RESOLUTION NO,
A RESOLUTION RESTRICTING VEHICULAR ACCESS TO
NORTHWEST FIRST AVENUE BETWEEN THE F.E.C.
RAILROAD RIGHT-OF-WAY AND NORTHWEST EIGHTH
STREET DURING EVENTS HELD AT THE MIAMI ARENA,
SUBJECT TO THE PROVISIONS CONTAINED IN THIS
RESOLUTION.
WHEREAS, the traffic congestion on Northwest First Avenue
between the F.E.C. Railroad Right -of -Way and Northwest Eighth Y'
Street for the periods commencing one hour prior to each
scheduled event at the Miami Arena located at 721 Northwest 1st
Avenue ("Arena"), and ending one hour after the end of each such
_ event has raised concern about the possibility of severe '
accidents Involving pedestrians arriving at the Arena via
Metrorall and by other means; and

WHEREAS, the Police Department has requested a temporary -
restriction of vehicular access to Northwest First Avenue between
the F.E.C. Railroad Right -of -Way and Northwest Eighth Street for
the periods commenting one hour prior to each scheduled event and
ending one hour after such event has ended; and

WHEREAS, the proposed limited prohibited access has been
reviewed by the Departments of public Works, Fire, Rescue and
inspection Services and Solid Waste, and has not been found:
objectionable by any of the said departments; and
WHEREAS, Section 54-17 of the Code of the City of Miami,
Florida, gives the City Commission the power, after a properly
advertised public hearing to require that vehicular access to a
particular street be prohibited at an intersection or zoning
district boundary line where such prohibition Is found to be in
the best interest of the public; and
WHEREAS, pursuant to due public notice, a public hearing was

held before the City Commission on April 27, 1989 as to any
objections to the temporary prohibition of vehicular access to
Northwest First Avenue between the F.E.C. Railroad Right -of -Way
and Northwest Eighth Street and no objections were sustained by
the City Commission; and
WHEREAS, the City Commission finds that the herein temporary =

prohibition Is In the best Interest of the public and wishes to,
approve Its Implementation;
t NOW,,_THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY _

4 Section 1. The recitals and findings set forth in the

Preamble to this Resolution are hereby approved, confirmed and ,
adopted by reference thereto and Incorporated herein as If fully
set forth In this Section.
Section 2. Vehicular access to Northwest First Avenue }'

Install and maintain said barricades,
Section S. The Miami Sports Authority shall pay all costs
related to the installation and maintenance of said barricades.
Section S. This Resolution shall become effective
Immediately upon Its adoption pursuant to law.

RECOMMENDATION:
It Is respectfully recommended that the C 1 ty, CcmmI ss I on adopt the
attached Resolution formalizing Motion 89-90 approved at the
January; 26 1989 Commission=meeting for the restrlctlon' of
vehicular access to N.W. 1 Avenue during Miami Arena events.
BACKGROUND: {
— At the January 26, 1989 City Commission meeting, Motion 89-90 was s 'u
'passed approving, the' restriction of vehicular access to N.W. 1
Avenue between the F.E.C. Railroad right-of-way and N.W. 8 Street t.-
duriny`Miami Arena events. This motion ,was' In. response to a `4
request by the Poi ice Department concerning pedestrian safety, x_
when crossing N.W. 1L Avenue between the Overtown Station of
Metrorail and the Miami Arena.
