AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, BY CHANGING THE
ZONING CLASSIFICATION OF APPROXIMATELY
6500-6598 WEST FLAGLER STREET, MIAMI, FLORIDA
(MORE PARTICULARLY DESCRIBED HEREIN), FROM
RG-3/5 GENERAL RESIDENTIAL TO CR-2/7
COMMERCIAL RESIDENTIAL (COMMUNITY); BY MAKING
FINDINGS; AND BY MAKING ALL THE NECESSARY
CHANGES ON PAGE NO. 30 OF SAID ZONING ATLAS
MADE A PART OF ORDINANCE NO. 9500 BY
REFERENCE AND DESCRIPTION IN ARTICLE 3,
SECTION 300, THEREOF; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of
February 13, 1989, Item No. 3, following an advertised hearing,
adopted Resolution No. ZB 24-89, by a 9 to 0 vote, RECOMMENDING
APPROVAL of a change of zoning classification, as hereinafter set
forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of approximately
6500 to 6598 West Flagler Street, Miami, Florida, also described
as Lots 1-10, inclusive, Block 7, FAIR LAWN, as recorded in Plat
Book 8, at Page 83, of. the Public Records of Dade County,
Florida, from RG-3/5 General Residential to CR-2/7 Commercial
Residential (Community).

Section 2. it is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts:
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(.f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Page No. 30 of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.

clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not he affected.

REQUEST
Change of Zoning Classification in the Official
Zoning Atlas of Zoning Ordinance 9500, as
amended, the Zoning Ordinance of the City, of
Miami, From RG-3/5 General Residential to CR-2/7
Commercial Residential (Community).
RECOMMENDATIONS
PLANNING DEPARTMENT
APPROVAL. The proposed change is in conflict
with the adopted Miami Comprehensive
Neighborhood Plan, and requires a plan
amendment, there is a companion item being
presented before the Planning Advisory Board,
with Planning Department recommendation for
approval. The proposed change is in harmony
with the established land use pattern, there is
commercially used land adjacent both to the east
and west of the subject site; furthermore, the
proposed change creates a district related to
adjacent and nearby districts. The change
suggested is in scale with the needs of the
neighborhood. There have been changing
conditions in the immediate area surrounding the
subject property that make the passage of the
proposed change necessary.

AND TRANSPORTATION
No comments.
ZONING BOARD At its meeting of February 13, 1989, the Zoning
Board adopted Resolution ZB 24-89, by a 9 to 0
vote, recommending approval of the above to the
City Commission.
One proponent was present at the meeting.
One reply in favor and seven objections were
received by mail. I —

ATTACHMENT TO APPLICATION FOR AMENDMENT TO ZONING ATLAS
9. It is the belief of the owners of this entire block that
the existing plan is inapproprite since the abutting blocks
(6400 block of Vest Flagler and the 6600 block of West
Flagler) are currently zoned CR-2-7. Furthermore, by
maintaining the existing zoning of RG-3-5, you are depriving
the owners of this particular block of their right to utilize
the property in the same or similar fashions as their
adjoining neighborhood.
10. It is our belief that the zoning change request is justified
in that the character of the neighborhood would ndt be__'
significantly altered by the change in zoning to CR-2-7,
which would allow light commercial use of the property.
Additionally, all owners of lots in this particular block
are in favor of said proposed change, which would allow
them additional flexibility as to the use of their property.
Finally, the change, besides imparting value and increasing
the tax base for the City of Miami, would also be contiguous
with the two abutting blocks and provide a continuity to
the neighborhood.
