( AN EMERGENCY ORDINANCE AUTHORIZING THE CREATION OF THE OVERTOWN LOCAL GOVERNMENT NEIGHBORHOOD IMPROVEMENT DISTRICT PURSUANT TO THE PROVISIONS OF SECTION 163.504 F.S.; IN ACCORDANCE WITH SECTION 163.506 F.S.; IDENTIFYING THE DISTRICT AS AN AREA OF APPROXIMATELY 201.0 ACRES IN SIZE LOCATED WITHIN THE CITY OF MIAMI; BOUNDED ON THE EAST BY THE FLORIDA EAST COAST RAIL ROAD RIGHT-OF-WAY, ON THE NORTH BY NORTHWEST 20 STREET UNTIL ITS INTERSECTION WITH NORTHWEST 3 AVENUE, THENCE NORTHERLY TO NORTHWEST 22 STREET THENCE WESTERLY UNTIL ITS INTERSECTION WITH NORTHWEST 5 AVENUE THENCE SOUTHERLY TO NORTHWEST 21 TERRACE THENCE WESTERLY UNTIL ITS INTERSECTION WITH US INTERSTATE I-95, ON THE WEST BY US INTERSTATE I-95 UNTIL ITS INTERSECTION WITH US INTERSTATE I-395, AND ON THE SOUTH BY US INTERSTATE I-395; AUTHORIZING THE DISTRICT AND/OR THE CITY, ON BEHALF OF THIS DISTRICT, TO RECEIVE A PLANNING GRANT FROM FLORIDA DEPARTMENT OF COMMUNITY AFFAIRS AND THE SAFE NEIGHBORHOOD TRUST FUND; INCLUDING A STATEMENT OF PURPOSE TO UTILIZE SPECIAL ASSESSMENTS ON REAL PROPERTY WITHIN THE DISTRICT; DESIGNATING THE MIAMI CITY COMMISSION AS THE BOARD OF DIRECTORS OF THE DISTRICT; PROVIDING FOR THE ESTABLISHMENT OF AN ADVISORY COUNCIL TO THE BOARD OF DIRECTORS COMPOSED OF PROPERTY OWNERS OR RESIDENTS OF THE DISTRICT; PROVIDING FOR THE OPTIONAL PROHIBITION OF THE USE OF ANY DISTRICT POWER AUTHORIZED BY SECTION 163.514 F.S.; PROVIDING FOR THE POWER OF THE CITY COMMISSION TO DISSOLVE THE DISTRICT BY RESCINDING THE HEREIN ORDINANCE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A Safe Neighborhood Improvement District, authorized by F.S. 163.504, to be known as the Overtown Local Government Neighborhood Improvement. District, located within the City of Miami, bounded on the East by the Florida East Coast Rail Road right-of-way, on the North by Northwest 20 Street until its intersection with Northwest 3 Avenue thence northerly to Northwest 22 Street thence westerly until its intersection with Northwest 5 Avenue thence southerly to Northwest 21 Terrace thence westerly until its intersection with US Interstate I-95, on the West by US Interstate 1-95 until its intersection with US Interstate I-395, and on the South by US Interstate I-395; containing approximately 201.0 acres, is hereby created. Section 2. The District and/or the City, on behalf of the District, is hereby authorized to receive a planning grant from the Safe Neighborhoods Trust Fund. I-()- 5`: Section 3. A Safe Neighborhoods Plan shall be prepared for the District for the coordinated, balanced, and harmonious development of the District, and for the reduction of crime through implementation of crime prevention through environmental design, environmental security or defensible space techniques. Although said District is hereby authorized to levy an ad valorem tax on real property of up too 2 mills annually, the Commission intends to fund improvements through the use of special assessments on real property within the District which assessments are hereby authorized pursuant to Chapter 170 F.S. and through other available means. Section 4. The City Commission is hereby designated as the board of directors of the District. Section 5. An advisory council to the board of directors, comprised of property owners and/or residents of the District, as appointed by the City Commission, is hereby established. Section 6. The City Commission, by ordinance, may prohibit the use of any District powers although said powers may be authorized by Section 163.514 F.S. Section 7. The City Commission may dissolve the District by rescinding the herein Ordinance. Section 8. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 9. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote not less than four -fifths of the members of the Commission. Section 10. Odio City Manager RECOMMENDATION CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE : FEB 2 1 1969 FILE : SUBJECT : Separate Emergency Ordinances Creating the Allapattah, Model City and Overtown Safe REFERENCES Neighborhood Improvement Districts ENCLOSURES: It is respectfully recommended that the City Commission approve separate emergency ordinances, creating the Allapattah Local Government Neighborhood Improvement District; Model City Local Government Neighborhood Improvement District; and the Overtown Local Government Neighborhood Improvement District, in accordance with F.S. 163.503, which authorizes each district to receive a planning grant from the Safe Neighborhoods Trust Fund as provided for in F.S. 163.504 and in F.S. 163.517. BACKGROUND In 1987, the State Legislature enacted the "Crime Prevention and Control Act." Part IV of this legislation created a mechanism for the establishment of Safe Neighborhood Districts, commonly referred to as the Safe Neighborhoods Program. This program is now entered in the Florida Statutes beginning with Section 163.501. By this act, the legislature declared that the development, redevelopment, preservation and revitalization of neighborhoods are public purposes for which monies may be expended, loaned or granted. In accordance with Section 163.504 F.S., planning funds may be requested from the Safe Neighborhoods Trust Fund. The City and the Wynwood Community Economic Development Corporation (WEDC) made a joint application on March 28, 1988, during the first round of funding, which was not successful under the first -come first - served filing procedure. The second round of funding began on October 26, 1988. The City and the WEDC have been notified that we are eligible to receive a grant, pending the outcome of the appeal period, which totals $280,000 (City $30,000 and WEDC $250,000). Agenda Item #54 (J-89-106/J-89-251) [Waiving prohibition in Code and authorizing execution of agreement] This Item has been redrafted to allow separate Commission consideration of the question of granting the waiver to Mr. Reginald A. Barker, and if granted, then the question of authorizing the execution of the contract with him for professional planning services in connection with the Southeast Overtown/Park West Development of Regional Impact (DRI). The granting of the waiver (J-89-106) requires a 4/5ths vote following a public hearing which has been advertised while the contract authorization (J-89-251) only requires a majority vote of the Commission. A copy of these two newly -drafted resolutions are attached for your consideration and should be substituted in the Agenda Packet.
