprehensive Neighborhood Plan
("MCNP"), the Miami 21 Code, and other City regulations; and
WHEREAS, City Commission has considered the Planning Director's recommendations
and conducted a public hearing on the proposed amendments; and
WHEREAS, the Planning, Zoning and Appeals Board (TZAB"), at its meeting on
November 16, 2022 following an advertised public hearing, adopted Resolution No. PZAB-R-22-
062 by a vote of seven to four (7-4), Item No. PZAB.8, recommending approval of the Zoning
Text Change;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Article 4, Table 4 of the Miami 21 Code is amended in the following
particulars:1

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of the Ordinance shall not be affected.
Section 4. New Developments under review by the City that have completed prescreen
review within ePlan prior to May 2022 shall be vested under previous parking reduction
standards.
Section 5. This Ordinance shall become effective immediately after the adoption
thereof.2
