AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED; "SUMMER FOOD
SERVICE PROGRAM FOR CHILDREN 1989" AND
APPROPRIATING FUNDS FOR THE OPERATION OF SAME
IN THE AMOUNT OF $199,752.00, CONSISTING OF A
GRANT FROM THE UNITED STATES DEPARTMENT OF
AGRICULTURE THROUGH THE FLORIDA DEPARTMENT OF
EDUCATION; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT AWARD FROM THE UNITED STATES
DEPARTMENT OF AGRICULTURE AND TO EXECUTE THE
NECESSARY DOCUMENT (S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR THE ACCEPTANCE OF
THE GRANT AND IMPLEMENTATION OF SAID PROGRAM,
IN ACCORDANCE WITH APPLICABLE CITY CODE
PROVISIONS; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.
WHEREAS, the Florida Department of Education, Food and
Nutrition Management Division, with funding from the U.S.
Department of Agriculture, has agreed to allow the City of Miami
to participate once again in its Summer Food Programs; and
WHEREAS, said State agency will reimburse the City at a rate
of $1.925 per summer lunch, and $0.505 per supplement, which the
City provides to children within the parks of the City of Miami;
and
WHEREAS, each $1.925 reimbursement will provide $1.7850 for
operational and actual lunch cost, and $0.14 for administrative
costs of the program, and each $0.505 reimbursement will provide
$0.4675 for operational and actual supplement costs, and $0.0375
for administrative costs of the program; and
WHEREAS, an estimated 84,260 lunches and 74,360 supplements
will be served during the project period starting June 19 and
ending August 18,. 1989; and
WHEREAS, an estimated $199,752.00 will be received from the
State of Florida for carrying out said program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
preamble to this Resolution are herby approved, confirmed and

adopted by reference thereto and included herein as if fully set
forth in this Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: Summer Food Service for
Children - 1989.
RESOURCES: Grant Reimbursements from the
United States Department of
Agriculture through the
Florida Department of
Education.
APPROPRIATION: Summer Food Service Program
for Children - 1989.
$199,752.00

Section 3. This appropriation is contingent upon the
approval of the City's application .for said grant by the Florida
Department of Education and the City Manager's acceptance
thereof.
Section 4. The City Manager is hereby authorized to accept
the grant as set forth in the preamble to this Ordinance and to
execute the necessary document(s) in a form acceptable to the
City Attorney, to accept said grant and implement said program,
in accordance with applicable City Code provisions.
Section 5. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.

Section 8. The requirements of reading this Ordinance on
two separate days is hereby dispensed with an affirmative vote of
not less than four -fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon its adoption pursuant to law.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance establishing a Special Revenue Fund
for the Summer Food Service Program 1989 and appropriating funds
in the amount of $199,752.00 from a United States Department of
Agriculture (USDA) grant through the Florida Department of
Education for said program to be conducted in City parks from
June 19, 1989 through August 18, 1989.
BACKGROUND:
Since 1968, the City of Miami Department of Parks, Recreation and
Public Facilities has sponsored a Summer Food Service Program for
youths aged 18 and under. The City of Miami has provided a
nutritional lunch program in conjunction with the summer
recreation program which features arts and crafts, sporting
activities, field trips and special events. This year, we plan
to serve up to 1,915 lunches and 1,690 snacks per day using
twenty-eight (28) park sites throughout the City.
The Florida Department of Education, with funds from USDA, will
reimburse the City at a fixed rate of $1.925 per lunch, and
$0.505 per snack. This rate will provide sufficient funds to
cover the lunch cost and hire up to 43 temporary, part-time
recreation aides to operate the program.
The adoption of this Ordinance is requested as an emergency
measure so that start-up funds are in place prior to the
commencement of the Summer Food Program in June.
NOTE: A Resolution authorizing Metropolitan Dade County to
select a vendor or vendors for the program is also being
presented for City Commission action.

AN EMERGENCY ORDINANCE, AMENDING SECTION ONE
OF ORDINANCE NO. 10521, ADOPTED NOVEMBER 17, 1988,
AS AMENDED, THE CAPITAL IMPROVEMENT APPROPRIA-
TIONS ORDINANCE, BY INCREASING THE APPROPRIATION
FOR THE EDISON CENTER GATEWAY IMPROVEMENTS,
PROJECT NO. 322054, IN THE AMOUNT OF $54,864 AS A
GRANT FROM TACOLCY ECONOMIC DEVELOPMENT AND
IN THE AMOUNT OF $24,000 IN THE FORM OF A GRANT
FROM THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION; CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
Said ordinances may be inspected by the public at the Office of the
City Clerk, 3500 Pan American Drive, Miami, Florida, Monday through
Friday, excluding holidays, between the hours of 8:00 a,m. and 5:00
p.m.
