HomeMy WebLinkAboutO-10580J-89-175 2/16/89 ORDINANCE NO. 1.015, 8 A REMEDIAL ORDINANCE AMENDING THE ZONING ATLAS OF ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION FOR PROPERTY LOCATED AT APPROXIMATELY 879 NORTHEAST 78TH STREET, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FROM COMBINATION OF CR-3/7 COMMERCIAL RESIDENTIAL AND RS-2/2 TO CR-3/7 COMMERCIAL RESIDENTIAL; MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 9 OF SAID ZONING ATLAS. WHEREAS, commencing in 1978, the zoning boundary was erroneously shifted to mid -lot of Lot 21 on the Zoning Ordinance Atlas sheet; and WHEREAS, since 1970, and continuing through Comprehensive Zoning Ordinance No. 9500, the incorrect mid -lot line has been retained; and WHEREAS, the Miami Planning Advisory Board, at its meeting of February 1, 1989, Item No. 5, following an advertised hearing, adopted Resolution No. PAB 8-89, by a 9 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the zoning ordinance of the City of Miami, Florida, as amended, is hereby amended by changing the zoning classification of real property located at approximately 879 Northeast 78th Street, Miami, Florida, more particularly described as Lot 21, Block 21, 10 R0. SHORE CREST, Plat Hook 10, Page 23, Public Records of Dade County, Florida, from a combination of CR-3/7 Commercial Residential and RS-2/2 to CR-3/7 Commercial Residential. Section 2. It is hereby found that this zoning classification change: (a) Is in oonformity with the adopted Miami Comprehensive Neighborhood Plan; (b) Is not contrary to the established land use pattern; (o) Will not create an isolated district unrelated to adjacent and nearby districts; (d) Is not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Page No. 9 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. -2- 1. Q•580 - .1 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 5. if any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 6. Lot 21 Block 21 SHORE CREST (10-23) P.R.D.C. _ Consideration of a corrective amendment to Zoning Atlas Sheet #9, Ordinance 9500, as amended, the Zoning Ordinance of the City of Miami by changing, and clarifying, the zoning designation of the entire lot from a combination of CR-3/7 COMMERCIAL RESIDENTIAL (GENERAL) and RS-2/2 ONE FAMILY DETACHED RESIDENTIAL to CR-3/7 COMMERCIAL RESIDENTIAL (GENERAL). REQUEST To correct an error pertaining to a zoning district boundary on the subject site. ANALYSIS The Planning Department proposes this corrective amendment to Zoning Ordinance 9500 to designate the entire lot as CR-3/7 by reason of the following sequence of events: - In 1965, the subject lot was zoned R-1 One Family Residential; - In 1966, same as above; In 1967 by Ordinance 7556; May 8, 1967 the zoning classification of the lot was changed from R-1 to C-4 General Commercial; - In 1967 the Commission (on appeal) by Resolution 38600; April 24, 1967 granted a variance to the distance requirements for a gasoline service station on the lot; - Subsequently, a gasoline service station was built; - Commencina with 1967, the Comprehensive Zoning Ordinance Atlas sheet was not continuouoslv corrected to show the correct zoning for the subject lot; PAB 2/1/89 Item w5 Page 1 Commencing in 1978; :he zonina boundary was erroneously shifted to mid -lot of Lot 21 on the Zonina Ordinance Atlas sheet; since 1970, and ontinuina yhrouah Comprenensive "-•mina Ordinance 9500, the incorrect mid -lot line has oeen retained. PLANNING ADVISORY BOARD At its meeting of February 1, 1989, the Planning Advisory Board adopted Resolution PAB 8-89, by a 9 to 0 vote, recommending approval of the above to the City Commission.
