HomeMy WebLinkAboutO-10566J-89-384 03/24/89 ORDINANCE NO. 1_.0 0GC AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 10521, AS AMENDED, ADOPTED NOVEMBER 17, 1988, THE CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE, AS FOLLOWS: BY REAPPROPRIATING $50,000 FROM THE PROJECT ENTITLED "CITYWIDE VITA COURSE RENOVATIONS" PROJECT NO. 331308 TO THE PROJECT ENTITLED "CITYWIDE PARK EQUIPMENT" PROJECT NO. 331339, BY REAPPROPRIATING $75,000 FROM THE PROJECT ENTITLED "ATHALIE RANGE PARK REHABILITATION" PROJECT NO. 331070 TO THE •PROJECT ENTITLED "VIRGINIA KEY PARK DEVELOPMENT - PHASE I" PROJECT NO. 331044, BY INCREASING APPROPRIATIONS TO THE PROJECT ENTITLED "CITYWIDE NEIGHBORHOOD PARK RENOVATIONS" PROJECT NO. 331303 IN THE AMOUNT OF $10,000 FROM INTEREST EARNINGS FROM CAPITAL IMPROVEMENT FUNDS AND BY IDENTIFYING THE SOURCE OF FUNDING FOR THE PROJECT ENTITLED "ATHALIE RANGE PARK - POOL REPLACEMENT" PROJECT NO. 331348; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10521 on November 17, 1988, appropriating funds for Capital Improvement projects; and WHEREAS, the City Commission has identified certain projects within the Capital Improvement Program as being contained within the program conceptually entitled "The $8.3 million Citywide Neighborhood Park Renovations Program"; and WHEREAS, staff of the Departments of Public Works and Parks, Recreation and Public Facilities are in process of completing certain projects within "The $8.3 million Citywide Neighborhood Park Renovations Program"; and WHEREAS, during this process, it was determined that certain changes are required to facilitate the completion of work, to accommodate changes in park capital needs, and to provide funds for unforeseen work; and WHEREAS, work is nearly completed at twelve (12) parks under the $200,000 "Citywide Vita Course" Project No. 331308 and a balance of $50,000 remains; and WHEREAS, funding has been nearly exhausted in the $130,000 "Citywide Park Equipment" Project No. 331339 for the purchase and installation of playgrounds, picnic tables and benches at eleven (11) parks, but drinking fountains have not yet been purchased; and WHEREAS, the amount of $75,000 was appropriated within the "Athalie Range Park Rehabilitation" Project No. 331070 for restroom facilities to service the ballfields at that site; and WHEREAS, a purchase order has been issued for a prefabricated restroom building pursuant to Resolution No. 88-899 adopted October 6, 1988 and delivery of said building is imminent; and WHEREAS, under the recently established "Athalie Range Park - Pool Replacement" Project No. 331348, restrooms to service the ballfields will be constructed; and WHEREAS, a permanent restroom building is urgently needed at Virginia Key Beach to replace the portable toilets utilized at that facility since 1986 at an annual cost of $50,000 for rental and service; and WHEREAS, such changes were presented to the Park Advisory Board on March 7, 1989 and received the Board's approval; and WHEREAS, staff has additionally determined the need for roof replacement at Shenandoah Park and has identified funding in the amount of $10,000 from the Interest Earnings from Capital Improvement Funds, to be appropriated into the "Citywide Neighborhood Park Renovations" Project No. 331303 for this purpose; and WHEREAS, the "FY '89 Sunshine State Bond Pool Proceeds" has been identified as the proper funding source for the "Athalie Range Park - Pool Replacement" Project No. 331348, which was established by Ordinance No. 10529, adopted December 15, 1988; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1,O..Srw - 2 - Section 1. Section 1 of Ordinance 10521, adopted November 17, 1988, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during fiscal year 1988-89. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior fund appropriations. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the reservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Od City Manage ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Emergency Ordinance amending the Capital Improvements Appropriations Ordinance No. 10521 by reappropriating certain funds, by increasing certain other appropriations, and by identifying a funding source-.-f.or---spec-i-Lied---park projects, all as detailed below. BACKGROUND The Department of Parks, Recreation and Public Facilities has prepared the attached legislation as an emergency measure so as to have funds in place for the continuation of work on various capital improvement projects contained within the $8.3 million Citywide Neighborhood Park Renovations Program. More specifically, delayed adoption may jeopardize the installation of a restroom building and drinking fountains in certain parks prior to the start of the heavy summer season, and may contribute to the irreparable deterioration of the recreation building roof at Shenandoah Park. During the course of work on the various projects within this program, staff of Parks, Public Works, and the Strategic Planning Office have determined that certain fiduciary changes are required in order to facilitate the completion of work, to accommodate changes in park capital needs, and to provide funds for some additional urgent improvements. The following paragraphs detail these changes, which were discussed by the Park Advisory Board during their meeting on March 7, 1989. Actions 1 and 2, which directly affect the Board's original recommendation, were unanimously approved by the members present. ACTION 1: Reappropriate $50,000 from Citywide Vita Course Project to the Citywide Park Equipment Project for Drinking Fountains. Originally, $200,000 was allocated for Vita Courses at 10 parks. The project was later expanded to include 12 parks at a total cost of $133,700, or $66,300 less than originally budgeted. to )6,C, vo- , / Honorable Mayor and Members of the City Commission Emergency Ordinance: Amend C.T.P. for Park Projects page 2 On the other hand, only $130,000 was allocated to the Park Equipment Project, which includes playgrounds, picnic tables, benches, and drinking fountains in a total of 16 parks. With work nearing completion on the furnishings at a cost of $121,000, only $9,000 remains for the purchase and installation of 25 handicapped accessible drinking fountains, which are estimated at a cost of $50,000. We are proposing the transfer of $50,000 to the Equipment Project from the $66,300 balance available in the Vita Course Project for the purchase of the handicapped accessible fountains. This action would allow approximately $16,300 to remain in the Vita Course Project for the purchase and installation of at least one more vita course at a park site to be determined later. At the same time, we anticipate a $9,000 balance in the Equipment Project after the fountain purchase, which could be used to address the neod for additional tables and benches that have been requested for several more of our parks. ACTION 2: Reappropriate $75,000 from the Range Park Rehabilitation Project to Virginia Key Development for a Restroom Building. The original allocation to Range Park included $75,000 for a prefabricated restroom building to service the ballfields, and a purchase order has been issued for this purpose. Subsequently, the Commission called for the replacement of the pool at that site, and the architect has been able to incorporate the ballfield restroom (with separate access) into the bathhouse. Alternatively, Virginia Key Beach was reopened two years ago without permanent restrooms. Portable toilets are used at a cost of $50,000 per year for rent and service, but a permanent building is badly needed. ACTION 3: Increase the Appropriation to the Citywide Renovation Project by $10,000 for Roof Repair at Shenandoah Park. The roof of the recreation building severely deteriorated condition.
