ORDINANCE NO. W-574
AN EMERGENCY ORDINANCE AMENDING SECTION ONE
OF ORDNANCE NO. 10521, ADOPTED NOVEMBER
17, 1988, AS AMENDED, THE CAPITAL
IMPROVEMENT APPROPRIATIONS ORDINANCE, BY
INCREASING THE APPROPRIATION FOR THE EDISON
CENTER GATEWAY IMPROVEMENTS, PROJECT NO.
322054, IN THE AMOUNT OF $54,864 AS A GRANT
FROM TACOLCY ECONOMIC DEVELOPMENT AND IN THE
AMOUNT OF $24,000 IN THE FORM OF A GRANT FROM
THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10521 on November
17, 1988, to establish appropriations for capital improvements, continue
previously approved capital improvement projects, and establish new capital
improvement projects to begin during fiscal year 1988-99; and
WHEREAS, said Ordinance No. 10521, appropriated $60,000 for the
landscape construction of the Edison Center Gateway Improvements, Project
No. 322054; and
WHEREAS, Resolution No. 88-273 was passed on March 24, 1988, accepting a
payment of $24,000 from FDOT as a grant towards the development of the Edison
Center Gateway Improvement; and
WHEREAS , Resolution No. 89 -364 was passed on April 13, 1989,
accepting a payment of $54,864 from Tacolcy Economic Development Corporation as
a grant towards the development of the Edison Center Gateway Improvement; and
WHEREAS, competitive bids were received on November 22, 1988, and based
on the lowest acceptable bid submitted by Build -All Construction Inc., the
total project cost will be $65,975; and
WHEREAS the low bid may be withdrawn any the contractor if a contract is
not awarded within 60 days of the date of the bid opening; and
WHEREAS, it is now in order to increase the funds appropriated for the
Edison Center Gateway Improvements Project No. 322054, from $60,000 to
$138,864; specifically by $54,864 in a grant from Tacolcy Economic Development
Corporation Grant and by $24,000 in a State of Florida, Department of
Transportation Grant to enable a contract to be awarded to Build -All
Construction, Inc., for construction of said project;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 10521 adopted November 17, 1988,
as amended, is hereby further amended in the following particulars:i/
"Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City
of Miami , including new capital improvement projects scheduled to
begin during fiscal year 1988-89. The herein appropriations which
are hereby designated by reference to descriptive project title
and number also include appropriations for previously approved
scheduled projects as well as reappropriations of prior fund
appropriations. The source of revenues to support the herein
appropriations is hereby identified by fund and project with the
project appropriations and revenues therefor being set forth for
seven program (I-VII) areas based upon use or functional category
within said areas, as follows:

Section 2. All ordinances, or parts of ordinances insofar as they are
inconsistent or in conflict with provisions of this ordinance are hereby
repealed.
Section 3. If any section, part of section, paragraph, clause, phrase or
word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.

Section 4. This ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
safety, and property of the City of Miami and upon the further grounds of the
necessity to make the required and necessary payments to generally carry out
the functions and duties of municipal affairs.
Section 5. The requirements of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.
Section 6. This Ordinance shall become effective immediately upon its
adoption, pursuant to law.

The Departments of Planning and Public Works, in an effort to start construction
of the Edison Center Gateway Improvement Project located in the Model City area
along N. W. 12th Avenue and I-95 along N. W. 62nd Street and N. W. 58th Street and
N. W. 64th Street along N. W. 7th Avenue, consisting of the removal and
replacement of sidewalk, the addition of decorative brick pavers, and the planting
of solitaire palms, is proposing an amendment to the City's Capital Improvement
Appropriations Ordinance No. 10521 to increase the appropriation for the Edison
Center Gateway Improvement Project No. 322054, by $78,864.
Ordinance No. 10521, adopted on second reading November 17, 1988, appropriated
$60,000 for Edison Center Gateway Improvement. Competitive bids were received for
the project on November 22, 1988.
Based on the lowest acceptable bid submitted by Build -All Construction, Inc., the
total project cost for Phase I will be $65,975. However, since only $60,000 has
been appropriated, an additional $5,975 of the $78,864 must be appropriated in
order to award a contract and proceed with Phase I of the project. According to
the City's standard contract documents, the contractor has the right to withdraw
his bid if a contract is not awarded within 60 days of the date of the bid
opening.
The additional $78,864 are available from a $54,864 grant from the Tacolcy
Economic Development Corporation, and a $24,000 grant from the State of Florida
Department of Transportation.
