The proposed rezone from "D1" to "T6-12-0" would increase density from 36 dwelling units per
acre to 150 units per acre which permits a maximum of 88 dwelling units by Right on the
Property. Located within a TOD, the site can be developed with 132 dwelling units by utilizing
the Transfer of Development Density Program for Historic Resources established in Chapter 23
of the City Code of Ordinances and Article 4, Diagram 11 of Miami 21 Code. Permitted Density,
Intensity and Height would increase the existing and proposed transect zones.

permitted dwelling and lodging units only as accessary uses and only for watchmen, caretakers,
and others requiring living quarters on premises, and residential uses were limited to hotels and

Figure 8: Quarant One
The Property abuts Quadrant One and was included in the Study, but
rezoning from "D1" to "T6-8-0" would have required a FLUM
amendment from Light Industrial to Restricted Commercial. As such,
these parcels were excluded from Rezone Application PZ-20-7526.
The proposed Rezone for this Property from "D1 "to "T6-12-0", by the
Applicant, provides them a way to circumvent participation in the Citys
Public Benefits Program for the benefit of a single applicant at the
expense of the Public. The Miami 21 Code is intended to capture in
instances precisely like this scenario, rather than rezoning to a higher
transect "T6-12-0",the Applicant can capture additional development
capacity for a "T6-8-0 via participation in the public benefits.

Finding Pursuant to Article 7, Section 7.1.2.8.(f)(2) of Miami 21 Code, the
Criteria 3 request to rezone is consistent with the Miami 21 Code in that it is
successional; however, it is also inconsistent in that this request
would not preserve the "T6-8-0"neighborhood to the west and contrary
to the findings of the Planning Department's Culmer Study.
While the property abutting to the east was recently rezoned from "D1
to "T6-12-0",
Alternatively, staff recommends that rezoning the site to "T6-8-0"as
more appropriate for the proposed Rezoning.
Staff made a similar recommendation for the parcel located to the east
that was rezoned from "D1" to "T6-12-0". However, that site was
declared a brownfield and required environmental remediation to
redevelop the site. The Miami City Commission found that the rezoning
from "D1" — Work Place District Zone to "T6-12-0", Urban Core
Transect Zone — Open, may increase the likelihood of redevelopment
H. CONCLUSION
The City of Miami received an Application for Rezone from Trendy Properties, LLC for an
assemblage that is approximately 0.59 acres (25,708 square feet) located approximately at
1210, 1222, 1234, and 1250 Northwest 7 Avenue. The existing zoning for the Property is "D1"
and with "T6-8-0" to the west, "D1" to the south and north, and "T6-12-0" to the east. The
Property is comprised of residential, sales and commercial, and vacant properties. The
Applicant has proposed to change the zoning to "T6-12-0".
Staff found that the proposed request is not consistent with the Rezoning Criteria from Miami 21
Article 7, Section 7.1.2.8.f. Though the Property meets the requirements for rezone, changing
the zoning creates an undesirable impact on the zoning and development patterns of the area.
Staff recommends Denial of the requested rezone to "T6-12-0".
Alternatively, staff recommends that rezoning the site from "D1"to "T6-8-0"is more appropriate
for the Property, based upon the facts and findings in this staff analysis.

1. Provide more details and accuracy in the examples invoked in the letter of intent. 04/06/22
2. Survey must abide the requirements especified in Miami 21 Code and provide Lot size and Legal Descri on.
3. May the Applicant want to provide certain restrictions in uses, a voluntarily proffered Covenant will be the
appropriate mechanism to make it formal. Staff will not consider the Covenant in it's recommendation, but the
boards will.
4. Include in your analysis explanation of why the existing Zoning classification is inappropriate for the subject
properties, and how this request will benefit the immediate neighbohood or the entire city
5. Is the surrounding neighborhood an stable residential area or is a changing area?
6. Staff recommends to reach out the NET Office and the neighbors regarding the proposed rezoning and
provide the city with the feedback received.
7. Explain the relationship of the proposed amendment to the goals, objectives and policies of the
Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals,
objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations (Sec.
7.1.2.8 f). Check the distance from Culmer Station and MCNP Policy TR-2.7.6, TR-2.1.3, Policy LU-1.1.10,
and HO-1.1.9. In this analysis consider the impact of the request to the D-1 properety to the south that would
remain detached and isolated from a similar Transect Zone.
8. Elaborate in the need and justification for the proposed change, including changed or changing conditions
that make the passage of the proposed change necessary. In the analysis consider also the impact of the
rezoning to the abutting properties to the west (single family residences, relatively new with a lot size that
restrict them to maximize the current zoning designation.
9. If the request involves a Density increase, the application must contain a School Concurrency form properly
filled and signed by the Applicant.
10. Be sure to comply with the Naming Convention for your application(s), as provided in the attached Checklists
for Comprehensive Plan Amendment and Rezoning.

Re: Request for Neighborhood Comprehensive Plan Amendment and Rezoning of the
Properties at 1210-1250 NW 7th Avenue
Dear Mr. Garcia:
Our firm represents Trendy Properties, LLC (the "Owner"), the owner of the properties at 1210,
1222, 1234, and 1250 NW 7th Avenue, which are legally described in the attached Exhibit 'A" (the
"Properties'). The purpose of this letter is to submit the attached applications which seek to (a)
amend the Future Land Use Map ("FLUM") designation under the Miami Comprehensive
Neighborhood Plan ("MCNP") of the Properties from Industrial to Restricted Commercial; and (b)
change the zoning of the Properties reflected in the Miami 21 Zoning Atlas from Dl to T6-12-0 (the
"Applications").
The Properties are partially improved infill property located along the west side of NW 7t1
Avenue, between NW 12th and 13th Streets centrally located within the Highland Park neighborhood.
The neighborhood is well defined, bounded by State Road 836 to the north, the Miami River to the
south and west, and Interstate 95 to the east. See Attached Exhibit 1. NW 7th Avenue is the main
north -south artery for the neighborhood; the Properties are located within two blocks of the Culmer
Metrorail station and within a few minutes' drive of the Health District. The Properties are also close
to east -west arteries such as NW loth, NW llth, and NW 14th Streets, which offer easy access to
employment centers in Downtown and Edgewater. Miami Dade Transit bus service offer
countywide accessibility from a stop directly in front of the Properties.' With such a central location
and easy routes to major employment centers it is curious why the neighborhood continues to be
characterized by under -development and under -investment. Part of the problem, previously noted
'The 77 Route from Downtown to Golden Glades/199d' Street is available immediately in front of the Properties at
NW 1311' Street and NW 711' Avenue. Additional routes, including 21 (Downtown to Allapattah & Northside), 113
(Hospital District to Miami Beach), 246 (Downtown to Opa-Locka and 1631d Street Mall) and 277 MAX rush hour relief
service are available a few blocks north at NW 1711' Street and NW 711' Avenue.

by the Planning Departmentz, are the limitations on a true neighborhood -serving m 04/06/22
the under-utilized industrial properties along Highland Park's major arteries. These r
seek to remedy that, by replacing industrial zoning that is neither compatible nor condu
primarily residential neighborhood, with mixed -use development that will contribute to the fabric
of the developing Highland Park.
Together, the Properties measure approximately 27,600 square feet, or approximately 0.63
acres, and feature 250 feet of linear frontage along a single street, NW 7th Avenue. The frontage
exceeds the minimum criteria of Article 7.1.2.8.c.1 of Miami 21 which renders the Properties eligible
for rezoning.
The requested rezoning to T6-12-0 complies with the successional zoning criteria of Section
7.1.2.8.a. and 7.1.2.812 of Miami 21. The Successional Zoning Table in Section 7.1.2.8.a.3 allows for
successional rezoning of D1 properties to several potential T6 Transect Zones in order to yield the
most coherent pattern given the established zoning patterns and context in the immediate vicinity.
In this instance, the established zoning pattern is one of high density residential of moderate
intensity with most of the properties in Highland Park already zoned T6-8. Growth patterns
encouraged by the Planning Department recognize the need for a mix of uses and the lack of
compatibility of industrial uses with this evolving residential, mixed -use neighborhood. Located
directly on Highland Park's only local north -south artery, the T6-12-0 Transect Zone befits the
residential, mixed -use context, and yields the most coherent zoning pattern for the neighborhood,
concentrating a higher intensity on Highland Park's main street. Further, the Properties' close
proximity to various mass transit opportunities and employment centers favors higher intensity in
the neighborhood. In similarly compelling circumstances, the City Commission recently recognized
the appropriateness of the T6-12-0 Transect Zone along NW 7th Avenue when it approved the
rezoning of the property directly across the street from D1 to T6-12-0.3 The City has also previously
supported other applications seeking a change from D1 to T6-12-0.4
The Applications are consistent with the goals and objectives of the MCNP by facilitating
high density, mixed -use development near multi -modal public transportation and employment
centers that will draw new residents to Highland Park, serve them with a mix of neighborhood
commercial uses, and encourage increased Metrorail ridership and pedestrianism. The current
industrial FLUM designation and zoning serves none of these purposes and fails to leverage the
neighborhood's ideal location. Specifically, approval of the Applications furthers the following goals,
objectives and policies of the MCNP:
1) Policy LU-1.1.7: Land development regulations and policies will allow for the
development and redevelopment of well -designed mixed -use neighborhoods that
provide for the full range of residential, office, live/work, neighborhood retail, and
2 Indeed there is a current effort, sponsored by the City, to amend the zoning of the portion of the neighborhood west
of the Properties to provide for a greater mix of uses within the existing high density residential context. See Legislative
File ID No. 7583 approved on first reading by the City Commission.

PZ-20-8015
The Applications address the MCNP's emphasis on locating higher dens 04/06/22
Metrorail, multi -modal transit, and employment centers, and are consistent with the
guiding principles of Miami 21. These guiding principles encourage new development stru
reinforce a pattern of neighborhoods and urban centers, focusing growth at transit nodes in order to
foster the expansion and enhancement of transit opportunities and connections throughout the City.
On a community level, Miami 21 favors compact, pedestrian -oriented and mixed -use neighborhoods
and urban centers, with densities and intensities that relate to the degree of transit service in the
area. The highest densities and intensities should occur within walking distance of transit stops
and on commercial corridors, with transitions of density and height to relate to smaller development
further away from those corridors.
The proposed change to T6-12-0 will unlock a wider range of viable uses that are appropriate
based for the location of the Properties. T6-12-0 will promote high -density residential, office and
neighborhood commercial uses in close proximity to multiple modes of transit, employment centers,
schools, and the Urban Central Business District. By locating the higher intensity along NW 7th
Avenue within a couple of blocks from the Culmer Metrorail Station, development of the Properties
under T6-12-0 will incentivize ridership on the Metrorail and the NW 7th Avenue Transit Corridor as
an alternative to personal automobile use. As the neighborhood's most intense thoroughfare and the
backbone of the area's automobile and bus transit network, NW 7th Avenue is the most logical place
to locate additional height and intensity, as has been proposed directly across the street from the
Properties. Consistent with one of Miami 21's core principles, T6-12-0 zoning for the Properties
provides for transitioning, facilitating a step down in height and massing from NW 7th Avenue, to
the lower height and intensity T6-8 neighborhood to the west.
The current Light Industrial designation and D1 zoning do not advance the policies of the
MCNP and Sections 7.1.2.811(b) and 7.2.2.8.c.2(g) of Miami 21. At present, the Properties are part of a
strip of Light Industrial straddling NW 7th Avenue, which separates the residential portion of
Highland Park from the South East Overtown Park West Community Redevelopment Area and
Urban Central Business District. In the past, the Seaboard Coastline Railroad, which ran just east of
the Properties, provided freight service to area warehouses and the Biscayne Chemical complex
formerly located east of the Properties. The freight railroad is long gone now, and with it, the purpose
and feasibility of industrial zoning in the area. Not surprisingly, portions of the Properties are vacant,
and the others struggle to find viable long-term use. This has led to their underutilization and, given
the neighborhood's ideal urban location, urgent need for change.
With Culmer Metrorail Station located a mere two blocks from the Properties and highways
defining the other boundaries, the neighborhood encompasses a narrow strip of underperforming
industrial sandwiched by properties to the northeast offering institutional zoning, and properties to
the west characterized by relatively few newer multi -family structures mixed in with a significant
proportion of vacant lots (87 out of 215 properties). Entire blocks within the neighborhood are
completely vacant, with others offering a hodgepodge of empty lots and underdeveloped low -density
duplexes and single-family homes, remnants of a different time in the City's history. The wider area
includes underdeveloped industrial and medium density residential properties to the south located
with in the South East Overtown Park West Community Redevelopment Agency area, and the well -
established low -density Spring Garden neighborhood further south and east, buffered from Highland
Park by the Seybold Canal and Metrorail.

Although underutilized, Highland Park is primed for redevelopment and r04/06/22
order to establish itself as the next great Miami neighborhood.' An early pioneer on
the Properties has already developed a 12-story residential building. Redevelopment associa '
the recent rezoning efforts for the property across the street is expected in short order, and the
Planning Department is seeking rezoning of the underdeveloped western portion of Highland Park
to encourage development. The renaissance is underway because of the neighborhood's attributes,
with the Properties sitting at its prime location. Those enviable characteristics include employment
and cultural opportunities of South East Overtown Park West, and the Urban Central Business
District to the South and East, and the Health District just a few minutes away to the North.
With relatively easy connectivity to other neighborhoods of the City, including Allapatah,
Wynwood, and Edgewater, the Properties are ideally situated for a vibrant residential neighborhood
consisting of housing serving a broad diversity of income levels. By also promoting neighborhood -
serving retail and office uses along the 7t1 Avenue corridor, the Restricted Commercial designation
and T6-12-0 zoning will provide pedestrian -friendly options within Highland Park for residents,
visitors, and non-resident employees of the nearby employment centers. New commercial uses and
increased housing opportunities will also foster increased Metrorail ridership via Culmer Station
and use of the NW 7t1 Avenue Transit Corridor.
These factors firmly support a change from Light Industrial and D1 zoning that currently
inhibits neighborhood revitalization, to a Restricted Commercial designation and T6-12-0 zoning
that promotes high density, mixed -use development that leverages the neighborhood's central
location and promotes use of the nearby Metrorail. Given their location along the main thoroughfare
of Highland Park and within a short walk from Culmer Station, the Properties are situated at the
epicenter of this valuable but underutilized City neighborhood. Responsive and responsible urban
planning therefore supports the change to the higher residential density and intensity, with options
for neighborhood retail and office, sought in the Applications.
We appreciate your review of the Applications and look forward to your favorable
recommendations. As always, please feel free to reach out to me if you have any additional
questions.
Very truly yours,

Re: Support of Comprehensive Plan Amendment and Rezoning of Properties located at

Ron. Chairman & Members of the City Commission:
My name is Kelly P. Kitc, Jr., and I am one of the principals of KTLC Biscayne,
LLC ("KTLC"), the owner of the property located at 690 NW 13" Street (the "KTLC
Property"). The KTLC Property is located directly across NW 7`1 Avenue from the
properties at 1210-1250 NW 7"` Avenue. I write to express KTLC's strong support for the
comprehensive plan amendment and rezoning of the properties at 1210-1250 NW 71" Avenue
from D1 to T6-12-0. This part of the NW 711' Avenue corridor is seeing a change away from
its previous industrial character. The neighborhood is moving toward a mixed commercial
and residential nature that is better suited for its location near the Culmer Metrorail Station
and major employment centers nearby like the Hospital District and Urban Central Business
District.
KTLC supports this comprehensive plan amendment and rezoning and hopes that
you will vote to approve them. Thank you.

Re: Neighborhood Support of Comprehensive Plan Amendment and Rezoning of
Properties located at 1210-1250 NW 7th Avenue
Dear Mr. Garcia
I am a neighbor and property owner in the Highland Park neighborhood. I own
several properties in the immediate area of 1210-1250 NW 71h Avenue. I write to you to
express my STRONG SUPPORT for the comprehensive plan amendment and rezoning of
the properties at approximately 1210-1250 NW 71h Avenue neighborhood from D1 to T6-12-
0.
If rezoned, these properties hold great potential for the Highland Park area as well as
Downtown and the Hospital District. The properties have excellent access to transit, as they
are within the Culmer Metrorail Station TOD Area, as well as front the NW 71h Avenue
Transit Corridor. Compared to the existing industrial designation, the T6-12-0 zoning (with
corresponding comprehensive plan designation) would encourage mixed -use development
that can enhance our area and draw new residents and visitors to live, work and play in the
Highland Park. This will benefit not only Highland Park, but also nearby Downtown and
the Hospital District.
I strongly support the comprehensive plan amendment and rezoning of the properties
at 1210-1250 NW 71h Avenue to T6-12-0, as it will increase the available use options in
Highland Park and will incentivize appropriate development in the area.
I encourage your support and recommendation of approval of this comprehensive
plan application and rezoning.

Dear Constituent:
Welcome to the City of Miami! This package is intended to provide you with all open
Code Enforcement violations and liens attached to the subject property, or properties,
as of the current date and time the following report was created. Closed violations and
future violations are not included.
A violation may become a lien when the property owner does not timely remedy the
violation. This report may include two types of liens: Certified liens and non -certified
liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens
continue to accrue interest or a per diem fine; therefore, those liens must be satisfied
with the City as quickly as possible.
All outstanding violations and liens must be satisfactorily resolved before the City can
issue a Certificate of Use (CU); however, the City inspects all properties prior to the
issuance of a CU and those inspections may yield additional items, which must be
addressed by the owner at the property prior to issuance of a CU.
This search does not include encumbrances, other liens, restrictions or the like,
recorded in the Public Records of Miami -Dade County, Florida. Please contact
Miami -Dade County for the aforementioned items.

Miami -Dade County for the aforementioned items.

and County agencies review zoning public hearing requests and provide input, which may `°mm°°°'°°°°`a"na`de °
and outcome of my hearing. These reviews may require additional hearings before other Cit PZ-20-8015
boards, which may result in the modification of plans,. studies and/or the proffering of agreeme 04/06/22
recorded. The submission and acceptance of a request for public hearing means that the applica
be scheduled for public hearing. I am also aware that 1 must comply promptly with any City or Count
and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc, that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any
fees paid.
6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
7. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan,
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.
B. Any and all documents submitted must be accompanied by a cover letter indicating the subject matter,
application number and hearing date.
