AN ORDINANCE AMENDING SECTION 38-82 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO PROVIDE THAT THE BAYFRONT PARK MANAGEMENT TRUST MAY RESERVE THE PARK ON BEHALF OF THE CITY FOR '.THIRTY (30) DAYS EACH YEAR FOR COMMUNITY USE OR TRUST SPONSORED EVENTS WHICH IS IN ADDITION TO THE 50% OF EACH YEAR THAT IS RESERVED FOR COMMUNITY USE; FURTHER PROVIDING THAT THE TRUST MAY WAIVE AMPHITHEATER RENTAL FEES DURING PORTIONS OF SUCH THIRTY (30) DAY PERIOD FOR NONPROFIT GROUPS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Section of the Code of the City of Miami, Florida, being herein amended provides for a thirty (30) day reservation of park use by the City acting by and through its City Manager; and WHEREAS, the Bayfront Park Management Trust, the agency and instrumentality of the City constituted to direct, manage and maintain Bayfront Park, subject to City Commission approval, is desirous of fulfilling its mandate by being authorized to reserve the park for community use and/or trust sponsored events on behalf of the City; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 38-82 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particularsl: "Sec. 38-82. Reservation of park use. Bayfront Park shall be reserved for community use fifty (50) percent of the days of each fiscal year. An additional thirty (30) days each year is reserved for use by the Q4-try trust, unless the 1 Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. 1L Q. 71. l trust has existing commitments for scheduled events on the requested day(s). The trust shall be empowered to waive the Bayfront Park Amphitheater rental fee during portion(s) of such thirty (30) day period when the AmPhitheater user is a bonafide nonprofit group, pursuant to Florida's General Nonprofit Corporation Act, which is exempt from federal taxation by virtue of Section 501(c)(3) of the Internal Revenue Code, as amended, as being organized and operated exclusively for charitable, scientific, testing for public safety, literary or educational purposes, or to foster national or international amateur sports competition, or for the prevention of cruelty to children or animals." Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective 30 days after final reading and adoption hereof, pursuant to law. PASSED ON FIRST READING BY TITLE ONLY this 3rd day of March , 1989.
