NAND CITY ATTORNEY 7 —2— 1.055i TO: Honorable Mayor and Members of the City Commission /f FROM C' ` G ``, Cesar H. Odio City Manager RECOMMENDATION CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM DATE : F ;+ B z 1 9 g FILE : SUBJECT: Separate Emergency Ordinances Creating the Allapattah, Model City and Overtown Safe REFeReNcesNeighborhood Improvement Districts ENCLOSURES: It is respectfully recommended that the City Commission approve separate emergency ordinances, creating the Allapattah Local Government Neighborhood Improvement District; Model City Local Government Neighborhood Improvement District; and the Overtown Local Government Neighborhood Improvement District, in accordance with F.S. 163.503, which authorizes each district to receive a planning grant from the Safe Neighborhoods Trust Fund as provided for in F.S. 163.504 and in F.S. 163.517. BACKGROUND In 1987, the State Legislature enacted the "Crime Prevention and Control Act." Part IV of this legislation created a mechanism for the establishment of Safe Neighborhood Districts, commonly referred to as the Safe Neighborhoods Program. This program is now entered in the Florida Statutes beginning with Section 163.501. By this act, the legislature declared that the development, redevelopment, preservation and revitalization of neighborhoods are public purposes for which monies may be expended, loaned or granted. In accordance with Section 163.504 F.S., planning funds may be requested from the Safe Neighborhoods Trust Fund. The City and the Wynwood Community Economic Development Corporation (WEDC) made a joint application on March 28, 1988, during the first round of funding, which was not successful under the first -come first - served filing procedure. The second round of funding began on October 26, 1988. The City and the WEDC have been notified that we are eligible to receive a grant, pending the outcome of the appeal period, which totals $280,000 (City $30,000 and WEDC $250,000). Section 165.506(d) F.S. designates the City Commission as the board of directors of an approved local government improvement district, which will establish an advisory council to the board of directors, which will be comprised of owners or residents of the district. Page 1 of 2 10557 2% -/ The proposed Allapattah Safe Neighborhood Improvement District has the following boundaries: N. W. 27th Avenue, N. W. 12th Avenue, N. W. 38th Street, and N. W. 23rd Street, and contains approximately 922 acres. The proposed Model City Safe Neighborhood Improvement District has the following boundaries: N. W. 62 Street, N. W. 59 Street, N. W. 17 Avenue, N. W. 19 Avenue, State Road 112, and N. W. 12 Avenue, and contains approximately 578 acres. The proposed Overtown Safe Neighborhood Improvement District has the following boundaries: N. W. 22 Street, N. W. 21 Terrace, N. W. 20 Street, I-95, I-395, and the F.E.C. Railway Right-of-way, and contains approximately 201 acres. Fer andez City At orn DATE : March 2, 1989 FILE SUBJECT : City Commission Agenda March 3, 1989 REFERENCES, Items # 2 6 , #27, #28 and #54 ENCLOSURES: ( 5 ) This memorandum will have to be distributed to the City Commission upon your receipt hereof or Agenda Items #26, #27 and #28 cannot be approved by me for City Commission consideration at the subject Meeting. Upon further review, the herein proposed modification to Agenda Item #54 (waiver and execution of contract) is deemed appropriate. Agenda Items #26. #27 and #28 [Emergency Ordinances authorizing creation of three Local Government Neighborhood Improvement Districts: J-89-217/Model City, J-89-218/Allapattah and J-89-219/Overtown] The distributed legislation for these Items contain an ill- defined set of boundaries for the Model City and Overtown Local Government Neighborhood Improvement Districts. The attached Ordinances now contain properly defined District boundaries and other language required by Statute and should be substituted in the Packet. Agenda Item #54 (J-89-106/J-89-251) [Waiving prohibition in Code and authorizing execution of agreement] This Item has been redrafted to allow separate Commission consideration of the question of granting the waiver to Mr. Reginald A. Barker, and if granted, then the question of authorizing the execution of the contract with him for professional planning services in connection with the Southeast Overtown/Park West Development of Regional Impact (DRI). The granting of the waiver (J-89-106) requires a 4/5ths vote following a public hearing which has been advertised while the contract authorization (J-89-251) only requires a majority vote of the Commission. A copy of these two newly -drafted resolutions are attached for your consideration and should be substituted in the Agenda Packet.
