The herein committee is hereby changed with the responsibility of reviewing the concerns expressed by the City Co4mi_ssion this date in regard to the District Systm of electing City Ccrrmission members as well as other questions in conn-ection with the g-miernance of the City of Miami including, but not limited to, adoption of an "executive -mayor" form of government. The comni_ttee shall report its findings and male advisory recommendations to the City Ccmi_ssion with full. staff support to be given by the City Manager and said corrmiittee shall receive assistance and counsel, as necessary, from the City Attorney. The chairperson of the said committee shall be selected by the committee from among its members. Section 2. The herein conmmittee shall present the City Carin.ission with interim status reports concerning committee activity at each City Commission Meeting, said reports to include a report on input from the public received by the committee at its meetings which shall be open public meetings. Section 3. The committee shall submit its final written report and recommendation to the City Ccmnission and shall deliver a copy of the same to the City Attorney no later than June 2, 1989. Fer an City Attorn SUBJECT Charter Amendment REFERENCES City Commission District Elections ENCLOSURES: 3 At your Special Meeting in January, you indicated that in November, 1989 there should be a referendum on the question of electing members of the City on a district basis as distinguished from the present at -large system which is provided for in the City Charter. In an attempt to -provide you with information which you may wish to consider in your deliberations on this subject, we have requested the County Elections Supervisor to furnish us with basic data concerning the current structure of the City's voting population. A copy of that request and the response thereto is attached (Attachment #1). Since the long- standing multi -ethnic or racial composition of the City Commission is commonly known and accepted as being a mirror-like reflection of the CitylS ethnic make-up or population, the apparent legal goal or objective in your deliberations will be to ensure that this reflective ethnic or racial balance be maintained and not lost or upset by the proposed change to the district system. With the above in mind and pointing out that the nominating election (primary) takes place November 7th with the general (run-off) election being held November 14th, we are presenting you with the critical dates for action to be taken by you in regard to (A) an election date of November 7, 1989 and (B) an election date of November 14, 1909. Where are; two steps required for either p ) or ( H) . First, let Mks rem nd you that there are: no City Cornaission meetings scheduled during the month of August. initially, you must ac-lopt: a prelir"°Einary (or Ist) resolution giving us sufficiently clear instructions as to nuiabor and locations of districts; i.e., whethor all or just a part of the five conmtission seats will be filled by district elections and whether you will be establishing district boundaries now or in the future. Second, upon completion of our drafting process which will incorporate or implement the directions and instructions given us as to the number and boundaries of the districts, you will adopt a final (or second) resolution approving the text of ( q '--/ 89--402 Honorable Mayor and Members of the City Commission Re: Charter Amendment/City Commission District Election April 11, 1989 Page 2 _P the Charter amendment and calling for the election (either (A), =s 11/7; or (B), 11/14). A time limitation in connection with the adoption of the preliminary or first resolution poses no problem whatever in regard to either election date. The only mandate that applies is that we bring back the completed draft for your approval by means of your adoption of the final resolution within 120 days from the date this first resolution is adopted. In connection with the final resolution, the following limitations are applicable: A. If you wish to have the election held on November 7th, then the final resolution may only be adopted at either the scheduled meeting of July 13th or July 27th. B. If you wish to have the election held on November 14th, then the final resolution may only be adopted at either the scheduled meeting of July 27th or September 14th. Finally, in the event changes are made in the meetings scheduled for July 13, July 27, or September 14, please be aware of the following limitations on time which apply to adoption of the final resolution by reason of the Dade County Charter (Sec.5.03) and the City Code (Sec.2-42): A. For an election on November 7, the latest calendar date to adopt the final resolution is September 8, 1989. B. For an election on November 14, the latest calendar date to adopt the final resolution is September 15, 1989. We have not on-iI.hw:asized the earliest date that this final resolution can be adopted since you will likely spend a considerable, length of time- in reaching a. con:: em sus on your definitive instructions that will guide our drafting effort in this final resolution. For reference-, the earliest calendar dates to adopt the final resolution are: (A.) July 10 for a November 7th election and (B) July 17 for the November 14th election.
