A RESOLUTION REVERSING THE DECISION OF THE
ZONING BOARD AND DENYING THE SPECIAL
EXCEPTION AS LISTED IN ORDINANCE 9500, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, SCHEDULE OF DISTRICT REGULATIONS, PAGE
3 of 6, PRINCIPAL USES AND STRUCTURES, TO
ALLOW THE CONSTRUCTION AND OPERATION OF A
HELISTOP ON THE ROOF OF THE TERREMARK OFFICE
BUILDING UNDER CONSTRUCTION AT 2601 SOUTH
BAYSHORE DRIVE (MORE PARTICULARLY DESCRIBED
HEREIN) AS PER PLANS ON FILE, AND SUBJECT TO
A TOTAL OF ONLY TWO (2) TOUCHDOWNS PER DAY

P.M., NOT TO BE REGULARLY SCHEDULED; AND NO

WHEREAS, the Miami Zoning Board at its meeting of March 6,
1989, Item 4, following an advertised hearing, adopted Resolution
ZB 31-89 by a seven to two vote (7 - 2), granting the Special
Exception as listed in Ordinance 9500, as amended, the Zoning
Ordinance of the City of Miami, Schedule of District Regulations,
Page 3 of 6, Principal Uses and Structures, to allow the
construction and operation of a helistop on the roof of the
Terremark office building under construction at 2601 South
Bayshore Drive, also described as Lots 1-4 and 7 through 21
inclusive and that unnumbered lot lying southeasterly of Lot 7,
Block 39, according to the Amended Plat- of New Biscayne, as
recorded in Plat.

WHEREAS, the City Commission, after careftil consideration of
this matter and notwithstanding the decision of the Zoning Board,
finds that the appl.i.cati.on for a Special_ Exception does not meet
the applicable requirements of Zoning Ordinance 9500;
NOW, THEREFORE, BE IT RESOT�VED BY THE COMMISSTOq OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The decision of the Zoning Board in granting the
Special Exception as listed in Ordinance 9500, as amended, the
Zoning Ordinance of the City of Miami, Schedule of District
Regulations, Page 3 of 6, Principal Uses and Structures, to allow
the construction and operation of a tielistop on the roof of the
Terremark office building under construction at 2.601 South
Bayshore Drive, also described as Lots 1-4 and 7 through 21
inclusive and that unnumbered lot lying southeasterly of Lot 7,
Block 39, according to the Amended Plat of New Biscayne, as
recorded in Plat Book B, at Page 16, of the Public Records of
Dade County, Florida; as per plans on file, and subject to a
total of only two (2) touchdowns per day from Monday to Friday,
from 9:00 A.M. to 4:00 P.M., not to be regularly scheduled; and
no flying over the residential district; zoned RO-3/6 Residential
Office, is reversed and the Special Exception is hereby denied.

DISTRICT. The Special Exception as requested
meets the intent of Zoning Ordinance 9500. Elie
Planning Department does not leave any objections
to the proposed helistop to tic located at the
roof of the Terrc mark of ficc ' uilding, .ss long
as the touchdowns are liuited to only taro (2)
per day. No detrimental impact is anticipated
as a result of the proposed helistop if no
flying takes place over the nearby residential
neighborhood. The City of Miami Police
Department reserves the right for emergency
landings in case of need.

Commissioners reject heliport at Muss
Heeding the wishes of more than 100 people opposed to bu ldir:g
a heliport atop the Stephen Muss Convention Center, the ,Miami
Beach Commission unanimously rejected the proposal Wednesday at
a public hearing.
Just three months ago, the commissioners unanimously ap-
proved the project in concept. At that time, only 20 people protested
the proposal advanced by the Dade County Aviation Department.
The turnabout came after commissioners listened to IS speak-
ers pass the proposed heliport. They said the choppers would make
their neighborhoods noisier and more dangerous.
The heliport would have ferried people between Miami Interna-
tional Airport and Miami Beach. _
