HomeMy WebLinkAboutR-89-0218d J-89-192 2/22/89 RESOLUTION N0. 89-216 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMIt FLORIDA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERLOCAL AGREEMENT BY AND BETWEEN METROPOLITAN' DADE COUNTY AND THE CITY OF MIAMI IN ORDER TO MAKE A JOINT APPLICATION TO THE STATE OF FLORIDA SOLID WASTE MANAGEMENT GRANT PROGRAM FOR THE FUNDING OF RECYCLING AND RELATED EDUCATIONAL PROJECTS IN ACCORDANCE WITH SECTION 403.7095 FLORIDA STATUTE. WHEREAS, the Florida Legislature has passed State Bill 1192 (SB.1192) presenting local governments with goals of recycling 30% of all solid waste by the year 1994; and WHEREAS, the State Solid Waste Management Grant Program provides for funding of local recycling and educational projects; and WHEREAS, to apply jointly with Dade County and other — municipalities in Dade County there is no local match requirement per S403.7095 (3c) Florida Statue; and WHEREAS, the Commission of the City of Miami desires to accomplish the purposes outlined in the accompanying memorandum a copy of which is incorporated herein by reference; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. It Is agreed that the City shall meet on a regular basis and cooperate with the County and any other municipalities entering Into a like agreement with the County to the fullest extent practical In exchanging information to (a) prepare grant applications, (b) develop a county -wide recycling plan which will serve both incorporated and unincorporated areas of Dade County and (c) prepare an annual recycling report to the Florida Department of Environmental Regulation (FDER) as required by Section 403.706(7) F.S. and (d) meet other data needs as may be required by the County or State as part of the solid waste management program. It is agreed that both parties and other participating municipalities will seek to submit to the FDER a joint application for a solid waste grant for the first (March 1, 1989) and subsequent (October 1, 1989-1993) grant deadlines. This application will consist of a series of recycling projects, sponsored by either one or both parties or other participating municipalities and developed in accord with the agreed -upon county -wide recycling plan. The City hereby authorizes the County to submit the grant application on behalf of the County and City, and recognizes that said application will be made also on behalf of other participating municipalities. The City agrees to provide to the County all Information needed to develop a - complete recycling plan and application and to comply with FOER's annual reporting requirements. It is agreed that effort will be directed toward development of both a recycling plan and a complete application package that distributes funding and benefits to all participating Incorporated and unincorporated areas of the County. Each local government Is encouraged to develop proposals budgeted in accordance with their pro rats share of the incentive portion plus any base portion of the grant that they are entitled to in accordance with Section 403.7095(2) and (3) F.S. It is agreed that State funds approved will be allocated by the County to participating local governments on the basis of the grant application as approved by the FDER. The County will disiw ibute grant funds to the City and all other participating municipalities within 30 days of receipt of full program reimbursement. Funds will be distributed on the basis of expenditures approved by the FDER. Any percentage of the grant funding advanced by the State will also be distributed on the basis of the grant application as approved by FDER._ It is agreed that the City will manage and expend gran# ru �5 _: funds allocated and distributed to it by the County n accordance with all applicable State guidelines. J s It is agreed that as provided for In Section 403.7095(3)(c) F.S., relative to lack of 75 percent total participation of municipalities, both the matching funds and the proof of the availability of such funds will be provided by each local government In the dollar amount that has been allocated to that local government as provided In the grant application. The City retains the choice as to the amount of its Individual proposal for State funding to be included in the Joint package up to its - "pro rats share" and may choose not to submit a request in any particular year without penalty. In no case shall the City's obligation to provide the local match exceed the dollar amount that the City is requesting for Its program in the Joint application. In addition, each local government shall assume responsibility for any project expenditures incurred in advance of State reimbursement of such expenses. This agreement shall remain in effect throughout the life of the FDER Solid Waste Grant Program, currently scheduled to expire on September 30, 1994. This agreement may be modified by the mutual written consent of both parties and as required by revisions to the statute. This agreement may be terminated by either party provided that such termination be given In writing to the other party at least 90 days prior to the close of atoy grant year and shall be effective upon the close of the year. Notwithstanding termination, any accrued rights or duties shall remain effective, In particular including the exchange of information to fulfill the State's annual reporting requirements. Odio REFERENCES: State of Florida Solid City Manager Waste Grant Application ENCLOSURES: RECONNENDATIONs It is recommended that the City Commission- approve the attached Resolution authorizing the City Manager to enter into an Interlocall, Agreement, a copy of which is incorporated herein, with Metropolitan' Dade County for a joint State of Florida Solid Waste Management Grant Application to be submitted to the Florida Department of Environmental: Regulation. BACKGROUND: t .Senate Bill 1192, an act relating to Solid Waste Management, passed by the Florida Legislature during its 1988 session-. statute which took effect October 1, 1988 substantially alters 'tiie.`.,.: requirements concerning local solid waste management °in' Florida. ate Local governments are presented with the goal- of recycling '30% of solid waste .by 1994. The statute establishes responsibility :witli4 Florida Counties to develop "solid waste management and recycling' programs to provide for a sufficient reduction of.the �amount.,of;soli",d waste. generated within the county and municipalities within boundaries." Furthermore, the legislation provides 'that "each count shall ensure to the maximum extent: possible that municipalities': j`� participate in the preparation and implementation of the- recycling andy'= x�< solid waste management programs." Counties and Cities Apply Separately: 41 The County and all Cities with populations of over 50000.�, (Miami, Hialeah, Miami Beach) are eligible , to apply° individually and receive a grant with both a base portion of._ approximately $68,000 and an incentive portion::-,, of p. approximately $1.56:per capita, providing.that the. incentive<- :- portion is matched equally with local funds. 2. County and Most Cities Apply Jointly: The -County: and a sufficient number of Cities (representing. ° 75% of the incorporated population) develop a plan and apply jointly. They are eligible for the funds as described above . - However, no local match -- is required. 3. County and Some Cities Apply Jointly: A third option exists, that is, a joint application is made by the County and a smaller number of cities. In this case a local match of 50% is required, but the smaller Cities. are able to participate. i 3S.
