WHEREAS, a group of property owners have requested v permission from the City to,- restrict vehicular access to N.E.'38 Street and N.E.. 40 Street at the easterly side of their Intersection with North Miami Avenue, N.E. 38 Street and N.E. 40 Street at the. wester) y s I de of - the I r I ntersect I on 'w 1-th N . " 2 :J Avenue, N.E. 1 Avenue and N.E. 1 Court at the northerly side of their Inter,sectIon with N.W. 36 Street and N.E._1 Avenue at the ti southerly,s.ide of its intersection with N.E. 41 Street; and ,WHEREAS, Section 54-17 of the Code of the City of Miami, '- Florida, gives the City Commission the power, after a properly advertised pub IIc,hear Ing to require that vehicular access to A Particular: street be prohibited at an intersection where such proh I b I t Ion Is found to be In the best Interest of,: the pub I i c and WHEREAS, the City Comm i ss l on has requested that- the Department of Public .Works. WHEREAS, the Police Department, Fire, Rescue and Inspection u Services Department, Metropolitan Dade County Public Works Department and the City of Miami Public Works Department have made recommendations on the proposed prohibition of vehicular access and object to the proposed restrictions; and WHEREAS, pursuant to due public notice, a public hearing was t l held before the City Commission on March 3, 1989 as to any 4 objections to the prohibition of vehicular access to said streets a within the Miami Design District and no objections"of substance were sustained by the Commission; and WHEREAS, not withstanding said objections, the City Commission finds that the herein prohibition should be Instituted = for a_; ninety (90) day trial period to determine if said prohibitions are in the best Interest of the public; and WHEREAS, by Resolution No. 89-185, adopted February 91, 1989, _ the City Commission has enacted a policy whereby It wlII not honor funding requests from the general public through the remainder of fiscal year 1988-89; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: i� Section 1. The recitals and findings set forth In the t preamble to this resolution are hereby Incorporated by reference and adopted. �t Section 2. The Department of Public Works is hereby'' directed to construct and maintain for a ninety (90) day trial period, temporary barricades across N.E. 38 Street and N.E. 40 i F> Street at the easterly side of their Intersection with North g. M I am I Avenue, N.E. 38 Street and N.E. 40 Street at the westerly.. side of their Intersection with N.E. 2 Avenue, N.E. 1 Avenue and ; ti N.E. 1 Court at the northerly side of their Intersection with N.W. 36 Street and N.E. 1 Avenue at the southerly side of ais T Intersection with N,E. 41 Street.
