RESOLUTION NO. 89-360
A RESOLUTION AUTHORIZING AND PERMITTING THE
RESTRICTION OF VEHICULAR ACCESS TO N.E. 70
STREET, N.E. 71 STREET AND N.E. 72 STREET AT
THE ZONING DISTRICT BOUNDARY LINE LOCATED AT
THE EASTERLY SIDE OF BISCAYNE BOULEVARD ON A
NINETY (90) DAY TRIAL BASIS BY CONSTRUCTING
TEMPORARY BARRICADES ACROSS SAID STREETS,
SUBJECT TO CITY COMMISSION REVIEW AND
PROVISIONS CONTAINED WITHIN THIS RESOLUTION.
WHEREAS, a group of property owners have requested
permission from the City to restrict vehicular access to N.E. 70
Street, N.E. 71 Street and N.E. 72 Street at the zoning district
boundary line located at the easterly side of Biscayne Boulevard;
and
WHEREAS, Section 54-17 of the Code of the City of MIamI,
Florida, gives the City Commission the power, after a properly
advertised public hearing to require that vehicular access to a
particular street be prohibited at an Intersection or zoning
district boundary line where such prohibition is found to be In
the best Interest of the public; and
WHEREAS, the City Commission has requested that the
Department of Public Works initiate the process to prohibit
vehicular access to N.E. 70 Street, N.E. 71 Street and N.E. 72
Street at the zoning district boundary line located at the
easterly side of Biscayne Boulevard; and

Department and the City of Miami Public Works Department have
made recommendations on the proposed prohibition of vehicular
access and have objections to the proposed restrictions; and

RNARKS:
WHEREAS, pursuant to due public notice, a public hearing was
held before the City Comm isslon on April 13, 1989 as to any
objections to the prohibition of vehicular access to N.E. 70
Street, N.E. 71 Street and N.E. 72 Street at the zoning district
boundary line located at the easterly side of Biscayne Boulevard
and no objections of substance were sustained by the Commission;
and
. WHEREAS, the City Commission finds that the herein
prohibition should be Instituted for a ninety (90) day trial
period to determine If said prohibitions are in the best Interest
of the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
-OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth In the
preamble to this resolution are hereby Incorporated by reference
and adopted.
Section 2. The Department of Public Works is hereby
directed to construct and maintain for a ninety (90) day trial
period, temporary barricades across N.E. 70 Street, N.E. 71
Street and N.E. 72 Street at the zoning district boundary line
located at the easterly side of Biscayne Boulevard.
Section 3. Sald barricades shall prevent vehicular access,
but not restrict pedestrian access.
Section 4. This Resolution shall become effective
Immediately upon Its adoption pursuant to law,
89--360.

The purpose of the April 13, 1989 public hearing is to hear
comments and consider a Resolution authorizing the temporary
restriction of vehicular access to N.E. 70, 71 and 72 Streets at
the zoning district boundary line located at the easterly side of
Biscayne Boulevard and, If approved by the City Commission,
determine a method of financing the construction and maintenance
of temporary barricades at these locations.
BACKGROUND:
On March 17, 1989 a group of citizens from the "Bayside"
neighborhood submitted a petition to the City Manager requesting
that vehicular access be restricted to N.E. 70, 71 and 72 Streets
at the zoning district boundary line located at the easterly side
of Biscayne Boulevard. The citizens request for vehicular access
restrictions at these locations Is in response to Increasing
undesirable traffic volume and crlrnc: trlthln their neighborhood.

As the City Commission noted at Its meeting of May 26, 1988, the
City of Miami has no more funds available for neighborhood street
closures. If these temporary traffic control measures are
adopted by the City Commission, a method of financing their
construction and maintenance must be Identified. The total cost
of a typical temporary barricade is estimated to be $1,000.00 per
street closure

to close N'E'70 3t.,0'E.71 St' and N.E. 72St' and use 69 Street as
the access street for the entire neighborhood.

PROPOSED RESTRICTION OF VEHICULAR ACCESS IN THE BAYSIDE
NEIGHBORHOOD
At the request of the property owners in the Bayside
neighborhood, the City Manager has instructed the Department of
Public Works to take steps to initiate the restriction of
vehicular access to N.E. 70 Street, N.E. 71 Street and N.E. 72
Street along the easterly side of Biscayne Boulevard. If
approved, these vehicular access restrictions would be
implemented on a
A public hearing has been scheduled for the April 13, 1989 City
Commission meeting to discuss these proposed access restrictions.
The public hearing will be held at Miami City Hall, 3500 Pan
American Drive, Dinner Key. Please contact the City Clerk's
office at 579-6065 after April 10th to ascertain the scheduled
time of the hearing.
Enclosed is a map showing the location of these proposed street
restrictions. Questions pertaining to the street restrictions
should be directed to Mr. Leonard Helmers, Highway Engineer, at
579-6865.
