A RESOL ION AUTHORIZING AND PERMITTING THE

RESTRICTI N OF VEHICULAR ACCESS TO KUMQUAT AND
LOQUAT AV UES AT THE WESTERLY SIDE OF THEIR
INTERSECTI WITH DOUGLAS ROAD (S.W. 37
AVENUE) ON A NINETY (90) DAY TRIM; BASIS BY
CONSTRUCTI TEMPORARY BARRICADES ACROSS SAID
AVENUES, SUB ECT TO CITY COMMISSION REVIEW AND

PROVISIONS CO TAINED WITHIN THIS RESOLUTION.
WHEREAS, a group property owners have requested
permission from the City to estrict vehicular access to Kumquat
and Loquat Avenues at the w sterly side of their Intersection
with Douglas Road (S.W. 37 Aven e); and

WHEREAS, Section 54-17 of he Code of the City of Miami,
Florida, gives the City Commissl n the power, after a properly
ry;-
advertised public hearing to requl a that vehicular access to a
particular street be prohibited at an intersection where such
prohibition is found to be In the b t Interest of the public;

WHEREAS, the City Commission h s requested that the
Department of Public Works Initiate th process to prohibit

vehicular access to Kumquat and Loquat A nues at the westerly
side their Intersection with Douglas Road (S W. 37 Avenue); and

WHEREAS, the Poilce.Department,� Fire, R cue and inspection
Services Department, Metropolitan Dade Cou ty Public Works
Department and the City of Miami Public Works Department have
made recommendations on the proposed prohibits n of vehicular
access and object to the proposed restriction; and
WHEREAS, pursuant to due public notice, "a publi `hearing was

held before the City Commission on March 3, 1989 as ;to nny

for a ninety (00) day trial period to determine If said
prohibitions are In the best Interest of the public; and
WHEREAS, by Resolution No. 89-186, adapted February 9, 1980,
the City Commission has enacted a policy whereby it will not
honor funding requests from the general public through the }

remainder of fiscal year 1988-89;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth In the
- preamble to this resolution are hereby Incorporated by reference
= and adopted.
Section 2. The Department of Public Works Is hereby
directed to construct and maintain for a ninety (90) day trial f`

period, temporary barricades across Kumquat and Loquat Avenues at
the westerly side of their Intersection with Douglas Road (S.W.
37 Avenue).

Section 3. Said barricades shall prevent vehicular access,
but not restrict pedestrian access.
Section 4. This Resolution shall become effective Z�

Immediately upon Its adoption pursuant to law.
